A Conditional Use Permit (CUP) is required by the County Development Code to evaluate the location, design and operation for certain new or expanded land uses as specified in each Land Use District. These uses, although generally deemed to be consistent with the purpose and intent of the Land Use District, typically have characteristics which require special consideration in order to avoid conflicts with surrounding land uses. Note: Wireless telecommunication facilities are required to be submitted on a spcialized application form. The Conditional Use Permit application and process provides the County the opportunity to completely review the proposed project before its implementation. Conditions of Approval will be required of the project prior to its final approval or implementation. Conditional Use Permits will be reviewed by Planning Staff and may be considered by the Planning Commission at a public hearing. Actions of the Planning Staff may be appealed to the Planning Commission and actions of the Planning Commission may be appealed to the Board of Supervisors within ten days following the date of the action. Appeals must be made by means of a separate application and may require an additional fee. Please use this information sheet as a checklist to assemble the materials required for the submittal of your Conditional Use Permit and bring it with you when you submit your application. An appointment is not required to submit your application; however, appointments are available upon request. If you wish to schedule an appointment, please call one of the numbers listed above. E 3 4. GENERAL PROCEDURES Submit application and fees - County staff will use the checklist to determine whether your application may be accepted. The County's standard Land Use Application shall be used and is contained in this packet. Determination of Application Completeness -- County staff will determine whether the materials you have submitted are adequate or if additional materials or reports are required. You will be notified in writing if any additional materials are required. Environmental Action Determination - County staff will prepare an Environmental Initial Study in compliance with the California Environmental Quality Act (CEQA). It is through the initial Study that the determination is made as to what type of environmental determination will be required. If an Environmental Impact Report (EIR) is required, staff will contact you to explain the process and the costs. Application processing - The project planner will have the project and materials reviewed by all appropriate County Departments and Agencies. Any required corrections, questions or revisions to the plans or other materials will be reviewed by the project planner and then provided to you. CHECKLIST OF SUBMITTAL MATERIALS Please use this checklist as you assemble the materials for the submittal of your application, County staff will use the checklist to determine whether your application is acceptable for submission. If your submittal package does not contain all of the information listed below, your application will not be taken in and receipted for processing. If you have any questions about the items requested or if you wish to obtain information on processing schedules, please call the Application Intake Center at (909) 387-4131. Section A — Fees/Deposit Check or money order made payable to "San Bernardino County' in the correct amount. Contact DEHS at (909) 387-4666 for fee amount, applicability and payment prior to application submittal Receipt from the appropriate fire jurisdiction of payment of required review fees. Note: If your project is within a Geologic Hazard Overlay District, you will be required to pay the Building and Safety Division the review fees for any required geologic reports. You will be notified when you will need to complete this part of the process. The fee amount will be as established by the County Fee Ordinance. The fees listed above (2 - 4) for DEHS, County Fire and Building and Safety are in addition to the "actual cost' deposit. Additional fees will be required if the application is the subject of a Code Enforcement action or if the action is appealed. "Actual Cost Initial Deposit" — The basic review fees for this application are charged on an "actual cost" basis. Your application money is deposited into an account and the reviewing staff records the time spent processing your proposed project. Your account is then charged for the staff time at established hourly rate ($65 to $1351hr). If account funds are depleted an additional deposit will be requested. If an additional deposit is required it must be paid to allow staff to continue processing. Any failure to pay the requested deposit will result in termination of the review process. After the review is completed, a minimum deposit balance of $1000 will be required for condition compliance processing. For more information on fees, please refer to the Land Use and Development Review Fees handout. Section B - County Documents 4. Two copies of a completed Land Use Application Questionnaire. Only two copies of the application are required for the initial fling of this application. Revisions may or may not be required. When Application Intake Center staff determines that the application is complete, you will be required to submit additional copies of the application. The specific number of copies to be submitted will be determined at that time. 5. Completed Hazardous Waste Site Certification form contained in this packet. 