This agreement, made ea this 2nd day of duly 1962, by and betw a the
Cemetery Madowmeat Fund, a Truet, hereinafter called the Fnd, and the City of
Redlands, 4 Municipal Corporation, hereinafter called the City.

That for and in consideration of the payment of the rents, la the manner
hereinafter specified, on th part of City, the Pond does hereby loane, demise
and let unto City that certain 7 acres more or less of real property hereinafter
Called "Property" in the County of San Bernardino, State of California, described
as followat
The southwest 114 of lot 20, 0arton Rauch, as per plat recorded in
book 0 of Maps, page 100 records of said county. Excepting there-
from the north 132 feet. Also excepting therefrom the east 164.46
feet.
Property may be used by City for all lawful and proper purposes, during
the term of this lease, which shall IP).22,0..Yeara, commencing en the lot day of

July 1962, and ending on the Oth day of Juno 19;10 at the following rentpi:
Annually, beginning September 1, 10030 the City to pax an amount equal
to 25% of the gross incoKe produced from the property for the preceding fiscal
year, or;
An amount equal to a varying percentage of $32,000.00 calculated by the
ratio that the total fiscal revenue derived from the other invested monies or
the Cemetery Endowment Pond is to the June 30th total of other investments of
the same fiscal year, whichever ij the greater.
The City hereby agrees that the Fund As to be free from all liability and
claim for damages by reason of any injury to any person or persons, including City
personnel or property of any kind whatsoever and to whomsoever belonging, including
the City, from any cause or causes whatsoever while in, upon, or in any uay
connected with the said demised real property or the streets adjacent thereto
during the term of thin lease or boy extension hereof or any occupancy hereunder.
The. City hereby covenanting and agreeing to indemnify and save harmless the Fund
from all liability, loss, cost and/or obligations on accountof or arising out
of any such injuries. or losses however oeourring4
The City shall have theoption. to repurchase sald real property on any
July 1st during.. the term of this lease by paying 152,00.00 to. the. Rudd At the
expiration of this lease, the City. covenants. and agrees that said real propertY
will be repurehawA by payment of 432400000 to 1.7be Fend. Repurohase will not
waive payment of the rental above set forth for the fiaeal year. pr4eeding: purchase
date"
In witness whereof the Administrator of the Cemetery Endowment and has
hereunto set his hand and the City of Redlands has caused this lease to be signed
