HomeMy WebLinkAbout8330RESOLUTION NO. 8330 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS CONFIRMING THE AMOUNTS OF EXISTING FEES LEVIED, AND ESTABLISHING PRICING FOR SERVICES IN CONNECTION WITH THE CITY'S MUNICIPAL AIRPORT WHEREAS, under Health and Safety code Section 8130, the general management and operation of the Redlands Municipal Airport is under the jurisdiction and control of the City of Redlands ("City"); and WHEREAS, pursuant to Health and Safety Code Section 8133, the City may make and enforce general rules, regulations, and fee schedules pertaining to the use and operation of Redlands Municipal Airport. THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. Intent. It is the City's intent that airport fees set be set based on the City's cost and the fees charged by other municipal airports. The City's airport competes in an open market, and undertakes a degree of business risk that is greater than other enterprises in which the City is involved. There is no guarantee that consumers will continue to use the airport. Moreover, the mix of property and services that the City offers to the aviation marketplace may have a value that is greater than its cost. Due to the market risk it undertakes, the City (and its citizens) should be fairly reimbursed for the value it delivers into the marketplace. Therefore, the City's airport fees should not be limited to only covering the City's costs. The City's airport fees should be based on both cost and market. Accordingly, the City Council, by adoption of this Resolution, confirms the City's existing fees for the City's Municipal Airport and establishes pricing for the products described in the attached Exhibit "A." Section 2. Authority for Administrative Orders. The City Manager is hereby delegated the authority to issue administrative orders establishing fee collection and financial procedures for implementation of this Resolution. All such administrative orders shall be signed by the Assistant City Manager and the Director of Management Services/Finance. Section3. Proposition 218 Determination. The City Council hereby finds and determines that the fees referenced within this Resolution are not subject to Article XIIIB of the California Constitution (Proposition 218). Taxes, fees and levies are subject to Prop 218 if they are for a property -related service that are imposed on a parcel or on a person as an incident of property ownership. However, the hangars and tie -downs are not `parcels' as set forth in Proposition 218. The prices for hangars, tie -downs, etc., and the charges for services are not `imposed' on customers of the airport. The customers of the airport chose whether or not they want to use the service. Therefore, the prices and fees charged at the cemetery are not subject to Proposition 218. -1- L:\Reso\8330 Redlands Airport Fees.docx Section 4. Proposition 26 Determination. The City Council hereby finds and determines that the fees referenced within this Resolution are not taxes as defined in Article XIII C Section 1(e) of the California Constitution because the fees are either: A. Imposed for a specific benefit conferred or privilege granted directly to the payors, that is not provided to those not charged, and which do not exceed the reasonable costs in the City of conferring the benefit or granting the privilege; B. Imposed for a specific government service provided directly to the payor that is not provided to those not charged, and which do not exceed the reasonable costs to the City of providing the service; C. Imposed for the reasonable regulatory costs to the City for issuing licenses and permits, performing investigations, inspections, or audits, and the administrative enforcement and adjudication thereof; D. Imposed for entrance to, or use of, City property; or the purchase, rental or lease of City property; or E. Charges imposed as a condition of property development. Section 5. CEQA Exemption. The City Council hereby finds and determines that the adoption of this Resolution is exempt from review and under the California Environmental Quality Act ("CEQA") pursuant to Public Resources Code Section 21080(b)(8)(1) and CEQA Guidelines Section 15273 because this Resolution relates to fees and charges for the purpose of meeting the operating expenses of the City. Section 6. Severability. Should any part or portion of this Resolution be rendered or declared invalid by a court of competent jurisdiction, including any of the fees identified in the Exhibit to this Resolution, such invalidation of such part or portion of this Resolution, or of any fee, shall not invalidate the remaining portions hereof, of the remaining fees, and they shall remain in full force and effect. Section 7. Effective Date. This Resolution and the prices established, and fees confirmed by this Resolution shall become effective on October 19, 2022.