6. Two copies of the Adequate Service Certification for water and sewer service. Please use the forms (A, W1, W2, 81 and S2) at the end of this packet. San Bernardino County -2- Conditional Use Permit Section C — Other Documents 7. Two copies of a plot plan drawn at a scale to accurately delineate the proposed project as it is to be constructed. A conceptual plan is not acceptable. (Folded accordion style - 8" x 10 112" size.) (Refer to the Plot Plan Checklist for specific requirements.) Only two copies of the plot plan are required for the initial filing of this application. Revisions may or may not be required. When Application Intake Center staff determines that the plan is complete, you will be required to submit additional copies of the plot plan. The specific number of copies to be submitted will be determined at that time. 8. One copy of the plot plan reduced to 11" X 17". 9. One copy of a) the recorded Grant Deed or b) the Quit Claim Deed with the Previous Grant Deed for each lot or parcel or c) a copy of a current Preliminary Title Report (issued within 60 days of filing). 10. One copy of the appropriate assessor's map. This may be obtained from the Assessor's Office. 11. One copy of the United States Geological Survey (USGS) Map of the project area clearly showing project boundaries and labeled with the quadrangle map name and applicant's name. A legible photocopy is acceptable. The USGS map may be purchased at a local blueprint company. 12. One copy of any letter or document received from the County or other agency regarding this project. 13. Original color photos of the project site from various angles (digital photos on a disk/CD are preferred). Section D - Special Studies (if applicable) 14. Three copies of a Geologic Feasibility Study for any property in a Geologic Hazard (GH) Overlay District. 15. Four copies of a Slope Analysis for any project in a Fire Safety (FR1) Overlay District. 16. Three copies of any other studies prepared for this project. 17. Four copies of any required traffic study. 18. Two copies of any required Endangered Species Report (Desert Tortoise Certificate, etc.). 19. Two cop! of the Fiscal Impact Report for any mobilehome project of 50 units or more. Section E — Public Notice Materials/Surrounding Property Owners Certification Please refer to the sheet titled "Surrounding Property Owners Certification" for details regarding requirements and label format. This sheet also includes the required signature block for the person who prepared the information and labels. The Mailing Labels should include the applicants' and representatives' mailing addresses. 20. Submit two adhesive sets and one reproducible copy of mailing labels for all property owners that own property within the following specified areas. The following are based on the project area being: 20.0 acres or less: All parcels within 300 feet of the external boundaries of the project parcel. 20.1 acres to 160 acres: All parcels within 700 feet of external boundaries of the project parcel. 160.1 acres or greater: All parcels within 1,300 feet of the external boundaries of the project parcel. 21. Submit the certification sheet signed by the person who prepared the list and labels. Section F —Additional Materials Technical studies for traffic, drainage, noise, air quality, biotic resources, archeological resources, groundwater resources, hazardous materials, or other issues may be required to process your application. You will be notified if any additional materials will be required for the application. Section G — Plot Plan: Use the following checklist to be sure that your plans include all of the required elements. The plot plan is a drawing, to scale, on one sheet of paper (minimum size of 18" x 24") of the entire land parcel showing buildings, improvements, other physical features and all dimensions. Remember that the staff and Planning Commission are not familiar with the property and will need this information to evaluate your project. If the plans are not legible or do not contain the information listed below, your application will be returned. 1. _ _ k Plan Identification: A 4 inch by 14 inch area in the upper right hand side of the plot Official �sha shall eft bland p and labeled "Official Use Only'. The lower right hand corner of the plan shall contain the following information in this order: a) Assessor's Parcel Number(s) (APN:); b) application type and proposed land uselbuiiding size "CUP for " c) the names, addresses and telephone numbers of the applicant, representative, recorded Property Owner(s) (if different from applicant), and plan preparer and d) plot plan preparation date and any revision date. 2. Utilities: Indicate names, address and telephone numbers of water company, sewage disposal, electric, gas, telephone, cable television. If no utility company, indicate method of supply. 