HomeMy WebLinkAboutAgree-UltraSystemsAGREEMENT FOR THE PROVISION OF PROFESSIONAL ENVIRONMENTAL CONSULTING SERVICES FOR A PRIVATE PROJECT This agreement for the provision of professional environmental consulting services ("Agreement") is made and entered into this 7th day of August, 2023 ( "Effective Date"), by and between the City of Redlands, a municipal corporation ("City") and UltraSystems Environmental, Inc., a California corporation ("Consultant"), who are sometimes individually referred to herein as a "Party" and, together, as the "Parties." In consideration of the mutual promises contained herein, City and Consultant agree as follows: ARTICLE 1 — ENGAGEMENT OF CONSULTANT 1.1 City hereby engages Consultant to provide professional environmental consulting services for City (the "Services"). 1.2 The Services shall be performed by Consultant in a professional manner, and Consultant represents that it has the skill and the professional expertise necessary to provide the Services to City at a level of competency presently maintained by other practicing professional consultants in the industry providing like and similar types of Services. ARTICLE 2 — SERVICES OF CONSULTANT 2.1 The Services that Consultant shall perform are more particularly described in Exhibit "A," titled "Scope of Services, Project Costs and Hourly Rates," including a project schedule, which is attached hereto and incorporated herein by reference. 2.2 Consultant shall comply with applicable federal, state and local laws and regulations in the performance of this Agreement including, but not limited to, State prevailing wage laws. ARTICLE 3 — RESPONSIBILITIES OF CITY 3.1 City shall make available to Consultant information in its possession that may assist Consultant in performing the Services. 3.2 City designates Brian Desatnik, City's Development Services Director, and his designees, as City's representatives with respect to performance of the Services, and such person shall have the authority to transmit instructions, receive infoiliiation, interpret and define City's policies and decisions with respect to performance of the Services. ARTICLE 4 — PERFORMANCE OF SERVICES 4.1 Consultant shall perform and complete the Services in accordance with the project schedule. The Services shall commence on the Effective Date of this Agreement and be completed on or before June 30, 2024. 1 I:\cmo\Agreements\Environment Agmt.EA-7.2_Kaiser Project EIR_CRA 954 FY22-0163.doc-jm 4.2 If Consultant's Services include deliverable electronic visual presentation materials, such materials shall be delivered in a form, and made available to the City, consistent with City Council adopted policy for the same. It shall be the obligation of Consultant to obtain a copy of such policy from City staff. ARTICLE 5 — PAYMENTS TO CONSULTANT 5.1 The total compensation for Consultant's performance of the Services shall not exceed the amount one hundred ninety-five thousand eight hundred and eighty dollars ($195,880.00). City shall pay Consultant on a time and materials basis, up to the not to exceed amount, in accordance with Exhibit "A," titled "Scope of Services, Project Costs and Hourly Rates," which is attached hereto and incorporated herein by this reference. 5.2 Consultant shall submit an invoice to City describing the Services performed, the dates the Services were performed, and the number of hours spent and by whom, upon completion of the Services. City shall pay Consultant no later than thirty (30) days after receipt and approval by City of Consultant's invoice. 5.3 Any notice or other communication required, or which may be given, pursuant to this Agreement, shall be in writing. Any such notice shall be deemed delivered (i) on the date of delivery in person; (ii) five (5) days after deposit in first class certified, registered or express mail, with return receipt requested; (iii) on the actual delivery date if deposited with an overnight courier; or (iv) on the date sent by facsimile or electronic mail transmission (including PDF), if confirmed with a copy sent contemporaneously by first class, certified, registered or express mail; in each case properly posted and fully prepaid to the appropriate address set forth below, or such other address as a Party may provide notice in accordance with this section: City: Brian Desatnik, Director Development Service Department 35 Cajon Street, Ste. 20 P.O. Consultant shall not perform any Services unless and until the required insurance listed below is obtained by Consultant. Consultant shall provide City with certificates of insurance and endorsements evidencing such insurance prior to commencement of the Services. Insurance policies shall include a provision prohibiting cancellation or modification of the policy except upon thirty (30) days prior written notice to City. 2 I:\cmo\Agreements\Environment Agmt.EA-7.2_Kaiser Project EIR_CRA 954 FY22-0163.doc-jm A. Workers' Compensation and Employer's Liability insurance in the amount that meets statutory requirements with an insurance carrier acceptable to City, or certification to City that Consultant is self -insured or exempt from the workers' compensation laws of the State of California. Consultant shall execute and provide City with Exhibit "B" titled "Workers' Compensation Insurance Certification," which is attached hereto and incorporated herein by this reference prior to performance of the Services. B. Comprehensive General Liability insurance with carriers acceptable to City in the minimum amount of One Million Dollars ($1,000,000) per occurrence and Two Million Dollars ($2,000,000) aggregate, for public liability, property damage and personal injury is required. City shall be named as an additional insured and such insurance shall be primary and non-contributing to any insurance or self-insurance maintained by City. C. Business Auto Liability coverage, with minimum limits of One Million Dollars ($1,000,000) per occurrence, combined single limit bodily injury liability and property damage liability. This coverage shall include all Consultant owned vehicles used in connection with Consultant's provision of the Services, hired and non -owned vehicles, and employee non -ownership vehicles. City shall be named as an additional insured and such insurance shall be primary and non-contributing to any insurance or self-insurance maintained by City. D. Professional Liability (Errors and Omissions) Insurance appropriates to the Consultant's profession, with limit no less than $2,000,000 per occurrence or claim, $2,000,000 aggregate. If the Consultant maintains broader coverage and/or higher limits than the minimums shown above, the Entity requires and shall be entitled to the broader coverage and/or the higher limits maintained by the contractor. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the Entity. E. Consultant is expressly prohibited from assigning or subcontracting any of the Services without the prior written consent of City. In the event of mutual agreement by the Parties to assign or subcontract a portion of the Services, Consultant shall add such assignee or subcontractor as an additional insure d to the insurance policies required hereby and provide City with the insurance endorsements prior to any Services being performed by the assignee or subcontractor. 6.2 Consultant shall defend, indemnify and hold harmless City and its elected officials, employees and agents from and against any and all claims, losses or liability, including attorneys' fees, arising from injury or death to persons or damage to property occasioned by any negligent act or omission by, or the willful misconduct of, Consultant, or its officers, employees and agents in performing the Services. 3 I:\cmo\Agreements\Environment Agmt.EA-7.2_Kaiser Project EIR_CRA 954 FY22-0163.doc-jm ARTICLE 7 — CONFLICTS OF INTEREST 7.1 Consultant covenants and represents that it does not have any investment or interest in any real property that may be the subject of this Agreement or any other source of income, interest in real property or investment that would be affected in any manner or degree by the performance of Consultant's Services. Consultant further covenants and represents that in the performance of its duties hereunder, no person having any such interest shall perform any Services under this Agreement. 