BOX 3005 REDLANDS, CA 92373 FEES NOT REQUIRED PER GOVERNMENT CODE Assessor -Recorder -County Clerk 12/27/2022 Titles: 1 Pages: 6 08:25 AM SAN Fees $0.00 Taxes $0.00 F3010 CA SB2 Fee $0.00 Total $0.00 THIS SPACE FOR RECORDER'S USE ONLY RESOLUTION NO. 8425 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT A 10-FOOT WIDE PORTION OF STREET RIGHT-OF-WAY ON EAST HIGHLAND AVENUE ALONG THE FRONTAGE OF TRACT NO. 20065 IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF A PORTION OF SAID EXCESS RIGHT-OF-WAY (CITY OF REDLANDS STREET VACATION NO. 188) WHEREAS, Hicks & Hartwick, Inc., authorized representative, has submitted an application requesting vacation of the excess street right of way along East Highland Avenue that is ten (10) feet wide and 998 feet in length, along the south side of East Highland Avenue and approximately 50 feet west of South Lincoln Avenue/Redlands Street, along the entire frontage of the previously approved Tract Map No. 20065 (APN: 0174-161-25-0000), as more specifically described in Exhibit "A", which is attached hereto and made part hereto (the "Street Vacation"); and WHEREAS, the City is authorized to vacate all or part of a public street easement within the City pursuant to Streets and Highway Code section 8300 et seq.; and WHEREAS, pursuant to Streets and Highway Code section 8340, the City may, for public convenience and necessity, reserve and except public service easements from the Street Vacation; and WHEREAS, at its meeting on October 11, 2022, as required by Government Code Section 65402, the Planning Commission made a determination that the Street Vacation conforms to the City's General Plan; and WHEREAS, on November 15, 2022, the City Council of the City of Redlands adopted Resolution No. 8408 declaring its intention to vacate such portion of East Highland Avenue, and set a public hearing date and time for the proposed Street Vacation; and WHEREAS, City staff has recommended that the proposed Street Vacation is exempt from environmental review under the California Environmental Quality Act ("CEQA"), pursuant to section 15061(b)(3) of the CEQA Guidelines for projects where there is no possibility of any environmental effects; and 1 1:\Resolutions\Res 8400-8499\8425 Street Vacation 188 East Highland.docx DOC #2022-0406561 Page 2 of 6 WHEREAS, pursuant to Streets and Highways Code section 8320, the Redlands City Clerk published notice in the Redlands Daily Facts, for two successive weeks prior to the hearing, and caused the posting of notices along the proposed Street Vacation two weeks prior to the date set for the public hearing, no more than 300 feet apart, with at least three notices posted; and WHEREAS, on December 20, 2022, the City Council held a duly noticed public hearing on the Street Vacation and considered all verbal and written testimony provided by City staff and all interested persons. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. Approval of the Street Vacation is exempt from environmental review in accordance with the California Environmental Quality Act ("CEQA"), pursuant to section 15061(b)(3) of the State's CEQA Guidelines because, based on the information in the staff report and presented at this hearing, it can be seen with certainty that the approval of the Street Vacation will have no physical effect on the environment. Section 2. The City Council having elected to proceed under the provisions of Streets and Highways Code Section 8300 et seq., and having held a public hearing as provided therein, finds from all evidence submitted that the Street Vacation is unnecessary for present or prospective public use, and that the public interest and convenience require the Street Vacation. Section 3. Pursuant to Streets and Highways Code Section 8340, the City reserves and excepts from the Street Vacation a permanent easement for in -place and future public utility facilities. Section 4. Pursuant to Streets and Highways Code section 892, the portion of the Street Vacation to be vacated is not useful as a non -motorized transportation facility. Section 5. Pursuant to Streets and Highways Code section 8325, the City Clerk is hereby directed to cause a certified copy of this resolution to be recorded in t i - .1 records of the county of San Bernardino.
