Haskins , inclu Ing all assignees heirs, mortgagees, and successors in interest, 11-!-_r_ei_-.a_-ft-cr called ""applicant." RECITAL WHEREAS, Ordinance 1562 as amended requires certain improve- ments in connection with the division of real property, and WHEREAS, the City Council requires that where the land, or any portion thereof, being subdivided contains a citrus or other Fruit grove, the property owner, or his agent, shall file an agreement with the city that said grove shall be removed or maintained in good condition in compliance with customary agricultural practices until the start of construction. A copy of said agreement shall be filed with the city attorney and planning director and recorded prior to tentative approval of the subdivision or lot split by the City Council. COVENANTS Applicant hereby covenants as follows: 1. To remove or maintain in good condition in compliance with customary agricultural practices in the City of Redlands until the start of construction the grove located on property described on Exhibit "A" attached hereto. 2. This agreement shall be binding upon and enforceable agreement applicant and all assignees, heirs, mortgagees, and successors in iztk rest, and shall be recorded in the office of the county recorder. 1 3. If applicant or any successor in interest fails to comply with any term of this agreement or acts contrary to any ordinance of the City of Redlands, the City may bring action to enforce this agreement and said ordinance. Applicant and all successors in interest agree to pay all costs of suit and reasonable attorneys fees for such action. 4. In the event applicant for any cause fails to maintain the citrus groves in question in accordance with customary agri- cultural practices in the City of Redlands, the City of Redlands may at its option maintain or remove same, and the cost of such maintenance or removal shall become a lien upon and added to the City Tax upon the subject parcel.