7.2 Consultant agrees it is not a designated employee within the meaning of the Political Reform Act because Consultant: A. Does not make a governmental decision whether to: (i) approve a rate, rule or regulation, or adopt or enforce a City law; (ii) issue, deny, suspend or revoke any City permit, license, application, certification, approval, order or similar authorization or entitlement; (iii) authorize City to enter into, modify or renew a contract; (iv) grant City approval to a contract that requires City approval and to which City is a party, or to the specifications for such a contract; (v) grant City approval to a plan, design, report, study or similar item; (vi) adopt, or grant City approval of, policies, standards or guidelines for City or for any subdivision thereof. B. Does not serve in a staff capacity with City and in that capacity, participate in making a governmental decision or otherwise perform the same or substantially the same duties for City that would otherwise be performed by an individual holding a position specified in City's Conflict of Interest Code under Government Code section 87302. 7.3 In the event City determines that Consultant must disclose its financial interests, Consultant shall complete and file a Fair Political Practices Commission Form 700, Statement of Economic Interests, with the City Clerk's office pursuant to the written instructions provided by the City Clerk. ARTICLE 8 — GENERAL CONSIDERATIONS 8.1 In the event any action is commenced to enforce or interpret any of the terms or conditions of this Agreement the prevailing Party shall, in addition to any costs and other relief, be entitled to the recovery of its reasonable attorneys' fees, including fees for the use of in-house counsel by a Party. 8.2 Consultant shall not assign any of the Services, except with the prior written approval of City and in strict compliance with the terms and conditions of this Agreement. Any 4 I:\cmo\Agreements\Environment Agmt.EA-7.2 Kaiser Project EIR_CRA 954 FY22-0163.doc-jm assignment or attempted assignment without such prior written consent may, in the sole discretion of City, results in City's immediate termination of this Agreement. 8.3 Consultant is for all purposes under this Agreement an independent contractor and shall perform the Services as an independent contractor. Neither City nor its agents shall have control over the conduct of Consultant or Consultant's employees, except as herein set forth. Consultant shall supply all necessary tools and instrumentalities required to perform the Services. Assigned personnel employed by Consultant are for its account only, and in no event shall Consultant or personnel retained by it be deemed to have been employed by City or engaged by City for the account of, or on behalf of City. Consultant shall have no authority, express or implied, to act on behalf of City in any capacity whatsoever as an agent, nor shall Consultant have any authority, express or implied, to bind City to any obligation. 8.4 This Agreement may be teuiiinated by City, in its sole discretion, by providing not less than five (5) days prior written notice to Consultant of City's intent to terminate. If this Agreement is terminated by City, an adjustment to Consultant's compensation shall be made, but (1) no amount shall be allowed for anticipated profit or unperformed Services, and (2) any payment due Consultant at the time of termination may be adjusted to the extent of any additional costs to City occasioned by any default by Consultant. Upon receipt of a termination notice, Consultant shall immediately discontinue its provision of the Services and, within five (5) days of the date of the termination notice, deliver or otherwise make available to City, copies (in both hard copy and electronic form, where applicable) of project related data, design calculations, drawings, specifications, reports, estimates, summaries and such other information and materials as may have been accumulated by Consultant in performing the Services. Consultant shall be compensated on a pro-rata basis for Services completed up to the date of termination. 8.5 Consultant shall maintain books, ledgers, invoices, accounts and other records and documents evidencing costs and expenses related to the Services for a period of three (3) years, or for any longer period required by law, from the date of final payment to Consultant pursuant to this Agreement. Such books shall be available at reasonable times for examination by City at the office of Consultant. 8.6 This Agreement, including the Exhibits incorporated herein by reference, represents the entire agreement and understanding between the Parties as to the matters contained herein, and any prior negotiations, written proposals or verbal agreements relating to such matters are superseded by this Agreement. Except as otherwise provided for herein, any amendment to this Agreement shall be in writing, approved by City and signed by City and Consultant. 8.7 This Agreement shall be governed by and construed in accordance with the laws of the State of California. 8.8 If one or more of the sentences, clauses, paragraphs or sections contained in this Agreement is declared invalid, void or unenforceable by a court of competent 5 I:\cmo\Agreements\Environ vent Agmt.EA-7.2_Kaiser Project EIR_CRA 954 PY22-0163.doc-jm jurisdiction, the same shall be deemed severable from the remainder of this Agreement and shall not affect, impair or invalidate the remaining sentences, clauses, paragraphs or sections contained herein, unless to do so would deprive a Party of a material benefit of its bargain under this Agreement. (b) By securing from the Director of Industrial Relations, a certificate of consent to self -insure, either as an individual employer, or as one employer in a group of employers, which may be given upon furnishing proof satisfactory to the Director of Industrial Relations of ability to self -insure and to pay any compensation that may become due to his or her employees. CHECK ONE I am aware of the provisions of Section 3700 of the Labor Code which requires every employer to be insured against liability for Workers' Compensation or to undertake self- insurance in accordance with the provisions of that Code, and I will comply with such provisions before commencing the performance of the work and activities required or permitted under this Agreement. (Labor Code §1861). I affirm that at all times, in performing the work and activities required or permitted under this Agreement, I shall not employ any person in any manner such that I become subject to the workers' compensation laws of California. However, at any time, if I employ any person such that I become subject to the workers' compensation laws of California, immediately I shall provide the City with a certificate of consent to self -insure, or a certification of workers' compensation insurance. Amendment No. 6 to Concept Plan 1: A request to amend the permitting procedure contained in Concept Plan No. 1, Section IV, Part A (Discretionary Actions), to include a new Master Planned Development permit procedure for new master planned multi -phase development proposals. The proposed amendment would include a two-step Master Planned Development permit process in addition to the existing procedure that includes Commission Review and Approval permits and subdivision maps (i.e., Step 1 consisting of a Master Plan or Planned Development entitlement for the entire project, and Step 2 consisting of subsequent Commission Review & Approval permits for individual buildings or phases under the approved Planned Development and adopted environmental document). 2. Planned Development No. 6: A proposal to expand the existing Kaiser Permanente Redlands Medical Offices site in multiple phases, consisting of four phases: • Phase 1: New 4-story 165,000 square foot Medical Office Building/Ambulatory Services Center and parking lots • Phase 2: A 7-story 400,000 square foot hospital, a 2-story 35,000 square foot Central Utility Plant building, parking structure and parking lots • Phase 3: A 4-story 83,000 square foot Medical Office Building, and • Phase 4: A possible 180,000 square foot addition to the future hospital. 