A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
PROVIDING A DESTRUCTION SCHEDULE FOR CERTAIN RECORDS ;
DEFINITION OF RECORD; EXCEPTIONS; AND RESCINDING RESOLUTION
NO. 3370 .
WHEREAS , Section 34090 of the Government Code of the State of
California , as amended, provides, unless otherwise provided by law,
that a head of a City Department may destroy any city record,
document, instrument, book or paper under his charge, without
making a copy thereof, after the same is no longer required, with
the exception of:
A. Records affecting the title to real property or liens
thereon,
B. Court records,
C. Records required to be kept by statute,
D. Records less than two years old,
E. The minutes , ordinances , or resolutions of the legislative
body or of a city board or commission; and
WHEREAS , in the course of doing business as a Municipal Corpor-
ation, the City of Redlands creates certain records , documents , in-
struments , books or papers not required by law or convention, but
only as a convenience to individual departments of the City of
Redlands to facilitate the operation of such departments ; and
WHEREAS, the consent in writing of the City Attorney has been
given for the destruction of certain records, as hereinafter described,
and a copy of such consent is attached hereto as Exhibit "A" and in-
corporated herein; and
WHEREAS, the Chief of Police has determined that the city records,
documents, instruments, books or papers described herein are no longer
required, that they are not excepted under the provisions of Section
34090 of the Government Code of the State of California, and that such
items should be destroyed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Redlands that, pursuant to the provisions of Section 34090 of
the Government Code of the State of California:
A. The following are not records by convention, are herein
defined by way of example, are not required by law, and
may be destroyed when no longer required:
1 . Duplicates of originals , made in the normal course of
business for convenience .
2. Indices for records .
3 . Documents , instruments, books or papers specifically
designed to contain, and which contain, purely temporary
information.
4 . Interdepartment communications of a routine and
temporary nature.
B. The following are records and may be destroyed no sooner
than two years from the date of the last entry, except as
otherwise provided for by law:
1. Reports of investigations of criminal activity or
traffic accidents , except that such reports involving
death as a proximate result of a criminal act may not
be destroyed.
2 . Reports of investigations of non-criminal activities.
3. Reports of an informational nature.
4 . Records of a non-temporary nature .
5 . Records made for other governmental agencies, with
copies filed with such agencies, serving no useful
retention purpose.

WRITTEN CONSENT OF CITY ATTORNEY IN ACCORDANCE
WITH GOVERNMENT CODE SECTION 34090
The undersigned, as City Attorney of the City of Redlands ,
hereby states that he has examined the documents listed in Resolution
No. 3526 and sought to be destroyed by the Chief of Police in accord-
ance with Section 34090 of the Government Code . These documents
being no longer required, are subject to no excepting provisions of
the Government Code, and, as City Attorney, I hereby give my written
consent for their destruction.
