A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF REDLANDS ESTABLISHING DEPOSIT FEES FOR
THE PROCESSING AND ANNUAL REVIEW OF
DEVELOPMENT AGREEMENTS
WHEREAS, the State Legislature has enacted a statutory
scheme for the approval of development agreements which provide
assurance to developers that they may proceed with and complete a
development project in accordance with the City ' s policies , rules
and regulations existing at the time the development agreement is
approved; and
WHEREAS, the City Council of the City of Redlands ( "this
City Council" ) has determined that the processing and annual
review of development agreements is not of general benefit to the
citizens of Redlands, but rather of benefit to the applicant
proposing to enter into a development agreement ; and
WHEREAS, this City Council finds it appropriate to
require applicants for development agreements to pay all direct
costs of the City incurred in processing and reviewing development
agreements; and
WHEREAS, this City Council further finds it appropriate
to require an initial deposit to guarantee that the applicant for
a development agreement will reimburse the City for such costs ;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Redlands as follows :
Section 1 . Applicants seeking to enter into a
development agreement with the City shall pay all of the direct
costs incurred by the City for processing the development
agreement. An initial deposit of $2 , 500 shall be required for
each development agreement submitted for processing, concurrent
with the filing of an application for the development agreement .
Section 2 . Applicants having an approved development
agreement shall pay all of the direct costs incurred by the City
in undertaking the annual review of that development agreement
required by Government Code Section 65865 . 1. One month prior to
the anniversary date of the development agreement , the applicant,
or his successor in interest, shall pay to the City an initial
deposit of $500 for review of the agreement.
Section 3 . Any portion of the deposit amounts which
are required by this resolution and not expended for the direct
costs of processing and reviewing a development agreement shall be
refunded.
Section 4. This resolution shall take effect
immediately upon its adoption.