3. Legal Description: Complete legal description of the property including number of acres. Include APN. North Arrow: Indicate north (pointing to top or right hand side of the plan), date of drawing and the scale. Use an Engineer's Scale (1" to 10', 1" to 20', etc.) Dimensions: Show all property lines and dimensions. Also, show boundary lines of project with dimensions if only a portion of the property is being developed. RoadslEasements: Indicate location, names, centerline, widths of boundary streets, and recorded road, utility, and drainage easements on the property. If none exist, indicate by a note that no easements exist. If property is not on a road or easement, show access to property. Drainage: Indicate any drainage or hilly terrain by flow -line arrows and contour lines. If none exist, indicate by a note that no hilly terrain or drainage problems exist. Gradin go o ra hic Information: Show existing rough grade contours and finish contours. Show finish elevations at lot corners and graded areas. Show typical lot drainage and swales. Show finish grades for all structures, pads and parking surfaces. If no grading is proposed, state " No grading proposed." Show location, size and height of any existing or proposed retaining walls. Land Use District: Indicate existing and proposed General Plan Land Use District for project and all adjacent property including across any streets. If in a City, list the City and City Zoning. Structures/Land Use Adjacent Areas): Indicate the existing land use, including "Vacant" or "citrus grove," of structures on all adjacent property including areas across any adjacent streets. Indicate distance to any structure that is within 20 feet of the project property line. Structures (Project Area):. Indicate with dimensions all existing and proposed structures, including but not limited to power poles, towers, fences, trash enclosures, signs, septic systems, curbs, driveways, and sidewalks: Indicate type of constructions and approximate age of any existing/proposed structures Locate by distance in relation to other structures and property lines. Indicate existing structures that are to remain or to be removed. Indicate the specific use of all existing and proposed structures. Indicate height, building footprint dimensions, including eave overhang projections, square footage of each story and number of stories including basements. Show location and height of any non -retaining wall. Vicinity Mai Indicate project location within a general vicinity map with a north arrow. Indicate nearest cross streets, major access roads and community name. Signage: If none proposed state "No signs proposed" Provide a dimensioned side elevation of any proposed identification sign including the proposed "copy' (wording). Include distance from both top and bottom of sign to grade. Refer to Development Code for information on allowable type and size of signs. Box 944209 SACRAMENTO, CA 94244-2090 (916) 443-3531 March 6, 1991 To All Project Applicants Environmental Filing Fees In accordance with Section 711.4 of the Fish and Game Code, effective January 1, 1991, persons or entities are required to pay an Environmental Filing Fee for projects subject to the California Environmental Quality Act (CEQA) that may have any adverse affect on wildlife resources. As defined in Section 711.2(a) of the Fish and Game Code: . . `wildlife' means and includes all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability . . . ." The filing fees are due and payable at the time a Notice of Approval or Determination is filed with the county clerk. With the exception of a documentary handling fee, counties are required to remit 100 percent of these fees to the Department of Fish and Game (Department). The Legislature, in adopting environmental filing fees, intended to extend the current Department user -based funding system by allocating a portion of the costs of wildlife protection and management to those who may consume wildlife resources through urbanization and development. These fees are not intended to reimburse costs specifically identifiable to individual projects, but rather to offset a relative portion of the cumulative effect of all projects. It is important to note, Section 711.4(c) of the Fish and Game Code and Section 21089 of the Public Resources Code, clearly states: ". . no project shall be operative, vested, or final until the filing fees required pursuant to Section 711.4 are paid." Fee exemptions are allowed for the following projects: 1. All projects statutorily exempt from the provisions of CEQA. 2. All projects categorically exempt by regulations of the Secretary for Resources from the requirement to prepare an environmental document. 3. All projects found by the lead agency to be "de minimis" when a lead agency finds and certifies that, as a result of its environmental review, a project has no potential for any adverse effect, either individually or cumulatively on wildlife resources. For projects not exempt from the fee and for which a Negative Declaration has been prepared, the fee is $1,250.00. 