HomeMy WebLinkAbout4334_CCv0001.pdf RESOLUTION NO. 4334 A RESOLUTION OF THE CITY OF REDLANDS ESTABLISHING RULES AND REGULATIONS GOVERNING THE USE AND OPERATION OF HILLSIDE MEMORIAL PARK, A CEMETERY OWNED AND OPERATED BY THE CITY OF REDLANDS, AND RESCINDING RESOLUTION NO. 3551 WHEREAS, under Health & Safety Code Section 8130, the general management and operation of Hillside Memorial Park is under the jurisdiction and control of the City of Redlands ( "City" ) ; and WHEREAS, pursuant to Health & Safety Code Section 8133, the City may make and enforce general rules and regulations pertaining to the use and operation of Hillside Memorial Park ;. and WHEREAS, the City previously has adopted rules and regulations pertaining to the use and operation of Hillside Memorial Park; and WHEREAS, it is desired to adopt new rules and regula- tions to replace those which were adopted previously; THE CITY COUNCIL OF THE CITY OF REDLANDS DOES HEREBY RESOLVE as follows: SECTION 1 . Sale, Transfer and Repurchase of Lots and Crypts. (a) All burial lots, crypts and niches sold within the boundaries of Hillside Memorial Park ( "cemetery" ) shall be used for no purpose other than the interment of the human dead. (b) Owners shall not transfer or resell their lots, crypts, or niches to any person, but may at any time resell them to the Cemetery Fund. The price paid by the Fund shall not exceed one-third (1/3) of the current selling price of an equivalent interment space in Hillside Memorial Park, excluding endowment fee, or an amount equal to that received for the interment space when last sold, whichever is greater, less charges for any services actually rendered. (c) The sale of burial lots in the cemetery shall not be made after the natural interment has taken place therein, unless and in accordance with all existing laws, all bodies have been removed therefrom. (d) Prices of lots, endowment costs, interment charges, sales prices of resale merchandise, and other miscellaneous charges shall be established by executive order as autho- rized by Chapter 3.16 of the Redlands Municipal Code. SECTION 2. Fees and Credit Regulations. (a) No interment shall be allowed unless and until the purchaser has paid to the city an amount equal to the interment fee for such interment . The only exceptions shall be those cases in which all burial charges are to be paid from an estate, and then only after the Cemetery Supervisor , or his representative, has verified with the Administrator or Executor of the estate that there will be sufficient funds to satisfy all such burial charges. (b) In cases of extreme emergency, the grave space may be paid for in full within twelve ( 12) months from date of interment, subject to payment of a handling fee of 12 percent (12%) of the unpaid balance. This charge is non- refundable in the event of prepayment of the contract balance. (c) There shall be a handling charge of twelve percent ( 12%) of the unpaid balance of any preneed sales contract for cemetery grave spaces, niches and crypts. This one-time charge may be collected in cash in addition to the down payment received, or may be added to the unpaid balance and collected as part of the contractual monthly payments. The handling charge shall be calculated on the unpaid balance. This charge is non-refundable in the event of subsequent prepayment of the contract balance. -2- SECTION 3 . Monument and Marker Regulations. (a) All markers shall be of first quality granite or bronze. Only flat markers of standard sizes set flush with the ground shall be permitted. EXCEPTION: Replacement of existing upright markers shall be permitted with the approval of the Cemetery Supervisor. (b) Only one marker shall be placed upon any single grave or crypt. (c) Permitted marker sizes are as follows: MAXIMUM MINIMUM aah—v Grave 18" wide, 301" long 61" x I2" 61" x I21" Baby Grave 30" wide, 54" long 8" x 161" 91" x 16" Ash Interment Space, 361" x 24" 81" x 161" 81" x 16" Adult Grave, single 361" x 108" 12" x 24" 12" x 24" Adult Grave, double depth - 48" x 108" 12" x 2411 12" x 2411 Adult Grave, double-side by side 72" x 108" 151" x 36" 14" x 30" (d) No bronze plates, inscriptions, or embellishments of any kind, other than the regulation name plate will be permitted on mausoleum crypts or niches. (e) No marker or improvement of any kind other than the improvements made by the Cemetery Supervisor shall be permitted on any space or lot until all cemetery charges for that space or lot have been paid for in full. Markers shall not be permitted in an "unendowed" area unless the per space endowment care charge is paid. (f) The cemetery is not liable for repair or replace- ment of monuments, markers, or cement borders damaged due to aging, lifting