HomeMy WebLinkAbout8408RESOLUTION NO. 8408 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING ITS INTENTION TO VACATE A PORTION OF STREET RIGHT- OF-WAY ON EAST HIGHLAND AVENUE BEGINNING WESTERLY OF REDLANDS STREET, AND ALONG THE ENTIRE FRONTAGE OF TRACT MAP NO. 20065 (APN: 0174-161-25-0000) WHEREAS, Hicks & Hartwick, Inc., authorized representative, has submitted an application requesting vacation of the excess street right of way along East Highland Avenue that is ten (10) feet wide and 998 feet in length, along the southerly side of East Highland Avenue and approximately 50 feet west of Redlands Street, along the entire frontage of the previously - approved Tract Map No. 20065 (APN: 0174-161-25-0000); and WHEREAS, the City may vacate all or part of a public street pursuant to Street and Highway Code Section 8300 et. Seq. and, pursuant to Streets and Highways Code Section 8340, the City may for public convenience and necessity reserve and exempt public service easements from a street vacation; and WHEREAS, the proposed street vacation qualifies for an exemption from environmental review in accordance with the California Environmental Quality Act ("CEQA"), pursuant to Section 15061(b)(3) of the State CEQA Guidelines for projects where there is no possibility of any significant environmental effects; and WHEREAS, at its meeting on October 11, 2022, the Redlands Planning Commission reviewed the proposal and determined that the proposed street vacation will conform to the City's General Plan including the Connected City chapter; and WHEREAS, the City Council intends to vacate the excess right-of-way, as more particularly described in Exhibit "A" attached to this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: SECTION 1. The City Council of the City of Redlands hereby declares its intention to vacate the excess street right-of-way along East Highland Avenue that is ten (10) feet wide and 998 feet in length, along the southerly side of East Highland Avenue and approximately 50 feet west of Redlands Street, along the entire frontage of the previously -approved Tract Map No. 20065 (APN: 0174-161-25-0000) described in the legal description contained in Exhibit "A" attached hereto. SECTION 2. The proposed street vacation of the right-of-way for the previously approved Tract Map No. 20065 is exempt from environmental review in accordance with Section 15061(b)(3) of the State CEQA Guidelines, as there is no possibility of any potentially significant environmental effects. 1 I:\RESOLUTIONS\RES 8400-8499\8408-RESO SV 188 INTENT TO VACATE -EAST HIGHLAND.DOCX SECTION 3. The City Council will conduct a public hearing on the proposed street vacation at a regularly schedule public meeting of the City Council on December 20, 2022, beginning at 6:00 p.m., or as soon thereafter as the matter may be heard, to be held in the City Council Chambers located at 35 Cajon Street, Suite 2, Redlands, California 92373. SECTION 4. The City Clerk shall give notice of the public hearing on the public hearing on the proposed vacation by: A. Publishing notice in the Redlands Daily Facts, for two successive weeks prior to the hearing; and B. Posting notices of the proposed street vacation conspicuously at the frontage of Tract Map No. 20065 at least two weeks prior to the date set for the public hearing. The notice shall be posted no more than 300 feet apart, and at least three such notices shall be posted. The notice shall reference the adoption of this Resolution of Intention and shall state the date, time, and place of the street vacation hearing.
