HomeMy WebLinkAbout5148_CCv0001.pdf RESOLUTION NO. 5148 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS CONSENTING TO THE DESTRUCTION OF PUBLIC RECORDS AND RESCINDING RESOLUTION NO. 3526 WHEREAS, in the course of doing business, the City of Redlands creates certain records, documents, instruments, boobs or papers not required by law or convention, but only as a convenience to individual departments of the City of Redlands to facilitate the operation of such departments; and WHEREAS, Section 34090 of the California Government Code provides that a head of a City Department may destroy any City record, document, instrument, book or paper under his charge, without making a copy thereof, after the same is no longer required, with the exception of records affecting the title to real property or liens thereon, court records,records required to be kept by statute, records less than two years old, and the minutes, ordinances, or resolutions of the legislative body or of a City board or commission; and WHEREAS,Redlands' Chief of Police has determined that certain City records, documents, instruments, books or papers described herein are no longer required, that they are not excepted under the provisions of Government Code Section 34090, and that such items should be destroyed; and WHEREAS,pursuant to Government Code Section 34090,the consent in writing of the City Attorney has been given for the destruction of the records described herein; and WHEREAS, before the records herein described may be destroyed, the consent of the City Council is required; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The following are not records by convention, are herein defined by way of example, are not required by law, and may be destroyed when no longer required: A. Duplicates of originals, made in the normal course of business for convenience. B. Indices for records. C. Documents, instruments, books or papers specifically designed to contain, and which contain, purely temporary information. D. Interdepartment communications of a routine and temporary nature. The following are records and the City Council hereby consents to their destruction no sooner than two years from the date of the last entry, except as otherwise provided for by law: A. Reports of investigations of criminal activity or traffic accidents, except that such reports involving death as a proximate result of a criminal act may not be destroyed. B. Reports of investigations of non-criminal activities. C. Reports of an informational nature. D. Records of a non-temporary nature. E. Records made for other governmental agencies, with copies filed with such agencies, serving no useful retention purpose. Section 3. The consent given by this resolution shall be ongoing provided the requirements of Government Code Section 34090 are complied with and the City Attorney, on a case-by-case basis, reviews all requests for the destruction of records and consents, in writing, to their destruction.
