HomeMy WebLinkAbout8403RESOLUTION NO. 8403 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING ITS INTENTION TO VACATE THE STREET RIGHT-OF-WAY LOCATED AT JASPER AVENUE (CITY OF REDLANDS STREET VACATION NO. 186) WHEREAS, Madison Capital Group ("Applicant"), has filed an application for Ordinance Text Amendment No. 363 to add "Self -Storage or mini -storage facilities on a project site a minimum size of five (5) acres" as a use that requires a Conditional Use Permit in the C- 4 district, Street Vacation No. 186 proposing to vacate roadway along Jasper Avenue approximately four hundred and four (404) feet in length by three (3) feet in width, and Conditional Use Permit No. 1168 to construct a 123,456 square foot storage facility consisting of 11 detached buildings that will contain 835 storage units and a 700 square foot leasing office with related site improvements including parking lot, walls and fences, landscape, and lighting on a 6.34-acre parcel. The project site is located on the south side of Naples Avenue between Wabash Avenue and Jasper Avenue in the Highway Commercial (C-4) District (APN: 0298- 051-07-0000); and WHEREAS, the City is authorized to vacate all or part of a public street pursuant to California Streets and Highway Code section 8300 et seq.; and WHEREAS, pursuant to section 8340 of the California Streets and Highways Code, the City may, for public convenience and necessity, reserve and except public service easements from a street vacation; and WHEREAS, at its meeting on October 5, 2022, the City's Planning Commission made its report to the City Council that the proposed street vacation will conform to the City's General Plan; and WHEREAS, The City Council adopted Resolution No. 8402 on November 15, 2022 for the proposed project and determined a Mitigated Negative Declaration is the appropriate environmental determination for the project; and WHEREAS, the City Council intends to vacate the excess right-of-way, as more particularly described in Exhibits "A" and `B" to this resolution; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. The City Council hereby declares its intention to vacate the right -of way roadway along Jasper Avenue approximately four hundred and four (404) feet in length by three (3) feet in width adjacent to APN 0298-051-07-0000, and as described in Exhibits "A" and `B," which are attached hereto and incorporated herein by reference. 1 I:\ResohRions\Res 8400-8499\8403_Intent to_Vacate_Self Storage.docx Section 2. The City Council adopted Resolution No. 8402 on November 15, 2022 for the proposed project and determined a Mitigated Negative Declaration is the appropriate environmental determination for the project. Section 3. The City Council will conduct a public hearing on the proposed street vacation at a regularly scheduled public meeting of the City Council on December 20, 2022, beginning at 6:00 p.m., or as soon thereafter as the matter may be heard, to be held in the City Council Chambers located at 35 Cajon Street, Suite 2, Redlands, California 92373. Section 4. The City Clark shall give notice of the public hearing on the public hearing on the proposed vacation by: A. Publishing notice in a newspaper of general circulation, for two successive weeks prior to the hearing; and B. Posting notices of the proposed street vacation conspicuously at Jasper Avenue at least two weeks prior to the date set for the public hearing. The notices shall be posted no more than 300 feet apart, and at least three such notices shall be posted. The notices shall reference the adoption of this Resolution of Intention and shall state the date, time, and place of the street vacation hearing.
