HomeMy WebLinkAbout3290_CCv0001.pdf RESOLUTION NO. 3290 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ADOPTING A CON- FLICT OF INTEREST CODE APPLICABLE TO THE MEMBERS .Z.' THE CITY COUNCIL PURSUANT TO TIE POLITICAL REFORM ACT OF 1974 THE CITY COUNCIL OF THE CITY OF REDLANDS RESOLVES AS FOLLOWS: SECTION 1. ADOPTION OF CONFLICT OF INTEREST CODE. In compliance with 87300 of the Government Cade, the City Council hereby adopts this Conflict of Interest Code. . SECTION 2. APPLICATION OF CODE. This Conflict of Interest Code shall be applicable to members of the City Council. SECTION 3 . DISCLOSURE. Members of the City Council are required, pursuant to Government Code §87200, to disclose investments, interests in real property and income. No other or no additional disclosure requirements are unposed by this Conflict of Interest Cade. SECTION 4. CIRCUMSTANCES REQUIRING DISQUALIFICATION. Any member of the City Council, whether acting as a Council member or as governing board member or commissioner of any city agency,. including the following: City of Redlands Planning Commission City of Redlands Public Works Commission Must disqualify himself or herself from making or participating in the making of any decisions which will foreseeably have a material finan- tial effect, distinguishable from its effect on the public generally, on any financial interest, as defined in Government Code §87103 . No member shall be prevented from making or participating in the making of any decision to the extent his or participation is legally required for the decision to be made. SECTION 5. DEFINITIONS. Except as otherwise indicated, the defi- nitions contained in the Political. Reform Act of 1974 (Government Code §81000) and regulations adopted pursuant thereto are incorporated into this Conflict of Interest Code. SECTION 6. The City Clerk is directed to forward a certified copy of this resolution to the Fair Political Practices Commission. ADOPTED, SIGNED AND :APPROVED this 5th da of October, 1976 . If any person objects to the approval of the Code as revised, that person may, within 30 days of the approval date, submit in writing his or her objections to the Commission and the Code shall be rescheduled for full hearing pursuant to subsections (Q - (q) of 2 Cal. Adm. Code Section 18750 . if no objection to the revision (s) and approval of the Code is received, the Code shall become effective December 16 , 1976 , 30 days after FPPC approval. Upon finalization of your Conflict of Interest Code , incorporating the above-mentioned revision (s) , please forward a copy to this office. Moseley City Clerk, Redlands Past Office Eos 280 Redlands, California 92373 Dear Ms. Moseley: The Conflict of .Interest Code for the Redlands City Council will be reviewed by the Fair Political. Practices Commission on November 16, 1976, at the Department of Con- sumer Affairs, 1020 N Street, Room 1032 , Sacramento. The staff will be recommending that the proposed Code as submitted by the City Council be revised to conform to Model Code provisions (attached) which represent the Co mission's most recent determinations with respect to Conflict of Interest Cedes for City Councils, Though the staff is proposing to revise the Cade , the review of the Cade will be scheduled for the Commis- sion Summary Calendar. (See, 2 Cal. Adel. Code §18750. ) Thus, unless the Council disagrees with the proposed amendment to the Cade and requests a full hearing thereon, it will not be necessary for a representative of the Council to be present at the review of the Code. The proposed amendment follows. Change Section 5 to Section 6. Insert new section 5: Section 5. Definitions. Except as otherwise indicated, the definitions contained in the Politi- cal Reform Act of 1974 (Government Cade §8100€3) and regulations adopted pursuant thereto are .incorpora- ted :into this Conflict of interest Cade. Adm. Code 518750 (d) (1) . This office is not in receipt of such dec- laration on behalf of the City Council. if the Code for the Council was not adopted pursuant to 587311 , please notify this office at once so that your Code may be returned to the Council for action consistent with the terms of that section. In the absence of such notification we assume that the Council has complied with the requirements of 58731-1 in the formulation of its Conflict of Interest Code. The rat- ification of each Conflict of Interest Code by the Commission,/ is conditional upon the satisfaction of the requirements of 587311. City Treasurer Mike Reynolds and employee Teresa Ballinger drove to Carl's Jr. to pick up food and soft drinks for the firefighters that evening. Many of those firefighters were present in the audience to bear Mayor Larson commend, on behalf of the citizens of Redlands, Chief Enslow, the Redlands' firefighters and other staff members for their efforts as he expressed the City Council's pride in its employees. The ineeting was opened with an invocation by Councilmember Banda followed by the pledge of allegiance. CONSENT CALENDAR Minutes - COLHIC11mcniber Cunningham moved to approve the minutes, of the regular meeting of September 3, 1996, as revised September 5, 1996, which clearly indicate that the version of Ordinance No. 2301 adopted was the one presented at the June 4, 1996, COUnCil. Bills and Salaries - On motion of Councilmember Gilbreath, seconded by Councilmember Gil, bills and salaries were unanimously ordered paid. Fee Waiver - Oil motion of Counciltriember Gilbreath, seconded by Council- member Gil, the City Council unanimously approved the waiver of fees in the amount of $220.00 for use of the Sewall Theatre by the Friends of Prospect Park. Conflict of Interest Code - On motion of Councilmember Gilbreath, seconded by Councilmember Gil, the City Council unanimously acknowledged it had reviewed its Conflict of Interest Code and found that the following amendments were necessary at this time and directed staff to prepare the legislation necessary in accordance with Government Code Section 87306.5-. 1.
