A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
AUTHORIZING CITY STAFF TO PROVIDE NOTICE OF THE CITY COUNCIL'S
CONSIDERATION OF RESOLUTIONS OF NECESSITY AND HEARINGS PURSUANT TO
CODE OF CIVIL PROCEDURE SECTION 1245.235
WHEREAS, from time to time the City Council of the City of Redlands("this City Council")
holds hearings to consider the adoption of resolutions of necessity which are preconditions to the
commencement of eminent domain proceedings; and
WHEREAS, the State Eminent Domain law, in Civil Code of Procedure section 1245.235,
requires that the "Governing Body" give notice of intent to adopt a resolution of necessity and
provide property owners with a reasonable opportunity to be heard; and
WHEREAS,because strict adherence to the requirements ofCode of Civil Procedure section
1245.235 may result in delay when adopting a resolution of necessity, this City Council desires to
delegate to City staff the authority to give notice ofthe proposed adoption of resolution of necessity
and hearing;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
REDLANDS AS FOLLOWS:
Section 1. Delegation of Authority.
This City Council hereby authorizes and delegates to City staffwithin the department handling
acquisitions of property for the City the authority to give notice required by Code of Civil Procedure
section 1245.235, in behalf of this City Council, either by mail or by personal service.