by tree roots, earthquake or vandalism.. SECTION 4. Cemetery Grounds. (a) Papers and trash shall be deposited in the containers provided. (b) Picnicking or lying on lawns or benches on cemetery grounds is prohibited. (c) As provided in section 12.45.020 of the Redlands Municipal Code, no dogs are allowed on cemetery grounds unless confined within an automobile. -3- (d) Placement of artificial flowers is not permitted any- where in the cemetery. All artificial flowers shall be removed by August 1, 1988 . (e) The removal of any flower vase installed by cemetery personnel , or its contents, or any portion thereof, from any grave in the cemetery to another grave in or outside of the cemetery by other than cemetery personnel is prohibited. ( f) All flower vases must be of an approved reversible type. No other flower containers shall be permitted. (g) A maximum of 3 vases may be placed on any standard grave space. The cemetery is not liable for replacement of vases due to normal aging or vandalism. (h) The placing of potted plants, glass vases, paper- mache containers and similar items on mausoleum floors, is not permitted with the following exceptions: Easter , Mother ' s Day, Decoration Day and Christmas, and then only for a period of five days after the holiday. ( i ) The Cemetery Supervisor is authorized to enter upon any and all lots and spaces and to remove therefrom any objectionable material that has been placed thereon. SECTION 5. Interment Regulations. (a) The laws of the State of California require a Burial Permit . No interment will be allowed without such a permit. (b) Opening of caskets at the cemetery is not permitted except in special circumstances when approved by the Cemetery Supervisor . (c) Interments shall not be made in wooden boxes. Only concrete bell liners or concrete vaults with arched lid shall be used to protect the casket . In the uncared-for area of Section "F" and the infant area of Upper "J" , a burial without the protective box shall be permitted in destitute and special cases. (d) Double depth interments may be made only in a standard single space ( 4 ' x 10 ' ) in specified areas. ( e) Ashes may be interred in spaces already occupied by a body, but not more than two ash interments with a body, or three ash interments without a body shall be allowed in a single ground space. One whole body and one ash interment may be made in one crypt . No more than two ash interments may be made in one crypt . -4- ( f) Subject to the approval of the City Manager, the Cemetery Supervisor is authorized to cause the interment of any destitute person, provided that such interments shall be made in the most inexpensive section of the cemetery. The proof of destitution shall become the permanent record of the cemetery. (g) The cemetery office operating hours are Monday through Friday, 8: 00 a.m. to 4: 30 p.m. (h) Overtime work rates will be charged for all funerals leaving the cemetery after 3 : 00 p.m. , Monday through Friday, and after 11: 00 a.m. on Saturday. ( i) Except in cases of extreme emergency, as determined by the Cemetery Supervisor, interments will not be authorized on Saturdays, Sundays or holidays observed by city employees. When such an interment is authorized, the interment charges will be doubled. ( j ) Twenty-four ( 24) hours ' advance notice is required for all interments. (k ) Hillside Memorial Park reserves, and shall have, the right to correct any errors which may be made in making interments, disinterments, or removals, or in the descrip- tion, transfer or conveyance of any interment property. Corrections may include the cancelling of a conveyance and substituting and conveying in lieu thereof other interment property of equal value and similar location insofar as is possible, or as may be selected by the cemetery; or in the sole discretion of the Cemetery Supervisor, by refunding the amount of money paid on account of said purchase. In the event the error involves the interment of the remains of any person in such property the Supervisor reserves, and shall have, the right to remove and re-inter the remains in such other property of equal value and similar location as may be substituted and conveyed in lieu thereof. (1) Hillside Memorial Park shall exercise due care in making a disinterment and removal, but shall assume no liability for damage incurred to any casket, burial case, or urn in making disinterment and removal . Disinterments for removal from the cemetery shall not be made unless autho- rized by the written order of a court of law. -5- SECTION 6. Resolution No. 3651, including any and all amendments thereto, is hereby rescinded. SECTION 7. This Resolution shall become effective immediately upon its adoption.
