A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDLANDS AMENDING RESOLUTION NO. 2786 , AS AMEND-
ED BY RESOLUTION NO. 3940, OTHERWISE KNOWN AS
THE EMPLOYER-EMPLOYEE RELATIONS RESOLUTION OF
THE CITY OF REDLANDS
WHEREAS , the City of Redlands has adopted Resolution
No . 2786, as amended by Resolution No. 3940 , otherwise known
as the Employer--Employee Relations Resolution of the City of
Redlands , to provide orderly procedures for the administration
of employer—employee relations between the City of Redlands
and its employee organizations and for resolving disputes
regarding wages , hours , and other terms and conditions of
employment; and
WHEREAS , the City desires to amend Section 1OB of the
Employer-Employee Relations Resolution of the City of Redlands
to permit the inclusion of professional employees in a unit
of representation consisting of mid-management and confidential
employees and Section 1OC to allow the City and a formally
recognized employee organization to agree in a memorandum of
understanding to bar the filing and consideration of a unit
modification petition during the term of the memorandum of
understanding; and
WHEREAS, the City of Redlands has met and conferred
with employee organizations representing employees in the
City of Redlands over said amendments , and the City and said
employee organizations have agreed to said amendments ;
NOW, THEREFORE , BE IT RESOLVED by the City Council of
the City of Redlands as follows :
SECTION I
Section 10B of the Employer-Employee Relations Resolution
of the City of Redlands shall be amended to read as follows :
"B. In the establishment of appropriate
units (1) professional employees shall
not be denied the right to be represent-
ed separately from non-professional em-
ployees ; and (2) management and conf-
idential employees may not be included
in the same unit with non-management
or non-confidential employees , except
that professional employees may be
included in a unit with management and/
or confidential employees . "
SECTION II
Section 10C of the Employer-Employee Relations Resolu-
tion of the City of Redlands shall be amended to read as
follows :
"C PROCEDURE FOR MODIFICATION OF ES-
TABLISHED APPROPRIATE UNITS.
Requests by employee organizations for
modification of an established appropriate
unit may be considered by the Municipal
Employee Relations Officer. Such re-
quests shall be submitted in the form
of a Petition for Recognition, and,
in addition to the requirements
set forth in Section 9 , shall con-
tain a complete statement of all
relevant facts and citations in
support of the proposed modified
unit in terms of the policies and
standards set forth in Section 10A
and 10B hereof . The Municipal
Employee Relations Officer shall
process such petitions as Recogni-
tion Petitions under this Resolu-
tion. Notwithstanding the fore-
going, the City and an employee
organization formally recognized
as the majority representative in
an existing unit of representation
may agree to bar the filing and
consideration of a petition for
unit modification during the term
of a memorandum of understanding
between the City and such employee
organization, so long as said agree-
ments are not prohibited by law. "
