HomeMy WebLinkAbout7369_CCv0001.pdf RESOLUTION NO. 7369 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ESTABLISHING A PUBLIC BENEFIT MATCH FUND POLICY WHERE-AS, the purpose for establishing a Public Benefit Match Fund Policy is to provide for proper guidance, oversight, and requirements for distribution of public benefit match funds, NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. Such designation was made by the City Council of certain proceeds from the sale of the Nevada Palmetto Grove property and deposited into public benefit fund accounts as follows: Public Benefit: Parks& Recreation (38%) $4,339,820 Public Benefit:Trails (8%) $ 913,646 Public Benefit: Agricultural Open Space(20%) $2,284,116 Public Benefit: Natural Open Space(18%) $2,055,704 Public Benefit: Other Improvements (16%) $1,827,293 Furthermore, from time to time the City may receive requests from private parties or other governmental agencies to use these funds as matching funds for other potential funding sources that may be available to fund public benefit projects. This may include requests for the City to match funds that the requesting party will provide to the City on the condition that the City agrees to perform the specified public benefit project; or it may include requests by a private party or other governmental agency for the City to match funds that the private party or other governmental agency is seeking from a grant or other source for completion of a specified public benefit project. POLICY 1.1 Distribution of Public Benefit Match Funds for a City Project. (a) An agreement with the requesting party shall be prepared by the City Department responsible for the project and approved as to form by the City Attorney, with final approval by the City Council. (b) All City staff shall comply with the City's Purchasing Ordinance, State Public Contract Code and all other policies and laws governing projects performed by the City (c) The City Department responsible for the project shall provide periodic reports of project milestones and a final report at project completion to the City Council. City of Redlands- Public Benefit Match Fund Policy Page 19 1.2 Distribution of Public Benefit Match Funds to Private Party or Other Governmental Agency. (a) An agreement with the requesting party shall be prepared by City staff and approved, as to form, by the City Attorney, with final approval by the City Council. The agreement shall include, at minimum: 1. Determination of findings by the City Council, if the request of funds is for a project identified as a public purpose project. 2. A match distribution schedule and identification of required milestones for distribution, based on the unique requirements of the requesting party. 3. Language that requires that the requesting party adhere to all laws applicable to the specified project. 4. Authority to the City of Redlands Finance Department to distribute match funds in accordance with the required milestones and schedule of distribution identified in the agreement. 5. Requirement that a report to the City Council be prepared by the requesting party at the completion of the project. City of Redlands— Public Benefit Match Fund Policy Page 12
