HomeMy WebLinkAbout5623_CCv0001.pdf RESOLUTION NO. 5623 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ADOPTING AN AMENDED CONFLICT OF INTEREST CODE PURSUANT TO THE POLITICAL REFORM ACT OF 1974 AND AMENDING RESOLUTION NOS. 3290 AND 5553 WHEREAS, the Legislature of the State of California has enacted the Political Reforni Act of 1974, Government Code Section 81000 et. sea. (The "Act"), which contains provisions relating to conflicts of interest which potentially affect all officers, employees, and consultant of the City of Redlands (the "City"), and requires all public agencies to adopt and promulgate a Conflict of Interest Code; and WHEREAS, the City adopted a Conflict of Interest Code on October 5, 1976 by Resolution No. 3290 in compliance with Government Code Section 81000 et sea.; WHEREAS, as a result of a change of certain employee positions, it is advisable and necessary to periodically amend and update Exhibit A, the listing of designated employees, to the City's Conflict of Interest Code; and WHEREAS, the potential penalties for violation of the provisions of the Act are substantial and may include criminal and civil liability, as well as equitable relief which could result in the City being restrained or prevented from acting in cases where the provisions of the Act may have been violated; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands that the City Council does hereby amend its Conflict of Interest Code by amending Resolution No. 5553, as follows: SECTION ONE: That Exhibit "A" of the Appendix of the Conflict of Interest Code of the City of Redlands shall be amended to read as follows: "EXHIBIT 'A' DESIGNATED POSITIONS The Mayor, Members of the City Council and Planning Commission, the City Manager, City Attorney, City Treasurer, and other City officials who manage public investments are included in and governed by the Conflict of Interest Code only with respect to its disqualification provisions. For purpose of disclosure, the Mayor, Members of the City Council and Planning Commission, the City Manager, City Attorney, City Treasurer, and the City officials who make public investments are governed by the statutory conflicts of interest provisions of Article 2 of Chapter 7 of the Political Reform Act of 1974 (Government Code Section 87200 et seq.). Such written determination shall include a description of the consultant's duties and, based upon that description, a statement of the extent of disclosure requirements. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as this Conflict of Interest Code." SECTION TWO: A copy of this amendment to the Conflict of Interest Code shall be on file with the City Clerk and available for inspection by the public. i ADOPTED, SIGNED AND APPROVED this 16th day of March, 1999.
