A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DELEGATING TO THE CITY MANAGER THE AUTHORITY TO APPROVE
AGREEMENTS FOR THE CITY'S MAINTENANCE OF LANDSCAPING AND
IMPROVEMENTS IN CALTRANS' RIGHTS-OF-WAY
WHEREAS, the City of Redlands commonly conditions private development projects on
the installation of landscaping and other improvements in rights-of-ways owned by Caltrans; and
WHEREAS, Caltrans has recently established the policy of not permitting the installation
of such landscaping and improvements without the City first entering into an agreement with
Caltrans for the long term maintenance and repair of such landscaping and improvements; and
WHEREAS, Caltrans has developed a "standard" form of maintenance agreement which
is not subject to significant change by the City; and
WHEREAS, the City Council regularly approves such maintenance agreements with
Caltrans; and
WHEREAS, for purposes of efficiency and economy in the use of City resources, and to
avoid unnecessary delay in connection with the completion of private development projects, City
staff has recommended the City Council delegate the authority to approve such agreements to the
City Manager;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Redlands
as follows:
Section 1. The City Council of the City of Redlands hereby delegates the authority to
the Redlands City Manager, or his or her designee, to approve agreements for the City's
maintenance of landscape and improvements in Caltrans' rights-of-way, when such agreements
are substantially in the form attached hereto as Exhibit"A."
Section 2. Upon approval and execution of such landscape and improvement
maintenance agreements with Caltrans, a copy of each such agreement shall be delivered to the
office of the City Clerk for filing in the City's official records.
ADOPTED, SIGNED AND APPROVED this 4th day of November, 2008.
