A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
APPROVING CONDITIONAL USE PERMIT NO. 993 TO ESTABLISH A THEATER
ARTS AND ACROBATIC STUDIO AT 1280 RESEARCH DRIVE,REDLANDS
WHEREAS,an application for Conditional Use Permit No. 993 to establish a theatre arts
and acrobatic studio has been duly filed by Derek Wray for property located at 1280 Research
Drive,Redlands,California; and
WHEREAS, the City Council has the authority pursuant Section 18.192.060 of the City
of Redlands Municipal Code to take action on Conditional Use Permit No. 993 to allow the
establishment of a theatre arts and acrobatic studio;and
WHEREAS, on December 13, 2011, the Planning Commission held a noticed public
hearing at which interested persons had an opportunity to testify in support of, or opposition to,
Conditional Use Permit No. 993;and
WHEREAS, the Planning Commission subsequently recommended to the City Council
approval of a negative declaration and Conditional Use Permit No. 993; and
WHEREAS, on January 4, 2012, the City gave public notice by mailing to property
owners within a 300 foot radius of the property, and on January 5, 2012 publishing notice in the
Redlands Daily Facts, a newspaper of general circulation within the City, of a public hearing at
which Conditional Use Permit No. 993 would be considered,and
WHEREAS, on February 7, 2012, the City Council held a noticed public hearing at
which interested persons had an opportunity to testify in support of, or in opposition to,
Conditional Use Permit No. 993;and
NOW, THEREFORE, be it resolved by the City Council of the City of Redlands as
follows:
Section 1. The City Council hereby adds hereby approves Conditional Use Permit
No. 993 based on the following findings,and subject to the attached conditions of approval:
A. The proposed theater arts and acrobatic studio will not adversely affect the
applicable land use plans of the City because the site has a Commercial/Industrial land use
designation of the General Plan and Specific Plan No. 42. The land use designation allows a
wide range of uses including professional offices, light manufacturing, restaurants, and child-
care centers. These uses are similar to and not more objectionable than the proposed use,in that
all activities will be conducted within the tenant space and the use is consistent with the General
Plan policies and will be conditionally permitted with the adoption of the Specific Plan
Amendment.
B. The theater arts and acrobatic studio will not be detrimental to the public health,

safety and welfare because the project will be located within an existing freestanding building on
a fully developed property. As conditioned, there is sufficient parking to accommodate the use.
The building has been designed to meet State and local standards for building safety and no
structural changes are proposed to the building. In addition, conditions of approval have been
imposed upon the project that regulate the project's operational characteristics, which include
hours of operation,number of students and permitted activities.
C. The theater arts and acrobatic studio will comply with the regulations of the
City's General Plan, the applicable land use district and the City's development standards
because the site is adequate in size to accommodate the physical requirements, including
parking. The current improvements comply with the applicable development standards and no
alternations are proposed.
D. The project is appropriate at the proposed location and will not create an adverse
effect on surrounding properties or businesses in that the theater arts and acrobatic studio is
located within an area surrounded by other commercial and office uses. The site is fully serviced
by existing facilities. The activities will be conducted completely inside the building,no exterior
changes are proposed. As conditioned herein parking will be provided on the site."
Section 2. The City Council hereby determines that the adoption of this resolution is
exempt from review under the California Environmental Quality Act C'CEQA7) pursuant to
State CEQA Guidelines section 15301 (3) because the project consists of the permitting of an
existing structure involving negligible expansion of use.
