AMEMORANDUM OF AGREEMENT FOR EXPENDITURE OF
GAS TAX ALLOCATION FOR MAJOR CITY STREETS.

WHEREAS, a Aemorandum of agreement has been presented
to be entered into with the State of California In accord-
ance with a project statement submitted by the City of

A!L4 Unda for expenditure of the gas tax al-
location to cities for the r1scal year 1 9, and
WHEREAS, the city council has heard read said agree-
ment In full and is familiar with the contents
THEREFORE, be it resolved by the city council of the
City of ft--0,4 Ila r.d A that said projecz statement
be and it is hereby adopted as the budget of proposed ex-
penditures of the gas tax allocation to cities, and said
agreement be and the same is hereby approved and the mayor
and the city clerk are directed to sign the same on behalf
of said City, said agreement to be binding upon the City
upon Its execution by the authorized offlcia�zofthe State.

FIRST SWAUPPLEXINTAL MEMORANDUM OF AGREEMZNT entered
Into by and between the City of Redlands, hereinafter re-
ferred to to the city, and the Depertmqnt of Public Works
of the State of California, hereinafter referred to as the,
department,
WITWESSETH, THAT, WHERL",, & memorandum of ar;reezent
for expenditure of funds accruing 4vring the 'flecal year
ending June 30s 1949#. and allocated under thi!! provisione
of Section 194 and Seotion 2107 of the Streets and High-
ways Coda upon major alts streets* was ereouted by the
city September 2, 1480 and by the department September
15* 1948, providing for the -work desoribed herein aa pro-
Jects 23 to 2?, Inclusive; and
WiEREASO the alty now desires that said agreement be
amended &rd has submitted to the dep&rtinent a aupplental
budget to extend the limits of Proot 27;

The work desoribed, in projects 24, 25* 26 and 27 shall
be performed by oaiet unless the performance thereof by
day labor shall be approved by the d_epartnt.
The work shall be done to the satisfaction of the do-
pvrtment and shall be wubjeet at ell times to Inspection
and approval by the authorized repreaentattves of the de-
partment 1.
Any alty-owned equipment used for the work described
In projects 24l 25v 29 and 27 may be charged for upon s
rental basia to cover depreal .tion and reps-irs In case ren-
tal rates already have been established bi theolty*lo.ther-
wise, allowance for deproolation reppArn may beehr',rged
for as approved by the department.
ARTICLE IV. FUNDS
Punds to defray the cost of the work desoribed in
Article I and paigble from revenue accruing under the
provIelons. of tectlon 210? of the Streets and High-ways

The amount of $52,90C,,00 Is budgeted to defroy the
an-st of the work described In ArtAcle T# &nd in add :tion
the amount of $2,4400.00 Is to be contrihited- from the
1/4 tient for St&te highways.
The annual revenue and the amnts provided for the
projects listed in Artioli! I are estimated amounts. In
the event that the aotualt revenue or the gotugi cost of
the projects differs from estimated amountso the approved
budget m&y be amended only by ourrlemental ogreerent.

Should the coet of Plgnalp under rojeat 24 be, 1,ess
than the a-m-unts set forth hrpin, then the actual coat
@hall be prorated on the basis of 25% from the Fas tax al-

for State highways.
The department hereby delegates to the oity the ex-
Pendit"ure of the funds provided herein to defray the cost
of the work described In Article 11%
Quarterly, In the months of August, November, "Feb-
ruary and May, the department will pay to the city its
pro rat& share of the money Alloeated under the provi-
sions of erection 2107 Of the Streeter and Highways Gode
until $-49o763.96 budgeted, herein and delegated to the
city for expenditure hLo been paid, in Wit on to the
anount of $3*136.04 previcnigly ptid to the atty and re-
maining unexpended In the city 's speetal gas tax street
Improvement fund,
The &rnounts provided for the projeets listed In Ar-
tiolm I must not be exoeededj, *,nd no moneys may be expent -
ded- by the elty fro ir the qiDpoial free tvx street imp7,ove-
ment fund except for the prjects listed In Artlele I
without amending the bLidget by supplement*1 &grm;,nt.
Such supplemental agreement ehall be valid only when exp-
outed by the city P-nd the department.
All funds alloeated under the provisions of Seotion
2107 of the 3treets and Highways We In excess of -much
funds budgeted herein for expenditure, will accumulete
for future budgeting, and, expenditure.

Within sixty days atter thF close of the fiscal. year
ending June 30, 19149., the city shall sinsItto the depart-
ment a statement of expenditures made Itrom the special gas
tax street Improvement fund during the preceding year for
the maintenance of the streets deseribed in project 23.
Maintenance expenditures shall be analyzed by func-
tions and objects as follows :
Functions
(1) Travelled way, including roadside and improved
shoulders.
(2) Structures.
(3) Safety devices, Inoluding stop migna,, automatic
signals, traffic stripes and parking stripes.
(4) Street cleaning, including the removal of snow
or sand drift.

(3) Service and expense.
(4) Equipment rental.
Within sixty days after **apletion of each item of
the budget described In projects 24, 25. 26 and 47a the
city will submit to the de-partment & final report of ex-
penditures made for such work.
The report for construction, Improvement or other
specific projects shall show payments to the contractor
detailed by contract items showing quantity, unit,, Item,
unit price and amount; and the amount paid for any mater-
ials, supplies, labor or equipment furnished by the city
for use on the contract. Expenditures for work performed
by day labor shall be detailed to show the quantity for
each item of work, the unit cost and amount,

ARTICLE V1, MISCELLANEOUS PROVISIONS
No Mate officer or employee shall be liable for any-
thing done or omitted to be done by the city in the perform-
ance of any work delegated to the city under this agreement.
The city shall, in the event any claim is made against any
State officer or employee by reason of such work, indemnify
and hold harmless such officer or employee from any damage
or liability by reason of any such claim.
IN WITNESS WHEREOF, the parties hereunto have affixe
their siEFiatures and official seals, the city on the