3. Commission Review & Approval No. 954: A proposal to construct Phase 1 of the Planned Development described above, to include a 165,000 square foot Ambulatory Services Center/Medical Office Building, up to four stories high, parking lot improvements to serve the new building, and related site improvements for the new building including driveways, walkways, infrastructure, landscape, lighting, on -site improvements, and utility connections. As mentioned in the City's Request for Scope, the project applicant will be preparing the following studies: ➢ Air Quality/GHG analysis and Health Risk Assessment (to be prepared by ESA) ➢ VMT Analysis (to be prepared by Fehr & Peers) ➢ Visual Impacts Study (to be prepared by ESA) ➢ Traffic Impact Analysis (by Fehr & Peers) for evaluation of compliance with the Redlands General Plan and Measure "U" level of service standards ➢ Sight Line Study (to evaluate compliance with East Valley Corridor Specific Plan) 230226/City of Redlands Page 4 LI1traSvstems March 2023 ❖City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ Additionally, the project application will provide the following engineering studies: ➢ Preliminary Water Quality Management Plan (WQMP) ➢ Preliminary Drainage Study ➢ Grading Plan ➢ BMP Plan ➢ Utility Plan • Phase I Environmental Site Assessment - pending. ➢ SWPPP - pending (possibly can be a condition of approval) UltraSystems will utilize these studies for the preparation on the EIR. 2.2 Existing Conditions The project site is 36.5 acres, and is located at 1301 California Street, at the northwest corner of California Street and Lugonia Avenue. Approximately 9.6 acres in the southeast quadrant of the site is developed with a three-story medical building and surface parking; the balance of the site is vacant land, much of which appears to have been recently tilled in a satellite photograph dated August 2021. The project site is surrounded by industrial uses to the east, north, and west, and by a closed theme park to the south. The General Plan land use designation for the project site is Commercial/Industrial and the zoning designation is CP-1 (East Valley Corridor Specific Plan). 230226/City of Redlands UltraSystems Page 5 March 2023 ❖City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ 2.3 Technical Approach UltraSystems' approach to preparing the EIR will be straightforward. For each environmental topical factor, current baseline conditions and, where applicable, projected baseline conditions will be presented in sufficient detail to enable the reader to not only understand them, but how they may change because of the proposed project. The impact analyses provided in the EIR will use methods and comprise levels of detail commensurate with the specificity of available baseline conditions data. For each environmental factor, the type and extent of all applicable impacts will be presented and be focused by the questions under each environmental factor as set forth in Appendix G of the State CEQA Guidelines, as amended. Thereafter, all identified impacts will be ascribed a level of significance based on established quantitative and qualitative Thresholds of Significance. Mitigation measures will then be developed as warranted. Our approach to the mitigation measure discussions under each environmental factor is to first identify project features designed to minimize a particular impact, then identify statutory and regulatory requirements designed to minimize a particular significant impact, and lastly, present any mitigation measures required to reduce any identified potential significant impact. We understand that it is critical to maintain ongoing communications with City staff throughout the EIR preparation period. Most important among the reasons to do so is that in the event a problematic impact conclusion is identified, immediate notification to the City of the relevant circumstances would enable the City to inform the project applicant (Kaiser Permanente's Project Team) of the circumstances and, if necessary, affect a project change designed to address the problematic issue. Our Scope of Work is presented below by Major Task and subtasks. MAJOR TASK 1.0 - PROJECT INITIATION AND PROJECT DESCRIPTION Task 1.1: Attend Kickoff Meeting. One project kick-off meeting (via Zoom or Teams) between UltraSystems' Project Director, Betsy Lindsay, MURP, ENV SP; Project Manager, Hina Gupta, MURP, LEED AP, and Michael Milroy, MS, Deputy Project Manager, and City staff will be scheduled to finalize the work program, identify and collect materials in the possession of the City (i.e., all plans affecting the project site, applicant -supplied technical studies, etc.) and relevant to the performance of this work assignment, establish working relationships among all project participants, verify the schedule and any budgetary concerns, define communication protocols, and discuss any other related matters. During this meeting we will also discuss any known public distributions list(s) for the project. After this meeting we will provide a data needs list to the City of all required information that we need for EIR document development. Deliverable: Kick-off Meeting Minutes and prepare a data needs list of required information either from the City or project applicant. Task 1.2: Prepare Project Description. Within 10 business days of having received all project -related information, UltraSystems will prepare a Draft Project Description. The Draft Project Description will contain all the information required under § 15124 of the CEQA Guidelines 230226/City of Redlands Page 6 March 2023 UltraSvstems ❖City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ including: location; project objectives; and the technical and environmental characteristics of the project. In addition, the intended uses of the document will be described, including a list of discretionary actions requiring approval to implement the project; a list of agencies expected to use the CEQA document in their decision -making process; and a list of environmental consultation requirements. The Draft Project Description will be submitted to City staff for review and finalized after comments are received. The final Project Description will be used in the upcoming Draft EIR. UltraSystems will also provide an organization outline/structure for the EIR to the City for staff review and comment prior to UltraSystems starting work on EIR topical sections. It is very important for the City to review and sign -off on the organizational structure, before UltraSystems proceeds with the EIR. Deliverables: The draft project description will be submitted to the City for review and UltraSystems will finalize after comments are received back from City staff. UltraSystems will also provide the organizational structure for the EIR. MAJOR TASK 2.0 - PROJECT MANAGEMENT/COORDINATION/MEETINGS & HEARINGS Task 2.1: Project Management and Coordination. This task consists of routine project management and coordination activities throughout this project including communications with City staff, directing UltraSystems staff leading the technical study reviews, undertaking weekly cost and MS Project Schedule adherence assessments, and preparing correspondence to the City throughout the contract performance period. This task includes a bi-weekly progress teleconference meetings with City staff throughout the contract performance period. Task 2.2: Participation in Meetings and Public Hearings. This task comprises participation by our Project Manager/Deputy Project Manager at up to four high-level internal Zoom meetings with City staff over the course of the contract performance period. This would typically coincide with the City's review of a major deliverable. This task also includes the attendance of our Project Manager or Deputy Project Manager at two (2) Planning Commission public hearings and two (2) City Council public hearings. As required, UltraSystems will provide a PowerPoint for the scoping meeting and one PowerPoint for both the Planning Commission and City Council hearings. Attendance at a scoping meeting is also included and described in Task 3.6. Attendance at other meetings/hearings beyond the number indicated would be compensated for in accordance with the terms and conditions contained in our Standard Rate Schedule. Deliverables: Project schedule/timeline, bi-weekly meeting