RESOLUTION NO. 8444
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
FINDING THAT A SEGMENT OF ALLEY PUBLIC RIGHT-OF-WAY
LOCATED ADJACENT TO 26849 BARTON ROAD AND 26863 LADERA
STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET
PURPOSES, AND ORDERING A SUMMARY VACATION (STREET
VACATION NO. 182)
WHEREAS, the Applicant, Joseph Bonadiman, has requested the summary vacation of a
portion of excess, undeveloped right-of-way, that is 15 feet in width and approximately 354 feet
in length totaling approximately 5,317 square feet, located adjacent to 26849 Barton Road and
26863 Ladera Street (APNs: 0293-082-12-0000, 0293-082-13-0000, 0293-082-14-0000, 0293-
082-15-0000, and 0293-082-05-0000); and
WHEREAS, the City of Redlands is authorized to vacate all or part of a public street or
public service easement within the City pursuant to the Public Street, Highway, and Service
Vacation Easements law (California Streets and Highway Code, Section 8300 et. seq.); and
WHEREAS, pursuant to Section 8331 of the California Streets and Highway Code, the
City may summarily vacate a street if the street or highway has been impassable for vehicular
travel and no public money was expended for maintenance on the street for a period of five
consecutive years prior to vacation; and
WHEREAS, pursuant to Section 8334 of the California Streets and Highway Code, the
City may summarily vacate excess right-of-way of a street not required for street purposes; and
WHEREAS, in accordance with Section 8334.5 of the California Streets and Highway
Code, the street may be summarily vacated as there are no known in -place public utility facilities
that are in use that would be affected by the vacation; and
WHEREAS, the proposal qualifies for exemption from environmental review in
accordance with the California Environmental Quality Act (CEQA), pursuant to Section
15061(b)(3) of the CEQA Guidelines for projects where there is no possibility of any
environmental effects; and
WHEREAS, on December 13, 2022, the Planning Commission held a public meeting on
the proposed vacation, and found that the vacation of the alley right-of-way would be in
conformance with the City of Redlands 2035 General Plan; and
WHEREAS, on March 7, 2023, the City Council held a public meeting on the proposed
summary vacation, and considered all testimony provided by the applicant and other persons
interested on the proposed vacation.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF REDLANDS AS FOLLOWS:
SECTION 1. The proposed vacation of said portion of alley right-of-way, located on the
west side of Ladera Street adjacent to 26849 Barton Road and 26863 Ladera Street, is exempt
from environmental review in accordance with the California Environmental Quality Act
(CEQA), pursuant to Section 15061(b)(3) of the CEQA Guidelines.
SECTION 2. The City Council of the City of Redlands, having elected to proceed under
the provisions of Division 9, Part 3, Chapter 4 of the Streets and Highways Code of the State of
California, hereby orders the summary vacation of approximately 354 linear feet of alley right-
of-way, as more specifically described in Exhibit "A" and Exhibit `B" attached hereto and made
a part hereof, based upon the following determinations:
A. For a period of five consecutive years or more, the subject segment of public alley
has been impassible for vehicular traffic.
B. No public money has been expended for maintenance of the subject segment of
public alley during the period it has been impassible.
C. In accordance with Streets and Highways Code Section 892, the subject segment
of public alley is not useful as a non -motorized transportation facility; and
D. The subject segment of public alley is excess and unnecessary right-of-way for
street or highway purposes.
SECTION 3. This resolution shall take effect immediately following the recordation of
this Resolution by the San Bernardino County Recorder.
SECTION 4. That from and after the date of this Resolution is recorded, the subject
segment of public alley as referenced herein is vacated and no longer constitutes a public right-
of-way ingress and egress easement.
