A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DESIGNATING THE CHIEF OF POLICE OR HIS OR HER DESIGNEE AS
THE SUBORDINATE OFFICER FOR THE PURPOSE OF DETERMINING
WHETHER THE PUBLIC CONVENIENCE OR NECESSITY WOULD BE
SERVED BY ISSUING A LICENSE BY THE DEPARTMENT OF
ALCOHOLIC BEVERAGE CONTROL
WHEREAS, the Department of Alcoholic Beverage Control is required to investigate
license applications and notify the City of completed applications, and
WHEREAS, Business and Professions Code section 23958.4(b)(2) allows the City
Council to delegate the determination of whether public convenience or necessity would be
served by the issuance of a license to a subordinate body or officer; and
WHEREAS, it is the desire of the City Council to delegate its authority under Business
and Professions Code section 23958.4 to the Chief of Police or his or her designee; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as
follows:
Section 1. Pursuant to Business and Professions Code section 23958.4(b)(2), the City
Council of the City of Redlands hereby designates the Chief of Police or his or her designee as
the "subordinate officer or agency" to determine within 90 days of notification of a completed
application from the Department of Alcoholic Beverage Control, whether the public convenience
or necessity would be served by the issuance of a license.
Section 2. The City Clerk shall notify Timothy Clark of the Department of Alcoholic
Beverage Control, 3737 Main Street, Suite 900, Riverside, CA, by mailing a copy of this
Resolution, that the City has designated the Chief of Police or his or her designee as the City's
subordinate officer.
ADOPTED, SIGNED AND APPROVED this 7th day of August, 2007.