agendas, notes, action items summary, one Scoping Meeting, two Planning Commission/two City Council meetings. MAJOR TASK 3.0 - INITIAL STUDY AND NOTICE OF PREPARATION Task 3.1: Prepare Administrative Draft Initial Study. UltraSystems will prepare an Initial Study (IS) pursuant to the requirements of CEQA § 21080 and CEQA Guidelines §§ 15060 through 15065. The environmental issues to be discussed in the Initial Study are those identified in State CEQA 230226/City of Redlands UltraSystems Page 7 March 2023 ❖City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ Guidelines Appendix G, Environmental Checklist Form. All issues to be discussed in the Initial Study are presented in the matrix below. Environmental Aesthetics Issues to be Discussed in the Initial Greenhouse Gas Emissions Study Population/Housing Agricultural & Forestry Resources Hazardous Materials Public Services Air Quality Hydrology and Water Quality Recreation Biological Resources Land Use/Planning Transportation/Traffic Tribal Cultural Resources Cultural Resources Mineral Resources Energy Noise Utilities and Service Systems Geology & Soils Mandatory Findings of Significance Wildfire Based on a preliminary review we anticipate that the following topical factors will be determined to be "Scoped Out" of the EIR, based on the Initial Study (that is, these subjects will not be analyzed in the EIR). > Mineral Resources: The project site is mapped in an urbanized area on the Mineral Land Classification map for the San Bernardino Production -Consumption Region. Project development would not adversely affect availability of aggregate mineral resources. ➢ Population and Housing: The project does not propose adding residences or population. The regional employment forecast for the City of Redlands (42,600 in 2016 to 56,300 in 2045, a net increase of 13,700) is sufficiently large that project employment would not exceed the regional forecast and thus would not be a significant adverse impact. ➢ Recreation: Demands for recreational facilities are generated by the population in the facilities' service areas. As the project would not add population to the City, the project would not increase demand for such facilities. ➢ Wildfire: The project site is not located within a fire hazard severity zone mapped by the California Department of Forestry and Fire Prevention, and the nearest such zone is several miles away. Hence, we believe this topical area could be screened out of the EIR. Task 3.2: Revise Initial Study (IS) per City Comments (Two Rounds). UltraSystems will submit the Administrative Draft IS to the City for its review and comment. Our scope and budget provide for two rounds of City review and UltraSystems revisions of the IS; one for the Administrative Draft IS and the another is for the Screencheck IS. Task 3.3: Prepare Notice of Preparation. UltraSystems will prepare a draft NOP for review by the City and will revise, finalize, and distribute the NOP after incorporating team comments. The NOP will contain all the information required by CEQA Guidelines § 15082 and will include a detailed narrative project description with sufficient maps, plans, and other graphics to fully define the project and its location. The NOP will also identify the probable environmental effects and topics identified for analysis in the EIR. UltraSystems will prepare the required notices and file them with the State Clearinghouse and the County Clerk, as well as the local newspaper - notifying the public of the NOP and the Scoping Meeting for the EIR. 230226/City of Redlands Page 8 March 2023 UltraSystems +City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ Task 3.4: Publish/Circulate Notice of Preparation (NOP)/Initial Study. After given the authorization to proceed by the City, UltraSystems will have the NOP/IS reproduced and distributed to up to 20 recipients on a Distribution List, developed in concert with the City. The IS document and notice will be circulated to City departments, local cities, regulatory agencies, trustee agencies, persons of interest, and others via US Mail. Additionally, all Native American Tribes will be sent notification via certified mail. An electronic version (.pdf) will be delivered to City staff for City website posting. Task 3.5: Review Comments Received on the NOP/Initial Study. UltraSystems will review the comments received on the IS/NOP and ensure that all pertinent concerns are considered in the upcoming Draft EIR (DEIR). Copies of all correspondence received by the City throughout the NOP process will be incorporated in a technical appendix to the DEIR. Task 3.6: Scoping Meeting. UltraSystems will assist City staff with the Scoping Meeting. UltraSystems would develop the Scoping Meeting presentation (PowerPoint), agenda, and comment cards for this meeting. Our suggestion is that the Scoping Meeting structure be an Open House Forum with a project specific presentation. Copies of all comments submitted during the scoping meeting will be incorporated in a technical appendix to the DEIR. Deliverables: Presentation materials (agenda, comment cards and presentation materials Ile., exhibits]). MAJOR TASK 4.0 - TECHNICAL STUDIES Task 4.1: Cultural Resources. UltraSystems will prepare a Phase I Cultural Resource Assessment with a records search for a one -mile radius around the project site. The Native American Heritage Commission (NAHC) would be contacted to request a search to identify Sacred Lands and culturally significant sites, if any, and obtain a list of Native American tribes, organizations and interested individuals that should be contacted to provide information on culturally important sites within the one-half mile Area of Potential Effect (APE). Prehistoric and historic archaeological literature and record reviews would include any prior EIRs, cultural technical reports, site records, previous assessments, research designs, monitoring programs, and related cultural documentation to identify cultural resources within the APE. Records would be reviewed at the South -Central Coastal Information Center at California State University Fullerton. A walking survey of the project site following standard professional archaeological procedures would be conducted by UltraSystems staff to determine if cultural resources are present on the surface and identify areas with a high possibility of containing subsurface cultural resources. Artifacts, features, sites, and structures greater than 50 years of age would be photographed and recorded. Based on these data, a Phase I Cultural Resource Survey Report would be prepared to document research methodology and findings and recommendations for avoidance or preservation of cultural resources that may be encountered during construction or other project activities, and provide mitigation measures to protect and preserve cultural resources if avoidance is not feasible in compliance with CEQA and local standards. A site record and/or site record update would be completed and submitted to appropriate agencies upon completion of the field survey. 230226/City of Redlands � rrA UltraSystems Page 9 March 2023 ❖City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ The City will conduct AB 52 consultation with the Native American tribes. UltraSystems will assist the City with the consultation letters to the tribes, if requested. Task 4.2: Paleontological Resources Records Search. UltraSystems will also obtain paleontological resources records searches from the San Bernardino County Museum and from the Western Science Center in Hemet. Findings from the two searches will be incorporated into the EIR. Task 4.3: Noise. UltraSystems will document existing ambient noise levels at the project property line, at proximal residential areas, and along roadway segments that could be affected by the Proposed Project. Ambient noise levels would be measured using a Quest Technologies, SoundPro, DL-1-1/3 noise meter that satisfies standards outlined in American National Standard Institute (ANSI) S1.13-1995 (standard measurement of sound pressure levels in Air). Current and future traffic noise levels along studied roadway segments without and with the project will be estimated using Federal Highway Administration (FHWA) Traffic Noise Model (TNM®), Version 2.5. Noise levels generated by construction