HomeMy WebLinkAbout7267_CCv0001.pdf RESOLUTION NO. 7267 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING CONDITIONAL USE PERMIT NO. 689 (REVISION NO. 2) FOR PROPERTY LOCATED AT 168 S. EUREKA STREET IN THE CITY OF REDLANDS WHEREAS, the Redlands Community Music Association has filed an application for Conditional Use Permit No. 689 (Revision No. 2) to expand the permitted activities at the Mission Gables Bowl House property located at 168 S. Eureka Street, Redlands, California to include weddings, parties, classes, lectures, musical and theatrical performances, meetings, business retreats, award ceremonies, catered luncheons and dinners, music lessons, and holiday celebrations;and WHEREAS, the City Council has the authority, pursuant Section 18.192.060 of the Redlands Municipal Code, to take action on Conditional Use Pen-nit No. 689(Revision No. 2) to allow for the expansion of the allowed activities, consisting of weddings, parties, classes, lectures, musical and theatrical performances, meetings, business retreats, award ceremonies, catered luncheons and dinners, music lessons, and holiday celebrations at the Mission Gables Bowl House; and WHEREAS, on April 24, 2013, the City's Planning Commission held a noticed public hearing at which interested persons had an opportunity to testify in support of, or opposition to, Conditional Use Permit No. 689 (Revision No. 2);and WHEREAS, the City's Planning Commission subsequently recommended to the City Council approval of a mitigated negative declaration and Conditional Use Permit No. 689 (Revision No.2);and WHEREAS, on April 25, 2013, the City gave public notice, by mailing to property owners within a 300 foot radius of the property, and on April 25, 2013 by publishing notice in the Redlands Daily Facts, a newspaper of general circulation within the City, of a public hearing at which Conditional Use Permit No. 689(Revision No. 2)would be considered;and WHEREAS, on May 7, 2013, the City Council held a noticed public hearing at which interested persons bad an opportunity to testify in support of, or in opposition to, Conditional Use Permit No. 689(Revision No. 2); NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The City Council hereby approves Conditional Use Permit No. 689 (Revision No. 2)based on the following findings, and subject to conditions of approval attached hereto as Exhibit"A:" A. Approval of Condition Use Permit No. 689 will not adversely affect the applicable land use plans of the City because the project is consistent with General Plan policies -I- 1:\cc1erk\Reso1utions\Res 7201-729917267 CUP 689 Rldoc 3.20a and 4.93a and purpose of the C-D (Civic Design) District. B. Approval o Conditional Use Permit No 689 will not be detrimental to the public health, safety and welfare because conditions of approval have been imposed on the project to mitigate any adverse address impacts to surrounding properties. C. The uses permitted by Conditions Use Permit o. 689 will comply to the maximum extent feasible with the regulations of the City's General Plan, the applicable zoning district and the City's development standards; with the exception of the variance the project site has been renovated to meet applicable development standards and no physical changes are proposed as part of the revision. D. The uses permitted by Conditional Use Permit No. 689 are appropriate at the proposed location because such uses will allow for the hosting of activities that area the same or very similar to activities already taking place in the surrounding Civic Center area such as musical performances, award ceremonies, lectures, workshop,luncheons and meetings." Redlands Community Music Association Location: 168 South Eureka Street 1 The approval grants an amendment to a Conditional Use Permit to expand the allowed activities, consisting of weddings, parties, classes, lectures, musical and theatrical performances, meetings, business retreats, award ceremonies, catered luncheons and dinners, music lessens, and holiday celebrations at the Mission Gables Bowl House located at 168 Eureka Street in the R-2 (Multiple Family Residential) District. 2. This project shall comply with all permits requirements of the Redlands Municipal Code. 3. All plans submitted to the City shall reflect all City approvals and any other changes required by the City Council and/or staff. This condition on applies to site plans, elevations, and all ether illustrations, text, or plans submitted to the city in connection with the project. 