A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF REDLANDS ESTABLISHING A SCHEDULE OF LOCAL
STORM DRAIN FEES AND RESCINDING RESOLUTION NO. 4746
WHEREAS, the City Council of the City of Redlands
has adopted Ordinance No. 2037, as amended by Ordinance No.
2146, which establishes a requirement for the payment of
local storm drain fees by new development within the City to
ensure that new storm drains are constructed and made
available concurrent with the need caused by the new
development; and
WHEREAS, pursuant to Ordinance No. 2037, this City
Council approved Resolution No. 4746 which established a
schedule setting forth the specific amount of fees for storm
drain construction to be levied upon new development within
the City; and
WHEREAS, the Public Works Director has undertaken a
new comprehensive study of the City's local storm drain
system and the need for new storm drains and improvements
caused by new development; and
WHEREAS, the results of the Public Works Director's
new study demonstrate that the amount of local storm drain
fees should be based upon the type of development, the area
of the City and the zone in which such development is
proposed to be located, and the estimated runoff calculation
caused by the construction of such development, and that the
fees set forth in Resolution No. 4746 should accordingly be
amended; and
WHEREAS, the fees collected pursuant to this
resolution shall be used to finance the storm drain
construction described in the City's Program Report for
Development Impact Fees, dated October, 1990; and
WHEREAS, the facts and evidence presented to this

Council establish that there is a reasonable relationship
between the need for storm drain improvements and the impacts
of new development for which the corresponding fee is
charged, and also that there is a reasonable relationship
between the fee's use and the type of development for which
the fee is charged;
NOW, THEREFORE, be it resolved by the City Council
of the City of Redlands as follows:
SECTION 1. Local storm drain fees for residential,
commercial and industrial development are hereby determined
to be as shown on the attached list. Other construction,
including but not limited to, building additions, patios,
walkways, driveways, out buildings, and other such
construction not included in the attached list, shall be
assessed at the rate of $0. 30 per square foot of roofed and
paved (impervious) area. Also included at this rate shall be
any impervious area constructed within public right-of-way
such as street pavement, curb and gutter, sidewalk, and
driveway approaches.
SECTION 4. The fees specified in this resolution
shall become effective on September 20, 1991, and at that
time, Resolution No. 4746 shall be rescinded without further
action of this Council and shall be of no further effect.
ADOPTED this 20th day of August, 1991.
