HomeMy WebLinkAbout3653_CCv0001.pdf RESOLUTION NO. 3653 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS PROVIDING FOR BUILDING PERMIT EXPIRATION AND EXTENSIONS WHEREAS, the 1979 Edition of the Uniform Building Code will revise building permit criteria with amended time frames and provisions for permit extensions; and WHEREAS, it is anticipated that the City of Redlands will not formally adopt the 1979 Edition of said code until July, 1980, in coor- dination with the San Bernardino County and adjacent cities; and WHEREAS, the current adopted Building Codes do not have provisions for extension of the time for which work may commence; NOW, THEREFORE, THE CITY OF REDLANDS does hereby resolve to pro- vide for permit extensions, amended permit time periods for start of construction, and for the definition of "start of construction" as follows: "Every permit issued by the Director of Building and Safety under the provisions of the Uniform Building Code shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced within 180 days from date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 180 days. Before such work can be recommenced, a new permit shall be first obtained, and the fee therefor shall be one-half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided further that such suspension or abandonment has not exceeded one year. "Any permitee holding an unexpired permit may apply for extension of the time within which he may commence work under that permit when he is unable to commence work within the time required by this resolu- tion for good and satisfactory reasons (unforseeable causes beyond the control and without fault or omission of the permittee, including but not restricted to 'Acts of God, ' strikes, fires, floods , epidemics, or severe weather) , provided further, that any fee imposed by the City as a condition of the issuance of a building permit which was established or increased subsequent to the issuance of the original permit shall be paid in the amount as required for a new permit at the date of the extension of the permit. The Director of Building and Safety may extend the time for action by the permittee for a period not exceeding 180 days upon written request by the permittee providing evidence of the circumstances beyond the control of the permittee which have pre- vented action from being taken -- NO permit shall be extended more than once. In order to renew action on a permit after expiration, the permittee shall pay a new full permit fee. "For the purpose of this resolution ' start of construction' means the placement of permanent construction of a structure on a site, such as the pouring of slabs or footings or any work beyond the stage of excavation and temporary concrete forming. Permanent construction does not include land preparation, such as clearing, grading, and filling; nor does it include the installation of streets and/or walkways; nor does it include the excavation for a basement, footings, piers, or foundations; nor the placement of plumbing or electric wiring; nor does it include the installation on the property of accessory buildings, such as garages or sheds not occupied as dwelling units or not as a part of the main structure. "For a structure without a basement or poured footings, the ' start of construction' includes the first permanent framing or assembly of the structure or any part thereof on its piling or foundation.
