A RESOLUTION OF THE CITY OF REDLANDS APPROVING THE JOINT
APPLICATION OF GRANT FUNDS UNDER THE RESOURCES AGENCY - CALIFORNIA
TRANSPORTATION COMMISSION ENVIRONMENTAL ENHANCEMENT AND MITIGATION
PROGRAM (AB 471)
WHEREAS, the Legislature of the State of California has
enacted the Environmental Enhancement and Mitigation Program, which
provides funds to certain political subdivisions of the State of
California to mitigate the environmental impact of modified or new
public transportation facilities.
WHEREAS, the State of California Resource Agency has been
delegated the responsibility of the administration of the program,
getting up necessary procedures governing application by local
agencies under the program and recommendation for funding to
California Transportation Commission; and
WHEREAS, said procedures established by the State of
California Resource Agency require the applicant to certify by
resolution the approval of applications prior to submission of said
applications of the State; and
WHEREAS, said applications contain certification that the
applicant will comply with all local, state, and federal
environmental, public health and affirmative action requirements
and all other appropriate codes, laws and regulations prior to the
expenditure of the grant funds; and
WHEREAS, the project(s) applied for under this program
demonstrate direct or indirect relationship with the environmental
impact of modifying an existing or new transportation facility and
provide mitigation or enhancement to transportation project with
emphasis on the compatibility of the safety and operation of the
transportation facilities and mitigation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
Redlands hereby:
1) Approves the joint application with the City of Highland
for funding under the Environmental Enhancement and
Mitigation Program (AB 471) ; and
2) Certifies that said agency understands the general
provision of the agreement; and
3) Certifies that agency has or will have sufficient funds
to operate and maintain projects (s) funded under this
program; and
4) Certifies that said agency has or will have available,
prior to commencement of any work on projects) included
in this application, the required match; and
5) Certifies that the project(s) included in the highway
landscaping element of any applicable city or county
general plan; and
6) Appoints the City Manager as agent of the City of
Redlands to conduct all negotiations and execute and
submit all documents including, but not limited to,
applications, agreements, amendments, payment requests
and so on that may be necessary for the completion of the
aforementioned project(s) ; and
7) Appoints Best, Best & Krieger as legal counsel for said
agency with authorization to sign the certification on
Page 1 of the application.
