HomeMy WebLinkAbout6573_CCv0001.pdf RESOLUTION NO. 6573 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS AMENDING RESOLUTION NO. 6561 RELATING TO TRANSPORTATION IMPROVEMENT FEES Whereas, the City Council of the City of Redlands ("this City Council") engaged the services of a consultant to prepare a comprehensive Public Facilities Fee Program to determine the maximum justified fees to impose on new development to ensure payment of the capital costs of necessary public facilities to serve such new development; and Whereas, as part of that Public Facilities Fees Program, a report was prepared entitled "City if Redlands Transportation Facilities Fee Study," dated November, 2006, which summarized an analysis of the need for transportation facilities and capital improvements to support new development within the City; and Whereas, on December lq, 2006, and based upon the Transportation Facilities Fee Study, this City Council adopted Ordinance No. 2652 to establish a Transportation Improvement Fee Program to implement the City's General Plan to ensure that streets, street improvements, and traffic signal improvements and facilities, which meet City standards, are available concurrent with the need caused by new development in the City; and Whereas, pursuant to Ordinance No. 2652, this City Council subsequently adopted Resolution No. 6561 to establish the specific amount of the Transportation Improvement Fee; and Whereas, by its provisions, Resolution No. 6561 is scheduled to take effect on February 20, 2007, concurrent with the effective date of Ordinance No. 2652; and Whereas, since the date of adoption of Resolution No. 6561, City staff has undertaken further review of the assumptions contained in the Transportation Facilities Fee Study, and the improvements described therein, and has determined that several of the assumptions made and the improvements described in the Transportation Facilities Fee Study need refinement; and Whereas, City staff has recommended to this City Council that it is in the best interests of the City to delay implementation of the Transportation Improvement Fee to permit the City's consultant to reevaluate and refine the assumptions and description of improvements contained in the Transportation Facilities Fee Study; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows; Section 1. Notwithstanding Section 2 of Resolution No. 6561 which provides that such resolution shall take effect on the effective date of Ordinance No. 2652 (February 20, 2007), this City Council hereby amends Resolution No. 6561 to suspend its effective date to allow the City's DJM\RESO%573 amending Transportation Fee consultant to reevaluate and refine the assumptions and improvement descriptions contained in the Transportation Facilities Fee Study. Section 2. This City Council further determines that Resolution No. 6561 shall not take effect unless and until a revised Transportation Facilities Fee Study is presented to this City Council and a subsequent resolution establishing the specific amount of the Transportation Improvement Fee justified by such study is approved in accordance with law by this City Council. Section 3. That the City's present Street Improvement Fees and Traffic Signalization Fees, which were previously identified in Chapters 3.54 and 3.58 of the Redlands Municipal Code and are now identified below in this Resolution as provided for by Ordinance No. 2652, shall remain in effect front and. after the effective date of Ordinance No. 2652: Fee Area Street Improvement Fees Traffic Signalization Fees Fee per trip generated Fee.per tri venerated East Valley 75.36 $ 6.96 Central $ 166.23 $ 27.86 North $ 186.72 $ 26.14 South S 1.80.08 $ 34.35 Canyon S 299.19 $ 14.22 Crafton S 227.78 $ 54.25 Section 4. This City Council further determines that the approval of this Resolution is exempt from review under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15061(b)(3) which provides that CEQA applies only to projects which have the potential for causing a significant effect on the environment. This City Council finds that it can be seen with certainty that there is no possibility that the approval of this Resolution, which maintains the rate of existing street improvement and traffic signalization fees, may have a significant effect on the environment.
