This second amendment ("Second Amendment") to the Public Works Construction
Contract for the Senior Center Outdoor Dining Facilities Construction Project for the
("Contract"), dated June 21, 2022, by and between the City of Redlands, a municipal corporation
and a general law city ("City"), and DEARK E&C, INC. ("Contractor"), is made and entered
into this 17th day of January, 2023.
RECITALS
WHEREAS, it is the desire of the City and Contractor to amend their existing Contract,
specifically to amend the time for completion of the contract to March 22, 2023.
NOW, THEREFORE, for good and valuable consideration in the receipt of which is
hereby acknowledge City and Contractor agree as follows:
AGREEMENT
Section 1. Section 3 of the contract, entitled "Time for completion," is hereby amended to
read as follows:
3 "TIME FOR COMPLETION: The Work shall be completed within two hundred forty
(240) calendar days from and after the date of City's issuance of a Notice to Proceed to
Contractor."
Section 2. All other provisions of the Agreement shall remain unchanged by this Second
Amendment and in effect.
Section 3. This Amendment may be executed in counterparts, each of which shall be
deemed an original, but all of which, together, shall constitute one and the same instrument.
