HomeMy WebLinkAbout4458_CCv0001.pdf RESOLUTION NO. 445$ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ESTABLISHING A SCHEDULE OF LOCAL STORM DRAIN FEES AND RESCINDING RESOLUTION NO. 4401 WHEREAS, the City Council of the City of Redlands has adopted Ordinance No. 2037 which establishes a requirement for the payment of local storm drain fees by new development within the City to ensure that new storm drains are constructed and made available concurrent with the need caused by the new development; and WHEREAS, pursuant to Ordinance No. 2037 , this City Council approved Resolution No . 4401 which established a schedule setting forth the specific amount of fees to be levied upon new development within the City; and WHEREAS, the City Engineer has undertaken a new comprehensive study of the City' s local storm drain system and the need for new storm drains and improvements caused by new development; and WHEREAS, the results of the City Engineer 's new study demonstrate that the amount of local storm drain fees should be based upon the type of development, the zone in which such development is proposed to be located and the estimated runoff calculation caused by the construction of such development, and that the fees set forth in Resolution No. 4401 should accordingly be increased; and WHEREAS, the fees collected pursuant to this resolution shall be used to finance the public facilities described in the City' s Master Storm Drain Plan; and WHEREAS, the facts and evidence presented to this Council establish that there is a reasonable relationship between the need for storm drain improvements and the impacts of new residential development for which the corresponding fee is charged, and also that there is a reasonable relationship between the fee' s use and the type of development for which the fee is charged; NOW, THEREFORE, be it resolved by the City Council of the City of Redlands as follows: SECTION I . Local storm drain fees for residential, commercial and industrial development are hereby determined to be: (1) $1 ,480 .72 per dwelling unit for residential development constructed in the RA zone; (2) $1 ,129 .59 per dwelling unit for residential development constructed in the RE zone; (3) $829 .71 per dwelling unit for residential development constructed in the RS zone; (4) $749 .25 per dwelling unit for residential development constructed in the R-1 zone; (5) $598 .51 per dwelling unit for residential development constructed in the R-2, R-2,2000 and R-3 zones; (6) $7,329 .60 per acre for commercial and industrial development constructed within the C and I/M zones, based upon the attached table. SECTION ;j. Local storm drain fees for residential dwelling units constructed in agricultural zones are hereby determined to be $81 .44 per dwelling unit within the A-1 zone or on a parcel of more than 1 .5 acres in commercial agricultural production , and $325 .76 per dwelling unit in the A-2 zone. SECTION 3 . Local storm drain fees for any construction of buildings, additions or other impervious areas not included in Sections 1 and 2 of this resolution are hereby determined to be $0 .25 per square foot of roofed and paved (impervious) area. SECTION 4 . The fees specified in this resolution shall become effective March 6 , 1989 , and at that time, Resolution No. 4401 shall be rescinded without further action of this Council and shall be of no further effect.