activities will be calculated for each phase of the medical center development. UltraSystems has substantial experience with calculating noise levels from all phases of construction, including any demolition and site preparation, excavation, and framing during renovation of existing buildings. When data are available, UltraSystems will obtain information on the length of each phase of construction and the types and numbers of pieces of equipment to be used. Otherwise, equipment requirements and scheduling on the basis of our past experience and our in-house library of noise emissions characteristics of most types of construction equipment will be used. The significance of construction noise exposures will be determined by comparing absolute levels with standards in the noise element of the City of Redlands General Plan and Municipal Code, or by comparing increases in exposure with other relevant criteria. Measures will be recommended as needed to mitigate the impacts of the project. An evaluation of the effectiveness of potential mitigation measures will also be provided. Predicted noise levels will be compared to adopted thresholds and goals, policies, and objectives from the General Plan and conclusions will be drawn as to whether any potential increase would represent a significant acoustical impact requiring mitigation. Noise levels generated by onsite uses, machinery during construction, construction delivery trucks, and landscape equipment will also be discussed and compared to adopted standards. Mitigation will be proposed for all significant noise impacts. Use of heavy earthmoving equipment during construction can generate enough vibration to adversely affect nearby sensitive receivers. UltraSystems will perform a vibration screening analysis, using methods and reference vibration levels from the Federal Transit Administration's Transit Noise and Vibration Impact Assessment Manual (2018) to determine whether construction vibration would be high enough to damage structures or cause annoyance to sensitive receivers. The methods and findings of the noise analysis and vibration assessment will be incorporated into the EIR. No separate noise study report will be produced and included in the technical appendix section of the EIR. Task 4.4: Biological Resources. A review of the current California Department of Fish and Wildlife (CDFW) natural diversity database, United States Fish and Wildlife Service species occurrence database, and United States Department of Agriculture/Natural Resources Conservation Service soils 230226/City of Redlands LIItraSystems Page 10 March 2023 •:• City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR•:• database will be conducted prior to initiating a field investigation in order to identify any potential threatened or endangered species or resources known to exist in this area. The site assessment will include a delineation of all general vegetation communities present within the Project Site and the findings will be incorporated into a Geographic Information System for use during further environmental compliance/engineering analyses (State Plane NAD83, Zone 11- feet), if warranted. The vegetation communities would be mapped based on the Vegetation Classification System - A Manual for California Vegetation (John Sawyer, Todd Keeler -Wolf, and Julie Evens 2009). Cadre Environmental will conduct a field reconnaissance and general biological survey of the entire project site to identify potential habitat for any threatened, endangered, or otherwise sensitive species or habitats, including, but not limited to: • Sensitive plants • Protected trees • Burrowing owl • San Bernardino kangaroo rat • Nesting bird and/or raptor habitat In addition to conducting a biological resources habitat assessment, an analysis will be conducted to identify any areas within or adjacent to the project site which may fall under the jurisdiction of the U.S. Army Corps of Engineers, CDFW or Regional Water Quality Control Board (regulatory resources). Although this will not include a formal delineation, it will characterize the potential constraints associated with "waters of the United States" and "waters of the state" throughout and adjacent to the property, if present. A Biological Resources Technical Report (including supporting graphics) will be prepared pursuant to the requirements of the CEQA, CEQA Guidelines, and the City of Redlands CEQA procedures. Specifically, text sections will include a discussion of the environmental setting (vegetation communities, general and sensitive floral/faunal species habitats, and trees), significant direct/indirect and cumulative impacts, and associated mitigation measures proposed to reduce impacts to less than significant, as warranted. The report will also address biological elements of the following City policies, as warranted: • City of Redlands General Plan 2035 Guidelines (Chapter 6 - Vital Environmental); • Municipal/Development Codes (Chapter 12.52 Trees and Tree Protection along Streets and in Public Places). Deliverables: Draft and Final Report in pdfformat. Task: Task 4.5: Burrowing Owl Focused Surveys - OPTIONAL Based on the results of the biological resources habitat assessment (Task 4.4) focused burrowing owl surveys may be required. If required, the surveys will be conducted in compliance with the guidelines issued by the CDFW Staff Report on Burrowing Owl Mitigation. A total of four visual surveys will be conducted from one hour before sunrise to two hours after sunrise. During each visual survey, all potentially suitable burrow or structure entrances will be investigated for signs of 230226/City of Redlands Page 11 March 2023 UltraSystems .n.nonmcvA.mv eat•0 n in4 ❖City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ owl occupation, such as feathers, tracks, or pellets, and carefully observed to determine if individuals utilize these features. All burrows will be monitored at a short distance from the entrance, and at a location that would not interfere with owl behavior. Weather conditions will be conducive to a high level of bird activity on site. A letter report including graphics, as appropriate, which documents the study findings would be prepared and submitted for the project site. This report will be prepared according to accepted scientific and technical standards and all other pertinent reviewing agencies and organizations. To the extent possible within an inherently technical discipline, report language will be designed for understanding by the lay reader. Results would be incorporated into the final Biological Resources Technical Report. Deliverables: Reports, Assessments or Memorandums would be provided to the City for its review in electronic format. MAJOR TASK 5.0 - PREPARE DRAFT ENVIRONMENTAL IMPACT REPORT Task 5.1: Prepare Administrative Draft EIR. This Task consists of preparation of a complete first draft of the environmental impact report (Administrative Draft EIR) for the proposed project pursuant to CEQA Guidelines § 15120 through 15132. We assume that the City does not yet have information on Phases 2 through 4 of the project that would be required for a project -level impact analysis. Therefore, we are proposing a Program EIR analyzing Phases 2 through 4 at a programmatic level and Phase 1 at a project level. As noted earlier, we anticipate that at least four environmental factors (i.e., mineral resources, population and housing, recreation, and wildfire) will be found to be less than significant in the Initial Study and will not be analyzed in the EIR. The EIR will contain maps, graphics, tables, and charts necessary to clearly depict the location and nature of environmental resources and potentially significant impacts identified in the EIR. The primary components of the Administrative Draft EIR are provided below: Introduction. This section introduces the Draft EIR (DEIR) and the Proposed Project, identifies the statutory authority for its preparation, identifies the City as the Lead Agency and explains how the DEIR constitutes a formal record of the City's environmental review of the Proposed Project. The Introduction will close with a brief description of the DEIR's organization. Executive Summary. The Executive Summary will briefly describe the Proposed Project and its environmental consequences. In