HomeMy WebLinkAboutContracts & Agreements_192-2022FIRST AMENDMENT TO PUBLIC WORKS CONSTRUCTION CONTRACT This first amendment ("First Amendment") to the Public Works Construction Contract for the Orange Blossom Trail Phase 3 Project dated June 7, 2022 (the "Contract"), by and between the City of Redlands, a municipal corporation and general law city ("City"), and Deark E&C, Inc., a California corporation ("Contractor"), is made and entered into this 20"' day of September, 2022. RECITALS WHEREAS, it is the desire of the City and Contractor to amend their existing Contract, speeil`ically to amend the Time for Completion of the Contract; and WHEREAS, the City Council approved the contract with contractor for work in accordance with the Contract Documents for City's Orange Blossom Trail Phase 3 Project, Project No. S241001; NOW, THEREFORE, in consideration of the mutual promises contained herein City and Contractor agree as follows: AGREEMENT Section 1. The time for completion, as set forth in Section 3 of the Contract, is herby amended to increase Contractor's time for completion and shall read as follows: "TIME FOR COMPLETION: the Work shall be completed within One Hundred Eighty (l80) calendar days from and after the date of City's issuance of a Notice to Proceed to Contractor." Section 2. All other provisions of the Contract sliall remain unchanged by this First Amendment, and in effect.
