HomeMy WebLinkAbout8407RESOLUTION NO. 8407 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING ITS INTENTION TO VACATE THE STREET RIGHT-OF-WAY AT 710 N. CHURCH STREET WHEREAS, Mr. Mike Frazier, as the authorized representative for the property owner of 710 North Church Street (APNs: 0170-071-03-0000 and 0170-071-04-0000) has submitted an application requesting vacation of the excess street right-of-way that is four (4) feet wide and 152.91 feet in length along the frontage of the subject property; and, WHEREAS, the City may vacate all or part of a public street pursuant to Street and Highway Code Section 8300 et. Seq. and, pursuant to Streets and Highways Code Section 8340, the City may for public convenience and necessity reserve and exempt public service easements from a street vacation; and WHEREAS, the proposed street vacation qualifies for an exemption from environmental review in accordance with the California Environmental Quality Act ("CEQA"), pursuant to Section 15061(b)(3) of the State CEQA Guidelines for projects where there is no possibility of any significant environmental effects; and WHEREAS, on October 5, 2022, the Redlands Planning Commission reviewed the proposal and determined that the proposed street vacation will conform to the City's General Plan including the Connected City chapter; and WHEREAS, the City Council intends to vacate the excess right-of-way, as more particularly described in Exhibit "A" to this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: SECTION 1. The City Council of the City of Redlands hereby declares its intention to vacate the excess street right-of-way that is four (4) feet wide and 152.91 feet in length located across the front property line at the property located at 710 North Church Street, and further described in the legal description contained in Exhibit "A" attached hereto. SECTION 2. The proposed street vacation of the right-of-way for 710 N. Church Street is exempt from environmental review in accordance with Section 15061(b)(3) of the State CEQA Guidelines, as there is no possibility of any potentially significant environmental effects. SECTION 3. The City Council will conduct a public hearing on the proposed street vacation at a regularly schedule public meeting of the City Council on December 20, 2022, beginning at 6:00 p.m., or as soon thereafter as the matter may be heard, to be held in the City Council Chambers located at 35 Cajon Street, Suite 2, Redlands, California 92373. SECTION 4. The City Clerk shall give notice of the public hearing on the public hearing on the proposed vacation by: 1 I:\RESOLUTIONS\RES 8400-8499\8407 INTENT TO VACATE-NO.187 710 N. CHURCH ST.DOCX A. Publishing notice in the Redlands Daily Facts, for two successive weeks prior to the hearing; and B. Posting notices of the proposed street vacation conspicuously at 710 N. Church Street at least two weeks prior to the date set for the public hearing. The notice shall be posted no more than 300 feet apart, and at least three such notices shall be posted. The notice shall reference the adoption of this Resolution of Intention and shall state the date, time, and place of the street vacation hearing.