a matrix format the Summary will identify each impact and the mitigation measures to reduce or avoid the impacts as needed. The Summary will also identify any known areas of controversy and/or issues to be resolved, including the choice among alternatives. Environmental Setting. For each issue addressed in the Draft EIR, there will be a description of the physical environmental conditions present at the time the NOP is published. The 230226/City of Redlands Page 12 LlltraSystcros March 2023 ❖City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ Environmental Setting section will set forth assumptions used in analysis of cumulative impacts including a list of projects that are under construction or for approval, and regional growth projections. Project Description. The Project Description will identify the project location in a regional and local context; project objectives; and all relevant construction and operations -related technical and environmental characteristics; the intended uses of the document including a list of discretionary actions requiring approval to implement the project; and a list of agencies expected to use the Draft EIR in their decision -making process. Environmental Impact Analysis. Every environmental issue analyzed in the Draft EIR will follow a master format consisting of the following subsections: (1) Regulatory Setting; (2) Environmental Setting, (3) Thresholds of Significance, (4) Environmental Impact(s), (5) Cumulative Impacts, (6) Mitigation Measure(s), and (7) Level of Significance after Mitigation. The environmental impacts subsection of each topical section will address impacts of the whole project at a program level; and then address the impacts of construction and operation of Phase 1 of the project at a project level. Alternatives Analysis. including a discussion of a reasonable range of alternatives to the proposed action. The Draft EIR will include the evaluation of up to three feasible alternatives, including the No Project Alternative. The remaining two alternatives will be developed in consultation with the City. A matrix will present a comparative analysis of the corresponding impacts associated with the project and each of the alternatives identified in the Administrative Draft EIR. Other CEQA Considerations. This section will address growth -inducing impacts; significant and irreversible environmental changes; and significant and unavoidable impacts. Organizations and Persons Consulted. This section includes a list of all organizations and persons consulted during the preparation of the Draft EIR. References and List of Preparers. Includes references and a list of preparers in accordance with CEQA and the CEQA Guidelines. Task 5.2: Revise Administrative Draft EIR per City Comments. This task includes two (2) rounds of City review and comments on the Administrative Draft EIR and UltraSystems revisions per City comments. The City would have up to 15 days to comments on the Draft EIR. Task 5.3: Prepare Draft EIR. After City staff reviews and comment on the Administrative Draft EIR, UltraSystems will revise the Administrative Draft EIR and submit the Screencheck Draft EIR to the City. Our scope and fee assume one (1) round of review. Upon the City's approval UltraSystems will then ready the Draft EIR for public EIR circulation. Task 5.4: Prepare Notice of Availability and Notice of Completion. UltraSystems will prepare a Notice of Availability (NOA) to notify the public, responsible agencies, trustee agencies, the County Clerk, and the State Clearinghouse that the Draft EIR for the Proposed Project is available for review and comment. Consistent with CEQA Guidelines § 15087(c), the notice will contain a brief project 230226/City of Redlands Page 13 March 2023 UltraSystems ❖ City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ description and its location; the public review period during which the City will accept comments; the date, time and place of any scheduled public meeting or hearing; and the addresses and URL where copies of the Draft EIR is available for review. UltraSystems will ensure posting of the NOA at the County Clerk and distribute the NOA to up to 25 recipients. UltraSystems will prepare the Notice of Completion (NOC) and then file that notice with the County Clerk and the State Clearinghouse with the electronic submission of the DEIR to the latter agency. Task 5.5: Public Circulation of the Draft EIR. Upon concurrence of a document distribution list, UltraSystems will distribute the Draft EIR to those agencies, organizations, and individuals required to receive notice. UltraSystems will prepare an electronic version of the Draft EIR and technical appendices in .pdf format to be posted for download on the City's website. Two hard copies will be provided to the City. All mailing will be via US Mail. Only Native American Tribes will be sent notification via certified mail (return receipt requested) and proof of deliveries will be assembled and provided to the City to document compliance. A condensed NOA will be provided in English for noticing in the local newspaper. Deliveries: One electronic copy delivered in digital format containing Administrative Draft EIR, an electronic copy showing responses to City comments/edits in tracked version, and one final clean version with all appendices. Two printed and bound copies containing final Draft EIR and Technical Appendices, Notice of Availability and proof offiling, newspaper version Notice ofAvailability in English. MAJOR TASK 6.0 - FINAL ENVIRONMENTAL IMPACT REPORT (FEIR) Task 6.1: Response to Comments. Following the close of the 45-day public review period and the receipt of all comments on the Draft EIR, UltraSystems will compile, index, and review all written comments. An indexed set of comments will be provided to City staff for review and discussion. After meeting with staff to go over the comments on the Draft EIR, UltraSystems will provide reasoned responses to each comment made on an environmental issue addressing the adequacy of the DEIR. If several comments are submitted on a particular topic, it may be most efficient to prepare a master or topical response on that subject. At this time, it is difficult to project the level of effort that will be needed to respond to comments on the Draft EIR. We have assumed a budget of approximately 48 labor hours for preparing responses to comments. In the event additional effort is needed to complete the response to comments document, UltraSystems will coordinate with the City to secure a contract amendment prior to completing the unfunded portion of our work effort. Task 6.2: Mitigation Monitoring and Reporting Program. UltraSystems will prepare a Mitigation Monitoring and Reporting Program pursuant to CEQA Guidelines § 15097 setting forth each mitigation measure, the timing of the mitigation effort, and the responsible parties for implementation and for monitoring. Task 6.3: Administrative Draft Final EIR. UltraSystems will revise the response to comments to address one round of comments from the City and then assemble the Final EIR. The Final EIR will consist of: (1) response to comments; (2) the Draft EIR revised in response to comments; (3) technical appendices; (4) the Mitigation Monitoring and Reporting Program; (5) Findings of Fact; 230226/City of Redlands Page 14 March 2023 UltraSystems l ❖City of Redlands - Proposal for the Kaiser Permanente Medical Center EIR❖ (6) Statement of Overriding Considerations. The final EIR will be submitted in draft form for review and comment by the City. UltraSystems will revise the document to respond to all comments and it will be finalized for use by the City. Task 6.4: Revise Administrative Draft EIR per City comments. This task includes two rounds of City review and comment on the Administrative Draft EIR and UltraSystems revisions. Task 6.5: Final EIR. Upon City approval of the Final EIR, UltraSystems will circulate the Final EIR to all agencies, organizations, and individuals who provided written comments on the Draft EIR. MAJOR TASK 7.0 - FINAL EIR CERTIFICATION AND NOTICING Task 7.1: Public Hearing. See Task 2.2 above. Task 7.2: Notice of Determination. Upon certification of the Final EIR, UltraSystems will prepare and file the NOD with the County Clerk within five working days of certification pursuant to CEQA Guidelines § 15094. Additionally, copies of the NOD will also be filed with the State Clearinghouse and transmitted to any person who has filed a written request for notices with the designated recipient for comments on the EIR. Payment of California Department of Fish and Wildlife fees is included in our proposal. Task 7.3: Administrative Record - OPTIONAL. UltraSystems will compile and deliver the administrative record, consisting of all the sources cited in the NOP, DEIR, and FEIR, for the project electronically. The administrative record will be accompanied by the compiled references sections of the NOP, DEIR, and FEIR. Deliverables: Notice of Determination and Filing Proof with the County Clerk. 