RESOLUTION CONCERNING CONTRACTS WITH OPTION B
WHEREAS, the CITY OF RED: ,ANDS, hereinafter called "City" ,
has made and entered certain agreements, entitled "Contract with
Option B" ; and
WHEREAS, by such "B Contracts" , the City agrees to perpetu-
ally sell and deliver water at cost to the holders thereof from the
City' s water system, subject to certain terms and conditions; and
WHEREAS, among such terms and conditions is the provision
that the City "does not agree to furnish water sufficiently pure
for drinking or household purposes" ; that the water may be delivered
only within the area described in paragraph l (c) of the "B Contract",
subject to the contract being suspended by the City without notice
should any of the water be transported without the area for use else-
where than in said area; that such water shall be furnished only in
the amounts required for irrigation by the contract-holder; and
WHEREAS, the City has complied with all of the terms and
conditions of the B Contract in delivering water within the designated
area for irrigation purposes only in accordance with the provisions of
such contracts and the City intends to continue only such service; and
WHEREAS, whenever the term contract holder is used herein,
such term shall include all heirs, assignees, executors, and successors
in interest;
IT IS HEREBY RESOLVED by the City Council of the City of
Redlands, as follows .
1 . That no delivery of water in accordance with the
"B Contract" shall be made outside the area described in
paragraph l (c) of such contracts ,
2 . That should any ,::f such water be transported or con-
dv.cte:d out of said "B Contract." area or district for use
elsewhere than in said area or district, or to any un-
authorized persons, or public agencies, the City shall
suspend furnishing of any further water to the holder of
such "B Contract" ,, without notice.
3 . That the City shall not make delivery of water in
accordance with a "B 'Contract." to any person who does not
use such water for irrigation purposes only on land lying
within the area described in the "B Contract" ; the City
shall not supply such water to any person who is not a
landowner, and in no event tc a public agency, including
but not limited to community service distri..cts, or
publ -..c utility corporations; which in turn supplies
such water for private or public use, or for treatment
for such use.
4. That this City Council reaffirms its approval and
acceptance of all of the terms and conditions of the
B Contracts .