2. For projects not exempt from the fee and or which an Environmental Impact Report has been prepared, the fee is $850.00. In addition to the filing fee, county clerks have been provided the authority to collect up to a $35.00 documentary handling fee. If you have any questions regarding how this fee requirement may impact your project, please contact your local lead agency or your nearest Department of Fish and Game, Environmental Services office (see attached map). If you wish to know definitely whether your project is subject to these fees, you may call the project planner any time after the initial study has been completed. If your project is subject to these fees, you will have to submit your payment ($1285.00, $885.00 or $35.00 depending on project specifics) to the Clerk of the Board of Supervisors within five (5) days after the date of conditional approval. The project planner will then be able to complete the final paperwork at the appropriate time. Be sure to identify which question is being amplified.) #23 The 19.6 acre site is typical of the historic orange grove and vegetable growing area lying southerly of the Santa Ana River. The site is relatively flat, sloping less than 1 % east to west on the parcels. Soils of the site are sand and gravel sediments deposited by the alluvial fans sourcing from the San Bernardino Mountains. These soils are subject to the same geologic hazards the entire valley endures including seismic shaking, liquefaction and flooding. The biological, cultural and historical resources will be described thoroughly in separate documented studies provided. There are no exisiting structures on the project site APN # 0292-041-08-0000 and # 0292-041-09-0000. These two parcels are currently being farmed with cultivated vegetables and has no trees. #24 The project site is surrounded by agricultural uses with a block of land delineated by Palmetto Avenue along the south, Nevada Street on the west, Alabama Street to the east and the Santa Ana River bordering on the north. Orange groves are located to the south between these two parcels and Palmetto Avenue. Plowed fields lay across these two parcels and to the west to Alabama Street. The City of Redlands Water Reclaimation plant is located to the north. Color digital photographs are provided attached as well as a CD of various angles is provided with the application package. Section 6 - Environmental Setting 6. If Industrial, attach information indicating type of industrial activity proposed, square footage of building, estimated employment per shift and loading facilities. The proposed facility will be for industrial business activity. - The primary business at this facility, will be the conversion and production of organic compost from municipal bio- solids using a proprietary process. This process is housed in a totally enclosed building complete with air scrubbers to manage odors. - The initial plant facility will be sized to handle approximately 100,000 wet tons of bio-solids annually. This facility will be approximately 65,000 - 70,000 square feet. - Trucks will enter and unload bio-solids in a specially designed truck unloading enclosed area. Trucks will leave via an exit road at the opposite side of the facility from the entrance. Truck scales will be utilized one at the truck entrance and one at the truck exit to accurately record bio-solids received and compost processed and exiting the facility. - This facility is anticpated as a muli-shift operation, on a 5-7 day basis, with approximately 6-12 employees. Generally the plant will operate 1 112 shifts daily but will be occupied on a 24 hour/7 day basis. - Plant operation is scheduled as a 5 -7 day operation. San Bernardino County -6- land Use Application Questionnaire - A wood processing system complements the process by receiving "diverted wood waste from landfills", sizing equipment for the green waste and construction wood waste and conveyance to the mixing area for blending with bio- soilds before being conveyed to the reactor cells. - A unique air scrubber system will provide approximately 60 seconds of residence time to allow for 98% -100% removal of virtually all odor elements in all the air leaving the facility. (See separate Odor/Air Quality Study with application) - A covered and air controlled storage area will be provided as "surge" or short term holding for finished compost. This storage will provide adequate time for truck loading and removal while permitting the facility to operate. - An administration office with public access and demonstration building will accompany the processing facility on the site. This office will house the administration for the operation as well as the record keeping, employee break facilities and conference/demonstration area. - Greenhouses are proposed on the west side of the process facility "ducted" with warm, carbon dioxide enriched air from the process, to facilitate year around horticultural use. This will provide the facility to demonstrate the sustainable and reusable elements of this process. Phase 11 - A proposed phase II expansion to the Phase 1 facility, which would increase the processing capacity by an additional 100,000 wet tons of bio-solids annually. This facility is not currently planned, but estimated for sometime (1-3 years) in the future after the initial facility is opened, in Q4 of 2006.
