HomeMy WebLinkAbout6975_CCv0001.pdf RESOLUTION NO. 6975 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, CALIFORNIA, ORDERING THE SUBMISSION TO THE QUALIFIED ELECTORS OF THE CITY OF A CERTAIN MEASURE RELATING TO THE OFFICE OF CITY TREASURER AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 2, 2010, AS CALLED BY RESOLUTION NO. 6953 WHEREAS, a General Municipal Election on Tuesday, November 2, 2010 has been called by Resolution No. 6953, adopted on July 6, 2010, and WHEREAS, the City Council of the City of Redlands, California, desires to submit to the voters of the city at a General Municipal Election a measure relating to the office of the City Treasurer; and WHEREAS, the City Council is authorized and directed by statute to submit the proposed measure to the voters; NOW, THEREFORE, the City Council of the City of Redlands, California, does hereby resolve, declare, determine and order as follows: SEC'T'ION 1. That the City Council, pursuant to its right and authority, does order submitted to the voters at the General Municipal EIection the following question: Yes Shall the office of the Redlands City Treasurer be appointive? No SECTION 2. That the proposed measure submitted to the voters is as follows: The position of the Redlands City Treasurer shall be changed from an elected office to an appointed office. SECTION 3. That the last day for receipt of primary arguments for or against the measure not exceeding 300 words has been established at 5:00 P.M. on August 17, 2010, in the City Clerk's Office, Civic Center, 35 Cajon Street, Suite 4, Redlands, California, and signed by each proponent and by each author, if different, of the argument in conformance with provisions of Section 9600 of the California Elections Code. Arguments may be changed or withdrawn by their proponents at any time prior to and including the final date fixed for filing arguments. 1 SECTION 4. That pursuant to Sections 9220 and 9285 of the Elections Code of the State of California, when the City Clerk has selected the arguments for and against the measure which will be printed and distributed to the voters, the City Clerk shall send copies of the argument in favor of the measure to the authors of the argument against, and copies of the argument against to the authors of the argument in favor_ The authors may prepare and submit rebuttal arguments not exceeding 250 words. Rebuttal arguments shall be printed in the same manner as the direct arguments. Each rebuttal argument shall immediately follow the direct argument which it seeks to rebut. SECTION 5. That the last day for receipt of rebuttal arguments not exceeding 250 words has been established as 5:00 P.M. on August 30, 2010, in the City Clerk's Office, Civic Center, 35 Cajon Street, Suite 4, Redlands, California, and signed by each proponent and by each author, if different, of the rebuttal argument in conformance with the provisions of Section 9600 of the California Elections Code. Rebuttals may be changed or withdrawn by their proponents at any time prior to and including the final date fixed for filing rebuttals. SECTION 6. That the City Council directs the City Clerk to transmit a copy of the measure to the City Attorney. The City Attorney shall prepare an unpartial analysis of the measure showing the effect of the measure on the existing law and the operation of the measure. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. SECTION 7. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 8. That notice of the time and place of holding the election is given and the City Clerk is authorized, instructed and directed to give further and additional notice of the election, in time, form and manner as required by law. SECTION 9. That. the City Clerk of the City of Redlands is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the Registrar of Voters of the County of San Bernardino. SECTION 10. The adoption of this resolution is exempt from the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) ("CEQA") pursuant to the States's CEQA Guidelines sub-section 15060(c)(2) because the adoption of this resolution will not result in a direct of reasonably foreseeable, indirecto physical change in the environmental, and therefore,review under CEQA is not required. 2 ADOPTED, SIGNED AND APPROVED this 3rd day of August, 2010 Mayor of the City of Redlands ATTEST: City Clerk I, Sam Irwin, City Clerk of the City of Redlands, hereby certify that the foregoing Resolution No. 6975 was duly adopted by the City Council at a regular meeting thereof held on the 3rd day of August, 2010, by the following vote: AYES: Councilmembers Harrison,Gallagher,Aguilar•, Mayor Gilbreath NOES: None ABSENT: Councilmember Bean ABSTAIN: None Sam Irwin, City Clerk 3
