A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF REDLANDS ESTABLISHING A SCHEDULE OF
PUBLIC FACILITY FEES FOR
FIRE, POLICE, LIBRARY, CITY HALL AND CITY YARD
FACILITIES AND RESCINDING RESOLUTIONS NO. 4429 AND 4470
WHEREAS, the City Council of the City of Redlands
has adopted Ordinance No. 2048, as amended by Ordinance No.
2146, which establishes a requirement for the payment of
public facility fees by new development within the City to
ensure that new public facilities are constructed and made
available concurrent with the need caused by the new
development; and
WHEREAS, pursuant to Ordinance No. 2048, this City
Council approved Resolutions No. 4429 and 4470 which
established a schedule setting forth the specific amount of
fees for public facility construction to be levied upon new
development within the City; and
WHEREAS, the Public Works Director has undertaken a
comprehensive study of the City's existing public facilities
and the need for public facility construction and related
improvements caused by new development; and
WHEREAS, the results of the Public Works Director's
study demonstrate that the amount of public facility fees
should be based upon the type of development, the area of the
City and the zone in which such development is proposed to be
located, and the estimated percentage of contribution caused
by the construction of such development, and that the fees
set forth in Resolutions No. 4429 and 4470 should be
accordingly increased; and
WHEREAS, the fees collected pursuant to this
resolution shall be used to finance public facility
construction described in the City's Program Report for
Development Impact Fees, dated October, 1990 ; and
WHEREAS, the facts and evidence presented to this
Council establish that there is a reasonable relationship
between the need for public facility improvements and the
impacts of new development for which the corresponding fee is
charged, and also that there is a reasonable relationship
between the fee's use and the type of development for which
the fee is charged;
NOW, THEREFORE, be it resolved by the City Council
of the City of Redlands as follows:
SECTION 1. Local public facility fees for
residential, commercial and industrial development are hereby
determined to be as shown on the attached tables.
SECTION 2 . The fees specified in this resolution
shall become effective on April 6, 1991, and at that time,
Resolutions No. 4429 and 4470 shall be rescinded without
further action of this Council and shall be of no further
effect.