4. The applicant for this permit, and its successors and assigns, shall defend, indemnify and hold harmless the City of Redlands, and its elected officials, officers, agents and employees, from and against any and all claims, actions, and proceedings to attack, set aside, void or annul the approval of this permit by the City, or brought against the City due to acts or omissions in any way connected to the applicant's; project that is the subject of this permit. This indemnification shall tv -1738-2 v1 3/t0, CONDITIONAL USE PERMIT NO. 689 R-2 CONDITIONS OF APPROVAL PAGE 201`6 include, but not be limited to, damages, fees, costs, liabilities, and expenses incurred in such actions or proceedings, including damages for the injury to property or persons, including death of a person, and any award of attorneys' fees. In the event any such action is commenced to attack, set aside, void or annul all, or any, provisions of this permit, or is commenced for any other reason against the City for acts or omissions relating to the applicant's project, within fourteen (14) City business days of the same, the applicant shall file with the City a performance bond or irrevocable letter of credit (together, the "Security") in a form and in an amount satisfactory to the City, to ensure applicant's performance of its defense and indemnity obligations under this condition. The failure of the applicant to provide the Security shall be deemed an express acknowledgement and agreement by the applicant that the City shall have the authority and right, without objection by the applicant, to revoke all entitlements granted for the Conditional Use Permit pursuant to this permit. The City shall have no liability to the applicant for the exercise of City's right to revoke this Conditional Use Permit. 5. Activities shall be limited to the hours of 6AM to I OPM. For evening events,, activities shall end at I OPM with clean-up completed by 11 PM. 6. Events may only be held in three (3) separate areas of the project site, the first floor board room, the second story performance hall or the outdoor courtyard. 7. The facility may be rented or otherwise used for RCNIA events year round, seven days per week. On days when performances are scheduled at the Bowl, the facility may only be used or rented if the event does not conflict with performances at the bowl, including compliance with the parking plan. 8. A maximum of 285 persons shall be permitted for events including any support staff such as RCMA representatives, caterers, and musicians. -2- C:\Documents and Settings\tbalfingef\Local Settings\Temporary Internet Files\OLKF917267 CUP 689 kldoc CONDITIONAL USE PERMIT NO.689 R-2 CONDITIONS OF APPROVAL PAGE 3 OF 6 9. Amplified music shall be permitted only indoors. 10. On-site alcohol consumption shall be conducted in accordance with appropriate ABC licensing requirements. 11. To mitigate the potential impacts identified in Section X11(a, d) of the Environmental Checklist relative to the increase in ambient noise levels the applicant shall comply with noise standards established in Chapter 8.06 of the Redlands Municipal Code (RMC) notwithstanding the exemption established under Chapter 8.06 of the RMC. (Mitigation Measure No.1) 12. To mitigate the potential impacts identified in Section X11(a, d) of the Environmental Checklist relative to the increase in ambient noise levels the applicant shall prohibit all amplification for events taking place outside of the building. (Mitigation Measure No. 2) 13. To mitigate the potential impacts identified in Section X11(a,d) of the Environmental Checklist relative to the increase in ambient noise levels the applicant shall cease activities after 10 p.m. and cleaning activities at 11 p.m. (Mitigation Measure No. 3) 14. The applicant shall provide at least one (1) representative on-site during all events to monitor compliance and to secure the property after each event. 15. Prior to the rental of the facility for events, the applicant shall submit an Event Plan Manual that will be utilized as a guide for all future events and will also serve as a code of conduct; the Plan shall provide the following content: a) A list of events allowed at the facility; b) Policies/regulations for use of the facility during Bowl events; c) ABC compliance regulations; d) Hours of operation e) Policies related to amplified devices; f) Attendance policies, including parking requirements for the -3- CA Documents and Settings\tbalfinger\Loeal Settings\Temporary Internet Files\OLKF917267 CUP 689 Rldoc CONDITIONAL USE PERMIT NO. 689 R-2 CONDITIONS OF APPROVAL PAGE 4 OF 6 various sizes of events; parking provisions should include: 1) Parking locations; 2) Use of valet services; and 3) Other appropriate parking solutions g) Other provisions with regard to the use of the facility such as deposits, damage to facility, failure to comply with ABC provisions, hours of operation, noise, etc. The Event Plan Manual shall be provided as an attachment to the rental agreement.
