HomeMy WebLinkAbout000 RDA_CCv0001.pdf A RESOLUTION RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS SETTING HEARING REGARDING ACQUISITION OF CERTAIN REAL PROPERTY IN REDLANDS BY EMINENT DOMAIN AND PROVIDING NOTICE OF HEARING THEREON WHEREAS, for purposes of redevelopment it will be necessary for the Redevelopment Agency of the City of Redlands ( "Agency" ) to acquire certain real property bounded by Pearl Avenue on the North, 6th Street on the East, Santa Fe Railway right-of-way on the South, and Orange Street on the West, in the City of Redlands , and more particularly described in Exhibit "A" , which is shown on the boundary map on file with the Secretary; and WHEREAS, the Agency has attempted to negotiate with the owner or owners of real property to be acquired in order to negotiate a purchase on mutually acceptable terms but has been unable to do so; and WHEREAS, prior to adopting its Resolution of Necessity authorizing the commencement of eminent domain proceedings for the purpose of acquiring said real property this Agency must give the owner or owners of the property to be acquired, as said owners ' names and addresses appear on the last equalized county assessment roll, notice and a reasonable opportunity to appear and be heard on the matters referred to in Section 1240. 030 of the California Code of Civil Procedure; NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS does hereby resolve and declare as follows : Section 1 : That this Redevelopment Agency shall hold a hearing on October 07, 1986, at 7 : 00 p.m. , at the City Council Chambers of the City of Redlands, 212 Brookside Avenue, Redlands, California , et which time and place all persons whose property is to be acquired by eminent domain shall be given a reasonable opportunity to appear and be heard on the following matters ; (a ) Whether the public interest and necessity require the property; (b) Whether the project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; (c) Whether the property is sought to be acquired is necessary for the project ; Section 2 . Notice. The Secretary is hereby directed to give notice of said hearing to each person whose property is to be acquired by eminent domain and whose name and address appear on the last equalized county assessment roll in accordance with the requirements of Section 1245. 235 of the Code of Civil Procedure.
