BOX 3005 REDLANDS CA 92373 FEES NOT REQUIRED PER GOVERNMENT CODE SECTION 6103 04/19/2023 10:01 AM SAN 14311 Electronically Recorded in Official Records San Bernardino County Assessor -Recorder -County Clerk DOC# 2023-0092733 Titles: 1 Pages: 9 Fees Taxes CA SB2 Fee Total $0.00 $0.00 $0.00 $0.00 (THIS SPACE FOR RECORDER'S USE ONLY) RESOLUTION NO. 8462 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT A 1,317.5-FOOT LINEAR PORTION (VARYING WIDTHS) OF STREET RIGHT OF WAY ALONG RESERVOIR ROAD AT THE NORTHWEST CORNER OF RESERVOIR ROAD AND WABASH AVENUE (APN: 0174-281-13-0000) IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF A PORTION OF SAID EXCESS RIGHT-OF-WAY (CITY OF REDLANDS STREET VACATION NO. 191) WHEREAS, Terracina Recovery, LLC ("Applicant"), has filed an application for Street Vacation No. 191 proposing to vacate excess street right-of-way along Reservoir Road that is approximately 1,317 feet in length with varying widths along the frontage of the subject property (APN: 0174-281-13-0000) at the northwest corner of Reservoir Road and Wabash Avenue, as more specifically described in Exhibit "A" (Legal Description) and Exhibit "B" (Plat) attached hereto (the "Street Vacation"); and WHEREAS, the City is authorized to vacate all or part of a public street easement within the City pursuant to Streets and Highway Code section 8300 et seq.; and WHEREAS, pursuant to Streets and Highway Code section 8340, the City may, for public convenience and necessity, reserve and except public service easements from the Street Vacation; and WHEREAS, at its meeting on January 24, 2023, the Planning Commission made a determination that the Street Vacation conforms to the City's General Plan, as required by Government Code Section 65402; and WHEREAS, on March 21, 2023, the City Council of the City of Redlands adopted Resolution No. 8403 declaring its intention to vacate such portion of Reservoir Road, and set a public hearing date and time for the proposed Street Vacation; and WHEREAS, the proposed Street Vacation is exempt from environmental review under the California Environmental Quality Act (CEQA), pursuant to section 15061(b)(3) of the CEQA Guidelines for projects where there is no possibility of any significant environmental effects; and 1 1_:\Resolutions\Res 8400-8499\8462 Street Vacation 191.docx DOC #2023-0092733 Page 2 of 9 WHEREAS, pursuant to Streets and Highways Code section 8320, the Redlands City Clerk published notice in the Redlands Daily Facts, for two successive weeks prior to the hearing, and caused the posting of notices along the proposed Street Vacation two weeks prior to the date set for the public hearing, no more than 300 feet apart, with at least three notices posted; and WHEREAS, on April 18, 2023, the City Council held a duly noticed public hearing on the Street Vacation and considered all verbal and written testimony provided by City staff and all interested persons. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. the proposed Street Vacation is exempt from environmental review under the California Environmental Quality Act ("CEQA"), pursuant to section 15061(b)(3) of the CEQA Guidelines for projects where there is no possibility of any significant environmental effects. Section 2. The City Council having elected to proceed under the provisions of Streets and Highways Code Section 8300 et seq., and having held a public hearing as provided therein, finds from all evidence submitted that the Street Vacation is unnecessary for present or prospective public use, and that the public interest and convenience require the Street Vacation. Section 3. Pursuant to Streets and Highways Code Section 8340, the City reserves and excepts from the Street Vacation a permanent easement for in -place and future public utility facilities. Section 4. Pursuant to Streets and Highways Code section 892, the portion of Reservoir Road (Street Vacation No. 191) to be vacated is not useful as a non -motorized transportation facility. Section 5. Pursuant to Streets and Highways Code section 8325, the City Clerk is hereby directed to cause a certified copy of this resolution to be recorded in the official records of the county of San Bernardino.
