HomeMy WebLinkAbout7096_CCv0001.pdf RESOLUTION NO. 7096 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DENYING AN APPLICATION FOR PROPOSED GENERAL PLAN AMENDMENT NO. 127 WHEREAS, BNY, INC. has submitted an application to amend the General Plan land use designation from Low Density Residential(0 to 6 dwelling units per gross acre)to Medium Density Residential (0 to 15 dwelling units per gross acre) for approximately 3.14 acres of real property located on the east side of Occidental Drive,approximately 657 feet north of Brockton Avenue and designated as Assessor's Parcel Nos. 0168-201-26,27,28,29,30,31,32,33,34,35,36,37,and 38 ("General Plan Amendment No. 127"); and WHEREAS,the Planning Commission of the City of Redlands has reviewed the application for General Plan Amendment No. 127 and made a written recommendation for denial of that General Plan amendment to the City Council after holding a noticed public hearing on the same; and WHEREAS,notice of this City Council's public hearing for General Plan Amendment No. 127 was duly published in the Redlands Daily Facts by the Redlands City Clerk; and WHEREAS,on December 20'h,2011 the City Council held a public hearing and considered the staff written and oral reports, the recommendation of the Planning Commission,the testimony and written evidence submitted by and on behalf of the applicant and by members of the public;and WHEREAS,the public hearing on General Plan No. 127 was continued to March 20,2012, then to April 3,2012,and subsequently to April 17,2012 for additional testimony from the applicant for General Plan Amendment No. 127 and the public; and WHEREAS,following the public hearing on General Plan Amendment No. 127,on May 1, 2012, the City Council determined that denial of the requested General Plan amendment is in the best interests of the public health, safety and general welfare; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. General Plan Amendment No. 127 is hereby denied based upon the City Council's determination that the proposed General Plan amendment would adversely affect surrounding properties because the permitted density of the Medium Density Residential land use designation is not consistent with the single-family detached residential uses on such properties,and because the subject project is located on a local street which is not suitable for the density of development permitted by the Medium Density Residential General Plan land use designation.
