I TO CONDITIONAL USE PERMIT NO. 905, APPROVING A ONE YEAR EXTENSION OF TIME FOR CONDITIONAL USE PERMIT NO. 905, AND MAKING A DETERMINATION PURSUANT TO SECTION 15162 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT GUIDELINES FOR A PROPOSED PROJECT LOCATED ON THE WEST SIDE OF EUREKA STREET, BETWEEN THE INTERSTATE 10 FREEWAY AND THE BNSF RAILWAY, REDLANDS, CALIFORNIA WHEREAS, an application for Revision No. 1 to Conditional Use Permit No. 905 to amend the conditions of approval to permit the placement of a City entry sign for an approved 149,800 square foot commercial center has been duly filed by The Howard Hughes Corporation for property consisting of approximately 13.2 acres along the west side of Eureka Street,between the Interstate 10 Freeway and the BNSF Railway, Redlands, California; and WHEREAS, the City Council has the authority pursuant to Sections 18.192.060 and 18.192.090 of the Redlands Municipal Code to take action on Revision No. 1 to Conditional Use Permit No. 905 to amend the conditions of approval and to approve extensions of time for conditional use permits; WHEREAS, on October 8, 2013, the Planning Commission held a noticed public hearing at which interested persons had an opportunity to testify in support of, or opposition to, Revision No. 1 to Conditional Use Permit No. 905; and WHEREAS, the Planning Commission subsequently recommended that the City Council determine, pursuant to Section 15162 of the State's Guidelines implementing the California Environmental Quality Act ("CEQA"), that no subsequent environmental review is necessary for its recommendation to approve Revision No. I to Conditional Use Permit No. 905; and WHEREAS, on October 3, 2013, the City gave public notice by mailing to property owners within a 300 foot radius of the property and publishing notice in the Redlands Daily Facts, a newspaper of general circulation within the City, of a public hearing at which Revision No. I to Conditional Use Permit No. 905 would be considered; and WHEREAS, on November 5, 2013, the City Council held a noticed public hearing at which interested persons had an opportunity to testify in support of, or in opposition to, Revision No. I to Conditional Use Permit No. 905; and NOW, THEREFORE, be it resolved by the City Council of the City of Redlands as follows: Section 1. The City Council hereby approves Revision No. 1 to Conditional Use Permit No. 905 based on the following findings, and subject to the attached conditions of approval: 1 1.icclerklResolutiomciRes 7300-7393\7334 CUP 905.doe A. That the revision to CUP 905 will not adversely affect the applicable land use plans of the City because the Redlands Promenade Project was previously determined to be consistent with the Redlands General Plan and Downtown Specific Plan, and the revision only involves the requirement to construct a City entry sign; B. That the revision to CUP 905 will not be detrimental to the public health, safety and welfare because the revision would not be in conflict with the findings and conclusions in the EIR or the mitigation measures that were required to ensure that the project will not be injurious to the public; C. That the revision to CUP 905 will not conflict with the previous determination that the project will comply to the maximum extent feasible with the regulations of the City's General Plan, the applicable zoning district and the City's development standards; because the revision only concerns the installation of a City entry sign on the subject property; and, D. That the revision to CUP 905 is appropriate at the proposed location because the Redlands Promenade Project and proposed City entry sign is located at a major gateway into Downtown Redlands from the Interstate 10 Freeway. Section 2. The City Council hereby approves a third, one year extension of time for CUP 905 thereby establishing an expiration date of May 15, 2015 for CUP 905, unless certain actions are taken by the project applicant. Section 3. The City Council hereby determines that the adoption of this resolution requires no subsequent environmental impact report or negative declaration under CEQA pursuant to State CEQA Guidelines section 15162 based on the following: A. No substantial changes are proposed in the project which will require major revisions of the previously certified EIR as there have been no new significant environmental effects or a substantial increase in the severity of previously identified significant effects under which the project will be undertaken. Since the project has not changed it remains within the scope of the environmental analysis and the Mitigation Monitoring Program which were adopted for the project to mitigate potential impacts to a less than significant level; B. No substantial changes have occurred with respect to the circumstances under which the project will be undertaken that will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. No new significant effects have surfaced and the EIR and Mitigation Monitoring Program adopted for the project remain current relative to mitigating the potential impacts of the project to a less than significant level; and, 2 L\cc1erkNReso1utions\Res 7300-7399\7339 CUP 905.doe C. There is no new information of substantial importance which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete as no new information of substantial importance has come to light."
