HomeMy WebLinkAbout5044_CCv0001.pdf RESOLUTION NO. 5044 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS AMENDING THE CONFLICT OF INTEREST CODE OF THE CITY OF REDLANDS AND RESOLUTIONS NOS. 4667 AND 4852 WHEREAS, the Legislature of the State of California has enacted the Political Reform Act of 1974, Government Code Section 81000 et seq. (The "Act"), which contains provisions relating to conflict of interest which potentially affects all officers, employees, and consultants of the City of Redlands (the "City"), and requires all public agencies to adopt and promulgate a Conflict of Interest Code; and WHEREAS, the City adopted a Conflict of Interest Code in compliance with Government Code Section 81000 et seq.; and WHEREAS, Government Code Section 87306.5 requires the review of every public agency's Conflict of Interest Code in each even-number year and submission to the City Council of a statement regarding that review, and if necessary, amendment of the agency's Conflict of Interest Code within 90 days; and WHEREAS, the potential penalties for violation of the provisions of the Act are substantial and may include criminal and civil liability, as well as equitable relief which could result in the City being restrained or prevented from acting in cases where the provisions of the Act may have been violated; and WHEREAS, notice of time and place of a public hearing on, and for consideration by the City Council of, the proposed amended Conflict of Interest Code was publicly posted for review at the Office of the City Clerk; and WHEREAS, a public hearing was held upon the proposed amendment at a regular meeting of the City Council on February 1, 1994, at which time all present were given an opportunity to be heard on the proposed amendment to the Conflict of Interest Code; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands, that the City Council does hereby amend its Conflict of Interest Code as follows: SECTION ONE: That Exhibit "A" of the appendix of the Conflict of Interest Code of the City of Redlands shall be amended to read as follows: "EXHIBIT A DESIGNATED POSITIONS The Mayor, Members of the City Council and Planning Commission, the City Manager, City Attorney, City Treasurer, and the City officials who manage public investments are included in and governed by the Conflict of Interest Code only with respect to its disqualification provisions. For purpose of disclosure, the Mayor, Members of the City Council and Planning Commission, the City Manager, City Attorney, City Treasurer, and the City officials who manage public investments are governed by the statutory conflicts of interest provisions of Article 2 of Chapter 7 of the Political Reform Act of 1974 (Government Code Section 87200 et seq.) DESIGNATED EMPLOYEE'S DISCLOSURE CATEGORIES TITLE OR FUNCTION ASSIGNED Archivist All Disclosure Categories (1-7) Chief Building Official All Disclosure Categories (1-7) Chief of Police All Disclosure Categories (1-7) City Attorney All Disclosure Categories (1-7) City Clerk All Disclosure Categories (1-7) Community Development Director All Disclosure Categories (1-7) Community Services Director All Disclosure Categories (1-7) *Consultants All Disclosure Categories (1-7) Deputy City Clerk All Disclosure Categories (1-7) Deputy City Treasurer All Disclosure Categories (1-7) Finance Director All Disclosure Categories (1-7) Fire Chief All Disclosure Categories (1-7) Fire Division Chief All Disclosure Categories (1-7) Library Director All Disclosure Categories (1-7) Municipal Utilities Director All Disclosure Categories (1-7) Police Captain All Disciosure Categories (1-7) Public Works Director All Disclosure Categories (1-7) * Consultants shall be included in the list of designated employees and shall disclose pursuant to the broadest disclosure category in this Code subject to the following limitation: The City Manager may determine in writing that a particular consultant, although a "designated position," is hired to perform a range of duties that are limited in scope and thus is not required to fully comply with the disclosure requirements described in this section. Such written determination shall include a description of the consultant's duties and, based upon that description, a statement of the extent of disclosure requirements. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as this Conflict of Interest Code." (Resolution No. 5444 adopted February 1, 1994) SECTION TWO: A copy of this amendment to the Conflict of Interest Code shall be on file with the City Clerk and available for inspection by the public. ADOPTED, SIGNED AND APPROVED this 1st day of February, 1994.
