A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF REDLANDS ESTABLISHING A SCHEDULE OF LOCAL
STREET CONSTRUCTION FEES AND RESCINDING RESOLUTION NO. 4393
WHEREAS, the City Council of the City of Redlands
has adopted Ordinance No. 2038, as amended by Ordinance No.
2146, which establishes a requirement for the payment of
local street construction fees by new development within the
City to ensure that new streets are constructed and made
available concurrent with the need caused by the new
development; and
WHEREAS, pursuant to Ordinance No. 2038, this City
Council approved Resolution No. 4393 which established a
schedule setting forth the specific amount of fees for street
construction to be levied upon new development within the
City; and
WHEREAS, the Public Works Director has undertaken a
new comprehensive study of the City's local street system and
the need for street construction and improvements caused by
new development; and
WHEREAS, the results of the Public Works Director's
new study demonstrate that the amount of local street
construction fees should be based upon the type of
development, the area of the City and the zone in which such
development is proposed to be located, and the estimated trip
generation calculation caused by the construction of such
development, and that the fees set forth in Resolution No.
4393 should accordingly be increased; and
WHEREAS, the fees collected pursuant to this
resolution shall be used to finance the street construction
improvements described in the City's Program Report for
Development Impact Fees, dated October, 1990; and
WHEREAS, the facts and evidence presented to this
Council establish that there is a reasonable relationship
between the need for street construction improvements and the
impacts of new development for which the corresponding fee is
charged, and also that there is a reasonable relationship
between the fee's use and the type of development for which
the fee is charged;
NOW, THEREFORE, be it resolved by the City Council
of the City of Redlands as follows:
SECTION 1. Local street construction fees for
residential, commercial and industrial development are hereby
determined to be as shown on the attached table.
SECTION 2 . The fees specified in this resolution
shall become effective on April b, 1991, and at that time,
Resolution No. 4393 shall be rescinded without further action
of this Council and shall be of no further effect..