3.0 FEE SCHEDULE The following table provides a cost summary of our proposed fees. And a detailed cost breakdown has been provided in Table 3.0-2, below. The Specific Plan would permit development of up to 1,196 residential units and up to 1.5 million square feet of industrial/logistics building area; land use intensities in the proposed commercial designations and commercial uses in the mixed -use designations are yet to be determined. UltraSystems was tasked with prepared the EIR and providing peer review on all technical studies used in the EIR. She is responsible for overall project management, the preparation and processing of CEQA/NEPA documents, and associated entitlement obligations for large-scale public and private infrastructure projects. SELECT PROJECT EXPERIENCE University Office and Medical Park EIR, San Marcos, CA; March 2006 to July 2008 An applicant proposed to amend the City of San Marcos Specific Plan (SP 90- 24) and develop the University Office and Medical park project with up to 1,070,000 square feet of medical offices, professional offices, a specialized hospital, and support retail. The permitted uses under the University Office and Medical Park project would be uses allowed under the existing Specific Plan. All development would require subsequent approval of a Site Development Permit as set forth in the Specific Plan amendment. A temporary rock crushing facility was proposed for the northeastern portion of the project site, or else offsite on an adjacent parcel, and is being processed under CUP (08-746). The proposed project, as in the existing Specific Plan, would include a helicopter landing site located on the south side of Discovery Street. Five acres of the Medical Office/Professional Office/Hospital/Support Retail development area is identified as a potential future school site and is a possible location for development of an elementary school. Approximately 16 acres on both sides of Grand Avenue in the northern of the proposed Specific Plan area would be preserved as open space under the proposed Habitat Preservation area. Ms. Lindsay served as Principal in Charge for this complex and controversial project, overseeing preparation of the Environmental Impact Report. San Fernando High School Teen Health Center Project, Los Angeles County, CA; January 2012 to November 2012 Ms. Lindsay serves as Principal -in -Charge for the preparation of an Initial Study in support of a Mitigated Negative Declaration that evaluated the environmental effects of constructing and operating a Teen Health Center within the San Fernando Valley High School Campus, San Fernando, CA. The single story, 5000 square foot clinic would contain four medical and two dental examination rooms, four counseling offices, business offices, a sterilization room, dispensary, laboratory, a nurse's station, and a conference room. Prior to beginning construction activity, soils on -site must be remediated to address elevated levels of lead, arsenic, and 4, 4-DDT. The method selected for site remediation involves removing top soil for disposal at an approved facility. UltraSystems prepared an Initial Study Checklist and air quality and noise technical studies that supported the CEQA analysis. Lindsay UltraSystems impact can be reduced to a less than significant level because revisions have been made or agreed to by the project proponents that will avoid or mitigate the effects to a point where no significant effects would occur. Palm Crest Elementary School Modernization; January 2020 to August 2021 The La Canada Unified School District proposes to modernize Palm Crest Elementary School. The proposed project involves the construction one new classroom building, which would be comprised of an east and a west wing. The building would be two stories in height and would include approximately 23,184 square feet evenly divided on the first floor and 2nd floor; renovation of 18 existing classrooms; conversion of one classroom building to four specialty classrooms; demolition of the old District Office and existing garage; removal of trees for construction of a new upper parking lot; alteration/improvement to the existing drop-off area; alteration/improvement to the existing west parking lot; installation of temporary portable classrooms for use during project construction; and repairs/improvements to site utilities, landscaping areas, and pedestrian walkways. As Project Director, Ms. Lindsay oversaw the budget, project management and billing for this project. Ms. Lindsay coordinated directly with the client and oversaw the quality control of the project. This project was approved by the La Canada Unified School District in September 2020. Oro Vista Estates Project, Los Angeles, CA; February 2019 to January 2022 As Principal in Charge, Ms. Lindsay is overseeing the project as a whole and is responsible for assuring that resources are available to complete this project within budget and on schedule. This project proposes to construct 310 units on an approximately 30- acre project site on an undeveloped ridgeline in the City of Los Angeles. Ms. Partridge drafted the project description, agriculture and forestry, and recreation sections of the Initial Study. Draft Environmental Impact Report (EIR)/Draft Environmental Impact Statement (EIS), Rose Hill Courts, Los Angeles, CA; October 2016 to February 2020 As Principal in Charge, Ms. Lindsay is overseeing the environmental document preparation for the Rose Hill Courts Modernization and Rehabilitation Project, which is located on a 5.24-acre site. The project site is one of the oldest, public housing projects in all of Los Angeles, and is currently developed with a total of 15 buildings, comprised of 14 residential buildings with 100-multi-family units, and one administration and community building. The EIR/EIS is being prepared with multiple Lead Agencies, Responsible Agencies and overseen by the Housing Authority of Los Angeles. Critical issues include: traffic, biological resources, aesthetics, noise, air quality, soils, geology, along with public relocation during construction. Target Retail Store - San Clemente, CA; October 2009 to August 2010 Ms. Lindsay served as the Principal -in -Charge for this project. The Target Corporation proposed to develop an approximately 142,000-square-foot retail store on 14.79 acres of undeveloped land within the City of San Clemente. A General Plan Amendment and a Specific Plan Amendment were proposed by the applicant to change the site zoning from Residential Medium to Neighborhood Commercial. The project required the approval of multiple permits including variances, conditional use permits (CUPs), and signage permits. UltraSystems was retained by the City of San Clemente to provide CEQA consulting services. UltraSystems prepared air quality, greenhouse gas, and cultural technical studies, and peer -reviewed biological resources, geotechnical, traffic impact, and visual simulations technical studies prepared by other consultants for the project. UltraSystems prepared the Initial Study, led a public scoping meeting, prepared the Environmental Impact Report (EIR), and circulated the document for public review. The EIR found that development as proposed had the potential to cause significant impacts on aesthetics, air quality, biological resources, cultural resources, geology and soils, and hazards and hazardous materials. Feasible mitigation measures were identified to reduce related impacts to below significant levels. Through extensive ambient noise measurements and detailed traffic noise modeling, UltraSystems demonstrated that noise impacts on nearby sensitive receptors would be less than significant and no mitigation was required. Calabash Trailer Storage Project, Fontana CA; January2018 to February 2019 Ms. Lindsay served as Principal -in -Charge for this project. The project proposes to develop and operate a registered vehicle storage yard and appurtenant facilities on approximately 4.59-acres located in the northwest corner of the Calabash Avenue and Santa Ana Avenue intersection in Fontana, CA. UltraSystems prepared an Addendum to the certified South West Industrial Park Specific Plan Program Environmental Impact Report. The City of San Dimas is processing several land use entitlement applications for the development of two -unit warehouse building totaling 64,422 square feet. The project site is at 309 West Allen Avenue and 917 and 929 North Cataract Avenue. The project site is 2.58 acres and is developed with eight single-family residences. 