RIGHT OF WAY CONTRACT -- CITY OF RNDLANDS, CALIFORNIA Document No. I in the form of a GRAINT DEED covering the following described property: The West 90' of the northwest 1/4 of the northwest 1/4 of Section 4, Township 2 South, Range 3 West, San Bernardino Base and Meridian, lying southerly of the centerline of San Timoteo Creek and northerly of the Southern Pacific Railroad Right of Way, has been executed and delivered to DONALD D. M©RRISON, Land Agent for the City of Redlands, California. In consideration of which, and the other considerations hereinafter set forth, it is mutually agreed as follows: 1. The parties have herein set forth the whole of their agreement. The performance of this agreement constitutes the entire consideration for said docu- ment and shall relieve the City of all further obligation or claims on this account, or on account of the location, grade or construction of the proposed public impro- vement. It is understood by the parties hereto that the proposed improvement will not adversely affect access to the remainder of Grantor's remaining property. 2. The City of Redlands shall: A. Pay the undersigned grantor(s) the sum of $1100.00 for the property or interest therein as conveyed by Document No. I within thirty (30) days after date title to said property vests in, or is in escrow for, the City of Redlands, free and clear of all liens, encumbrances, assessments, easements and leases (recorded and/or unrecorded), except: 1. Delinquent taxes and taxes for the fiscal year in which this escrow closes shall be pleared and paid in the manner required by Section 4986 of the Revenue and Taxa- tion Code. 2 Covenants, conditions, restrictions and reservations of record, if any. 3. Easements or rights of way over said land for utility or street purposes, if any. B. Waive the right to damages, if any, to the property that may have come into existence by reason of use or trespassing prior to transfer of title in this transaction and agree that the -under-.. signed grantor shall retain the right to collect same,.
