Though the majority of the grove has done well, the final phase, which includes the newest 550 trees, was subject to the phytophra fungus (commonly referred to as "root rot"). Concerned that the grove could not be managed within the guidelines of the citrus preservation policy, the Citrus Preservation Commission delayed any action accepting the grove until the phytophra fungus problem was solved. With the phytophra fungus problem now apparently solved, the Citrus Preservation Commission voted unanimously on June 13, 2006, to accept the donation of the University Groves under conditions contained in the staff report. Pat Meyer reviewed other citrus groves within developments that will be maintained by a Community Facility District or Home Owner Association. Counncihnember Gilbreath roved to accept the offered citrus grove (approximately 23.54 acres commonly known as "University Groves") from Standard Pacific Homes to be managed by the Citrus Preservation Commission. Motion seconded by Councilmember Gallagher and carried by AYE votes of all present. Agreement - Payless ShoeSource Distribution - Redevelopment Agency Director Gee reviewed the proposed agreement to provide a development incentive and operating covenant agreement with Payless ShoeSource Distribution, Inc. Saul Gomez, Ernst & Young, reviewed the proposal in detail. On behalf of Payless ShoeSource, Aaron G. Hove, thanked staff for their negotiating efforts, and noted how pleased they were to be coming to the Redlands' area. City Attorney McHugh answered questions regarding the sales tax revenue agreement currently in effect with the County of San Bernardino. Councilmember Gallagher moved to approve the development incentive and operating covenant agreement with Payless ShoeSource Distribution, Inc. and authorized the Mayor to execute, and the City Clerk to attest to, the document on behalf of the City. Motion seconded by Councilmember Aguilar and carried by the following vote: AYES: Councilmembers Gallagher and Aguilar; Mayor Harrison NOES: Councilmember Gilbreath as she does not philosophically support incentive agreements ABSENT: Councilmember Gil JOINT MEETING - CITY COUNCIL AND REDEVELOPMENT AGENCY Project Area Committee Meeting - Redevelopment Agency Director Gee reviewed the actions of the Project Area Committee meeting held on July 11, 2006. Committee members expressed their desire to continue beyond the anticipated expiration date of October 7, 2006, and recommended the City Council extend the Project Area Committee services for another year. G COUNCIL MEETING OF 08-01-06 REQUEST FOR COUNCIL ACTION SUBJECT: OFFER OF A DONATION OF AN ESTABLISHED CITRUS GROVE TO BE MANAGED BY THE CITRUS PRESERVATION COMMISSION MOTION: I move to accept offered citrus grove (Approximately 23.54 acres commonly known as "University Groves") from Standard Pacific Homes to be managed by the Citrus Preservation Commission. or I move to deny the offered land from Standard Pacific Homes. CITRUS PRESERVATION COMMISSION RECOMMENDATION: At the Regular Meeting on Tuesday, June 13, 2006, The Citrus Preservation Commission unanimously voted to accept the donation of University Groves by Standard Pacific Homes. DISCUSSION: The Citrus Preservation Commission has anticipated acquiring University Groves for many years. Though the majority of the grove has done well, the final phase, which includes the newest 550 trees, was subject to the phytophra fungus (commonly referred to as "root rot"). The phytophra fungus was initially treated with soil amendments, which failed to solve the problem. Multiple tree replantings were required. Concerned that the grove could not be managed within the guidelines of Citrus Preservation Policy, the Citrus Preservation Commission delayed any action accepting the grove until the phytophra fungus problem was solved. Eventually, many yards of soil had to be removed and replaced with imported soil to allow the new trees to be planted and mature successfully. Since the soil replacement, the trees have taken root, and are growing normally. With the phytophra fungus problem now apparently solved, the Citrus Preservation Commission voted unanimously to accept the donation of University Groves under the following conditions: • Standard Pacific Homes will pay an unrefundable amount of $32,482.61 for four years of cultural care of the 550 new trees which are planted in the area previously affected by the phytophra fungus. • Standard Pacific Homes will deposit an additional $15,917.33 for four years to cover the costs of replacing any of the 550 trees. At the end of three years, the deposit will be returned to Standard OFFER OF LAND FOR CITRUS GROVE City Council Meeting of 08/01/06 Page 2 Pacific Homes, minus any funds used to replace trees. This deposit can only be spent on replacement of trees. Mr. Pat Meyer, representative of Standard Pacific Homes, has accepted these conditions, and has provided the City with a check in the amount of $48,399.94. Legal documents transferring the property to the City of Redlands have also been prepared. The transfer of the property and deposit of funds can be executed upon City Council approval. FISCAL IMPACT: If the Council chooses to accept the land donation, it will be accepting the responsibility to care for University Groves, under the conditions placed upon the newest 550 trees. The current cost for cultural care of a grove is approximately $1,000.00 per acre, minus net sales revenue. Actual costs per acre will be determined after the Council has accepted the donation of University Groves, and a contractor has provided a cost estimate to provide care of the grove. City would hold this deposit for three years to pay for any tree replacement. Any funds not used for this purpose would be refunded to the Developer at the end of three years.
