A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DENYING AN APPLICATION FOR CONDITIONAL USE PERMIT NO. 986
WHEREAS, BNY, INC. has submitted an application for a conditional use permit for the
proposed development of thirty six(36)townhomes on approximately 3.14 acres located on the east
side of Occidental Drive, approximately 657 feet north of Brockton Avenue ("Conditional Use
Permit No. 986"); and
WHEREAS,the Planning Commission of the City of Redlands has reviewed Conditional Use
Permit No. 986 and made a written recommendation for denial of that conditional use permit to the
City Council after holding a noticed public hearing; and
WHEREAS,notice of this City Council's public hearing for Conditional Use Permit No.986
was duly published in the Redlands Daily Facts by the Redlands City Clerk; and
WHEREAS,on December 20'h,2011 the City Council held a public hearing and considered
the staff written and oral reports, the recommendation of the Planning Commission, the testimony
and written evidence submitted by and on behalf of the applicant and by members of the public;and
WHEREAS,the public hearings for Condition Use Permit No.986 was continued to March
20,2012,then to April 3, 2012, and subsequently to April 12,2012 for additional testimony by the
applicant for Condition Use Permit No. 986 and the public; and
WHEREAS, following the public hearing for Conditional Use Permit No. 986 the City
Council determined that denial of the requested conditional use permit is in the best interests of the
public health, safety and general welfare;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as
follows:
Section 1. Conditional Use Permit No.986 is hereby denied based upon the following findings:
A. The proposed development will adversely affect the applicable land use plans ofthe City
because the project is inconsistent with the General Plan land use designation of Low
Density Residential and the zoning designation of R-1, Single Family Residential
District.
B. The proposed development is located in single family residential neighborhood
surrounding by single-story,detached homes and would not be consistent with the single
family character of the neighborhood.
C. The proposed development will not comply to the maximum extent feasible with the
regulations of the City's General Plan, the applicable R-I zoning district and the City's

development standards because current standards have not been applied to the project as
follows:
(i) The allowable density under the Low Density Residential General Plan land use
designation is exceeded by the proposed Conditional Use Permit No. 986.
(ii) The allowable density under the R-1 District is exceeded by the proposed
Conditional Use Permit No. 986.
D. The proposed development is not appropriate at the proposed location because the
General Plan land use designation and zoning district do not provide for the use of the
property for residential uses at the density that is proposed.
