This second amendment ("Second Amendment") to the Public Works Construction
Contract for the Orange Blossom Trail Phase 3 Project dated June 7, 2022 (the "Contract"), by
and between the City of Redlands, a municipal corporation and general law city ("City"), and
Deark E&C, Inc., a California corporation ("Contractor"), is made and entered into this 7 b day of
February 2023.
RECITALS
WHEREAS, it is the desire of the City and Contractor to amend their existing Contract,
specifically to amend the Time for Completion of the Contract; and
WHEREAS, the City Council approved the contract with contractor for work in
accordance with the Contract Documents for City's Orange Blossom Trail Phase 3 Project,
Project. No. S241001;
NOW, THEREFORE, in consideration of the mutual promises contained herein City and
Contractor agree as follows:
AGREEMENT
Section 1. The time for completion, as set forth in Section 3 of the Contract, is hereby
amended to increase Contractor's time for completion and shall read as follows:
"TIME FOR COMPLETION: the Work shall be completed within Two Hundred Forty
(240) calendar days from and after the date of City's issuance of a Notice to Proceed to
Contractor."
Section 2. All other provisions of the Contract shall remain unchanged by this Second
Amendment, and in effect.
IN WITNESS WHEREOF, the parties have executed this Second Amendment, to be
effective as of the 7u' day of February 2023.
