Number:13-228648 This Program Supplement is hereby incorporated into the Agency -State Agreement for Federal Aid which was entered into between the Agency and the State on 05/13/97 and is subject to all the terms and conditions thereof. This Program Supplement is adopted in accordance with Article I of the aforementioned Master Agreement under authority of Resolution No. 5837 approved by the Agency on Feb . 6 , 2001 , (See copy attached). The Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with the covenants or remarks setforth on the following pages. All required pavement marking and advance warning signs shall comform to the requirements of MUTCD, 1988 and shall be placed in their proper location by the Local Agency at the time of completion of the Railroad's work. 2. The ADMINISTERING AGENCY is required to have an audit in accordance with the Single Audit Act and OMB A-133, if it receives $300,000 or more in federal funds in a single fiscal year. The federal funds received under this project are a part of the Catalogue of Federal Domestic Assistance (CFDA) 20.205, Highway Planning and Research. OMB A-133 superceded OMB A-128 in 1996. Reference to OMB A-128 in Master Agreement (if any) is superceded by this covenant. 3. The Local Agency agrees that payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal -Aid Project Authorization/Agreement or Amendment/Modification (E-76) and accepts any increases in Local Agency Funds as shown on the Finance or Bid letter or its modification as prepared by the Office of Local Programs Project Implementation. 4. The City of Redlands agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the FNM-76 or its modification.The cost of work as shown above is an estimate only and it is understood that the State will reimburse the City on the basis of actual cost. The reimbursement is not to exceed the actual cost of the project. Any cost of the work determined by the California Department of Transportation (Caltrans) not to be Federally eligible shall be. borne by the City.An itemized estimate of the cost of the work to be performed by the City is attached hereto and made a part hereof.The City may receive progress payments of the Federal share of the project cost. If upon final accounting it develops that the State previously paid more than its share of said project, the City shall refund the difference between the Federal share and the amount paid by the State.All invoices submitted by the City for this project shall be submitted directly to Caltrans- HQ Local Programs Office, Mail Station #1, addressed to the Section 130 program coordinator for review and approval for payment. For construction costs, the City has 180 days after project completion to make the final payment to the contractor Program Supplement08-5083-M001-R1 ISTEA Page 2 of 4 Os-BBD•0-k .DL 12/ 11 /2000 STPLR-5083(005) SPECIAL COVENANTS OR REMARKS and prepare the final report of expenditures and final invoice, and submit to the State for verification and payment.The City and its contractors shall retain all original records and documents relating to work hereunder financed in part with Federal funds and shall make same available for inspection by State and Federal representatives upon request. Following final settlement of the project accounts with the Federal Highway Administration (FHWA), such records and documents may be microfilmed at the option of the City, but in any event shall be retained for a three-year period after FHWA payment of final voucher, or a four-year period from the date of the final payment under the contract, whichever is longer.It is agreed that the City will coordinate with the Burlington Northern Santa Fe Railway Company for interconnecting the railroad pre-emption devices with the traffic signals and inform Caltrans and the Public Utilities Commission upon completion of the work. 5. In the City of Redlands, San Bernardino County, on California Street at the Interstate 10 Freeway Ramps just north of the recently improved railroad grade crossing known as PUC#2U-6.3. Install two new 4-phase traffic signals at an estimated cost of $377,256. The Railroad portion of the work which consists of railroad signals and surfacing is for an estimated amount of $462,128.The City of Redlands hereby agrees to do the work herein set forth in accordance with the provisions of this form and of the attached sheets, if any, and the City agrees to receive and accept as full compensation the payment provided herein.Further, the said Department of Transportation hereby agrees to the terms set forth herein, and hereby agrees to pay the same; provided, that by mutual consent this Program Supplement may be modified or terminated at any time.It is expressly agreed that all persons engaged in this work are employees of the City and or its consultants and contractors and that none are employees of the Department of Transportation of the State of California.The City will not proceed with any construction work on the project until authorized in writing by the State. The State and Federal maximum liability pursuant to this Program Supplement is limited to the amount set forth herein.The City agrees to perform said work and to provide and furnish all necessary labor, materials,. tools, and equipment required therefor, and to prosecute same diligently to completion. The State is acting as a conduit for disbursement of Federal funds under the 1998 Transportation Efficiency Act for this project.All work performed by a person, company or corporation other than the City must have a California contractor's license.The State and the City agrees that in accordance with Title 23 Code of Federal Regulations, that there will be a 10% contribution by the City for the work performed under this Program Supplement. 6. All maintenance, involving the physical condition and the operation of the improvements, referred to in Article III MAINTENANCE of the aforementioned Master Agreement will be the responsibility of the Local Agency and shall be performed at regular intervals or as required for efficient operation of the completed improvements. The estimate cost of the work is $377, 256.00. Enclosed is the city copy of fully executed Program Supplement No. 001-Mi. This is the Notice to Proceed for the installation and interconnection of traffic signals. When the work is completed and the warning devices are in operation, please notify the California Public Utilities Commission, the railroad, and this office. Supp. Files Funds - Replacement of Office Printer - On motion of Councilmember George, seconded by Councilmember Haws, the City Council unanimously approved an additional appropriation from the General Fund in the amount of $1,000.00 to replace a LaserJet printer in the City Treasurer's office and hook it into the City's network. Loma Linda University Medical Center Project - COPs - On motion of Councilmember George, seconded by Councilmember Haws, the City Council unanimously approved an amendment to the purchase installment agreement with the Loma Linda University Medical Center relating to the 1993 Refunding Certificates of Participation Series D. Funds - Joslyn Senior Center Donations - On motion of Councilmember George, seconded by Councilmember Haws, the City Council unanimously approved an additional appropriation of $2,000.00 to fund programs and equipment for the Joslyn Senior Center. These funds were received in the form of donations and contributions from seniors utilizing the Center. Salary Adjustment - Part -Time Employees - On motion of Councilmember George, seconded by Councilmember Haws, the City Council unanimously approved a cost -of -living salary adjustment for part-time hourly employees in the amount of 2.5 percent. Review of Water and Wastewater Utility Fiscal Requirements - Staff requested authorization to issue a request for proposals for a review of water and wastewater utility fiscal requirements, rate revenue, and development impact fees. Councilmember Freedman asked if this study could be done with our staff as it would be less expensive. Municipal Utilities Director Phelps felt that in order to address the fiscal issues adequately, in a timely fashion, and with the credibility of an independent review, that the study should be done by a consulting firm specializing in this area. Finance Director Johnson agreed with Municipal Utilities Director Phelps' assessment. Staff indicated a willingness to continue this matter to further review. Councilmember Freedman moved to refer this request to the City Manager for further study to see if an in-house review would be a more reasonable solution. Motion seconded by Councilmember George and carried unanimously. Resolution No. 5837 - Traffic Signals - California Street and I-10 - On motion of Councilmember George, seconded by Councilmember Haws, the City Council unanimously adopted Resolution No. 5837, a resolution of the City Council of the City of Redlands authorizing the Mayor to act for and on behalf of the City in the execution of Program Supplement No. M001, Rev. 1 to the Administering Agency -State Agreement for Federal -Aid Project No. 08-5083 for railroad crossing protection at California Street and the BNSF Railroad south of and adjacent to Interstate 10 with the installation of traffic signals.
