HomeMy WebLinkAbout7027_CCv0001.pdf RESOLUTION NO. 7027 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING THE APPLICATION FOR THE GRANT FUNDS FROM THE FLOOD CORRIDOR PROGRAM UNDER THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (Proposition 84) AND THE DISASTER PREPAREDNESS AND FLOOD PREVENTION BOND OF 2006 (Proposition I E) WHEREAS, the Legislature and Governor of the State of California have provided funds for the program identified above; and WHEREAS, the Department of Water Resources has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, the procedures established by the Department of Water Resources require a resolution certifying the approval of application by the applicant's governing board before submission of the application to the State; and WHEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the project; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The City Council approves of the filing of an application for the City of Redlands' Flood Control and Aquifer Recharge Program. Section 2. The City Council certifies that the City, as an applicant, understands the assurances and certification in the application. Section 3. The City Council certifies that the City, as an applicant, or title holder, will have sufficient funds to operate and maintain the project consistent with the land tenure requirement; or will secure resources to do so. Section 4. The City Council certifies that it will comply with all provisions of Section 1771.5 of the California Labor Code. Section 5. If applicable, the City Council certifies that the project will comply with any laws and regulations including, but not limited to, the California Environmental Quality Act, legal requirements for building codes, health and safety codes, and disabled access laws, and, that prior to commencement of construction all applicable permits will have been obtained. Section 6. The City Council hereby appoints the Redlands City Manager, or his designee, as the City's agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project. 1;\cc1crk\Rm1utions\Res 7440-799917427 Grant App Flood Corridor.doc 1 ADOPTED, SIGNED AND APPROVED this 15th day of February, 2011.
