A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
ADOPTING A SCHEDULE OF EQUIPMENT RATES APPLICABLE TO MAJOR
DISASTERS AND EMERGENCIES
WHEREAS, during periods of major disasters and emergencies exceptional use
and strain is placed upon equipment owned by the City of Redlands; and
WHEREAS, the costs associated with the use and strain of City-owned equipment
should be reimbursed directly to the City departments responsible for preserving the
integrity and further use of such equipment; and
WHEREAS, 44 Code of Federal Regulations, Section 13.22 has defined general
policies for determining allowable costs for reimbursement of force account equipment
used during a major disaster or emergency; and
WHEREAS, exceptions exist to those policies as allowed in 44 Code of Federal
Regulations, Sections 13.4 and 13.6; and
WHEREAS, eligible direct costs for applicant-owned equipment have been
defined under established guidelines at 44 Code of Federal Regulations, Subsection
206.228(a)(1)(ii) Allowable Costs; and
WHEREAS, 44 Code of Federal Regulations Subsection 206.228(a)(1)(ii),
entitled "Allowable Costs," states that (i) "where local guidelines are used to establish
equipment rates, reimbursement will be based on those rates or rates in a Schedule of
Equipment Rates published by FEMA, whichever is lower;" that (ii) "If an applicant
certifies that its Iocally established rates do not reflect actual costs, reimbursement may
be based on the FEMA Schedule of Equipment Rates, but the applicant will he expected
to provide documentation if requested;" and (iii) "If an applicant wishes to claim an
equipment rate which exceeds the FEMA Schedule, it must document the basis for that
rate and obtain FEMA approval of analternate rate;" and
WHEREAS, 44 Code of Federal Regulations, Subsection 206.228(a)(1)(ii)
further states "No Established Rates. The FEMA Schedule of Equipment Rates will be
the basis for reimbursement in all cases where an applicant does not have established
equipment rates;" and
WHEREAS, the City of Redlands has determined that in some instances the cost
of the use of equipment exceeds the allowable FEMA Equipment Cost Code Schedule;
and
WHEREAS, the City of Redlands is prepared to provide documentation, if
requested, that local equipment costs exceed those rates provided by FEMA;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS
AS FOLLOWS:
Section 1. The City Council of the City of Redlands hereby adopts the City of
Redlands Schedule of Equipment Rates as attached hereto.
Section 2. The City Council of the City of Redlands approves that force
account equipment costs reimbursed by the Department of Homeland Security/Federal
Emergency Management Agency following a major disaster and/or emergency shall be
reimbursed to the department incurring the actual use of the equipment and costs
associated thereto.
