RESOLUTION NO. 8454 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING ITS INTENTION TO VACATE EXCESS RIGHT-OF-WAY OF A PORTION OF EDGEMONT DRIVE WHEREAS, Aysar Helo, has submitted an application for Street Vacation No. 189 requesting vacation of an approximately 927-foot long segment of excess public right-of-way, thirty (30) feet in width, along the north side of Edgemont Drive adjacent to the properties located at 226 and 212 Edgemont Drive (APNs: 0294-141-33-0000 and 0294-141-12-0000); and WHEREAS, the City is authorized to vacate all or part of a public street or public service easement within the City pursuant to Public Street, Highway and Service Vacation Easements Law (California Streets and Highway Code, Section 8300 et.seq.); and WHEREAS, pursuant to Section 8340 of the California Streets and Highways Code, the City may for public convenience and necessity reserve and except public service easements from a street vacation; and WHEREAS, the street vacation qualifies for exemption from environmental review in accordance with Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines. Section 15061(b)(3) is the "general rule" exemption where it can be seen with certainty that the activity in question will not have any significant effects on the environment; and WHEREAS, the City Council intends to vacate the excess right-of-way as more particularly described in Attachment "A" to this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: SECTION 1. The City Council hereby declares its intention to vacate that portion of Edgemont Drive as further described in Attachment A (Legal Description and Plat), attached hereto. SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT. The proposed street vacation qualifies for exemption from environmental review in accordance with Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines. Section 15061(b)(3) is the "general rule" exemption where it can be seen with certainty that the activity in question will not have any significant effects on the environment. SECTION 3. The City Council will conduct a public hearing on the subject of the proposed vacation at a regularly scheduled public meeting of the City Council on May 2, 2023, beginning at 6:00 p.m. or as soon thereafter as the matter may be heard, to be held in the City Council Chamber located at 35 Cajon Street, Suite 2, Redlands, California 92373. SECTION 4. The City Clerk shall give notice of the public hearing on the public hearing on the proposed vacation by: a. Publishing notice in the Redlands Daily Facts, for two successive weeks prior to the hearing; and 1 I:\Resolutions\Res 8400-8499\8454 Street Vacation 189.docx b. Posting notices of the proposed vacation conspicuously along the lines of the portion of right-of-way to be vacated at least two weeks prior to the date set for the public hearing. The notices shall be posted no more than 300 feet apart, and at least three such notices shall be posted. The notices shall reference the adoption of this Resolution of Intention and shall state the date, time, and place of the vacation hearing. ADOPTED, SIGNED, AND APPROVED this 4th day of April, 2023.