9160-9176 Sunset Boulevard Project, City of West Hollywood, CA; June 2020 to Ongoing UltraSystems is preparing an Environmental Impact Report (EIR) in response to a development application by a private developer to construct a five -story, approximately 53,029-square-foot commercial building (including retail, restaurant, and office uses on the first floor and exclusively office uses on floors two through five), on an approximately 0.43-acre site located at 9160- 9176 Sunset Boulevard in the City of West Hollywood (City). The proposed project consists of the demolition of the existing commercial buildings and surface parking on the project site. The project would provide approximately 105 car parking spaces in a three -level underground parking structure and include an LED media system, or digital canvas, integrated into the west, north and east facades of the proposed new building. Ms. Gupta is serving as the Project Manager for this project and managing preparation of the CEQA Initial Study, EIR, and required technical studies (including Air Quality, Greenhouse Gas Emissions, Noise, Cultural Resources, Traffic and Visual Impact Assessment studies). Mango Avenue Industrial, City of Fontana, CA; February 2020 to February 2021 Ms. Gupta managed preparation of the CEQA IS-MND for the project and the project has been approved by the City Council. The proposed 115,100-square-foot logistics/distribution center would include an office/mezzanine comprising 6,000 square feet, and a second office of 4,000 square feet. The logistics/distribution center will have 20 truck dock bays, and 10 drive-thru doors, and 90 automobile parking spaces and 23 trailer parking spaces. Primary site ingress and egress is provided at a 40-foot-wide driveway along Mango Avenue in the project site's southeast corner. A second 35-foot-wide driveway would be located along Sierra Avenue at the project site's southwest corner. Clover Warehouse Project, City of Fontana, CA; October 2019 to December 2020 UltraSystems prepared an Addendum to the certified SWIP Specific Plan PEIR for the project. The project consisted of the development of a single 126,807 square -foot warehouse facility, located on a 5.59 gross acre parcel. Ms. Gupta served as the Deputy Project Manager for this project. She is coordinating with the City and assisting with the environmental analysis of potential project impacts. Ms. Gupta also conducted QA/QC review of all sections of the Addendum and supporting Technical Studies prepared for the project. Beech Warehouse Project, City of Fontana, CA; September 2019 to June 2020 Ms. Gupta managed preparation of the CEQA IS-MND for the project and the project has been approved by the City Council. The project site is currently occupied by a one-story 72,850SF industrial building and ancillary uses, which at present, are associated with an operating manufacturing concern with the property frontage along both Santa Ana and Beech Avenues that are lined with trees. Stover Logistics Center Project, City of Fontana, CA; July 2019 to May 2020 Ms. Gupta served as the Deputy Project Manager for the preparation of the IS/MND for the proposed Stover Logistics Center project in the City of Fontana. This project would include the construction and operation of a 109,500-square- foot warehouse logistics/distribution center located on 5.5 acres of land. Ms. Gupta coordinated with the City and assisted with the preparation of the IS/MND. She also conducted QA/QC review of all sections of the IS/MND and supporting technical studies. Village Center Mitigated Negative Declaration, Garden Grove and Stanton, CA; 2018 Mr. Milroy served as project manager for the Mitigated Negative Declaration for this 22-acre mixed -use project in the cities of Stanton and Garden Grove including proposed condominiums, new retail structures, and reuse of existing retail buildings. The project site consisted of two almost completely vacant and dilapidated former commercial developments at one of the gateways into the City of Stanton. The project description and site access changed during CEQA processing. UltraSystems is preparing an IS-MND and several technical studies. 13330 Magnolia Avenue Residential Development — IS-MND, Community of Home Gardens, Riverside County, CA; November 2021 to Ongoing The proposed project consists of development of 46 single-family homes and 44 attached townhomes on a 4.5-acre site in the Community of Home Gardens in unincorporated Riverside County. The site is vacant except for remnants of some historical water wells. UltraSystems is preparing an Initial Study and Mitigated Negative Declaration for the project, in addition to preparing several technical studies and peer -reviewing several other studies. Mr. Milroy is project manager. District at Rubidoux Project, City ofJurupa Valley, CA; October 2021 to Ongoing The proposed project site spans 254 acres abutting the east boundary of the City ofJurupa Valley. The site is bounded by the State Route 60 (SR-60) freeway on the north; Jurupa Boulevard on the west; the Santa Ana River on the east; and residential uses and churches near 34th Street on the south. The project will consist of 1,192 residential units; 2.93 million square feet of commercial and industrial uses; and 10 acres of parks and open space. Mr. Milroy is assistant project manager. City of Commerce Transit Maintenance Facility Project, IS/MND and NEPA Categorical Exclusion; October 2020 to May 2022 Mr. Milroy is Assistant Project Manager for this project, which consists of construction and operation of two transit maintenance facilities, both on industrial sites that would be redeveloped. A temporary facility would be built and operated while a permanent facility would be constructed. General Plan Update EIR, San Bernardino County, CA; 2019 Mr. Milroy wrote numerous sections of the Program EIR for the San Bernardino County General Plan Update which covered all of unincorporated San Bernardino County. Changes to permitted land uses and development intensity were concentrated in four areas; three in the Upper Santa Ana River Valley, and one in the Mojave Desert. Mr. Milroy added a great deal of environmental setting information not provided in the Existing Conditions Reports for the General Plan Update. Mr. Milroy compiled a list of hazardous materials sites in portions of unincorporated San Bernardino County, categorized by site name, type of site, location, and status, at a small fraction of the cost of obtaining a regulatory database search from a commercial vendor. Salient issues addressed in the EIR included biological resources and wildfire hazards. General Plan Update EIR, Los Angeles County, CA; 2014 Mr. Milroy wrote several sections of the Program EIR for the Los Angeles County General Plan Update EIR. Mr. Milroy found sources of information for hundreds of water suppliers at a very small fraction of the cost and time that sending hundreds of service letters would have required. Chadwick Ranch Estates Project, EIR, Bradbury, CA; June 2020 to July 2022 Mr. Milroy is Environmental Planner for this project, which consists of development of 14 estate homes and associated infrastructure and roadways. Santa Angelina Senior Apartment Homes; June 2020 to January 2021 This project consisted of a 65-unit senior residential project in two buildings it the City of Placentia, CA.
