HomeMy WebLinkAboutReso 8509RESOLUTION NO. 8509 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING THE CITY OF REDLANDS 2023 SEWER SYSTEM MANAGEMENT PLAN (SSMP), AS REQUIRED BY THE STATE WATER RESOURCES CONTROL BOARD WHEREAS, on May 2, 2006, the State Water Resources Control Board (SWRCB) adopted Water Quality Order No. 2006-0003-DWQ, which established the Statewide General Waste Discharge Requirements (WDRs) for publicly owned or operated sanitary sewer systems within the State of California. Water Quality Order No. 2006-0003 was later amended by Order Nos. 2008- 0002-EXEC, 2013-0058-EXEC, and replaced by Order No. 2022-0103-DWQ; and WHEREAS, the WDR requires that all federal and state agencies, municipalities, counties, districts, and other public entities that own or operate sanitary sewer systems greater than one mile in length that collect and/or convey untreated or partially treated wastewater to a publicly owned treatment facility in the State of California; 1) report Sanitary Sewer Overflows to the SWRCB; and 2) develop and implement a Sewer System Management Plan (SSMP) which under the current Order is referred to as the Sewer Spill Overflow Emergency Response Plan; and WHEREAS, the SSMP is a written document that details how an entity's sewer system is operated, maintained, repaired, and funded. The WDR requires the SSMP to be updated every five (5) years and to be re -certified by the City Council when significant updates to the SSMP are made. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. This City Council determines that approval of the Resolution to adopt the City of Redlands 2023 Sewer System Management Plan is exempt from environmental review in accordance with California Environmental Quality Act (CEQA) pursuant to Section 15061(B)(3) since it is reasonably certain that this action will have no significant negative environmental effects. Section 2. This City Council further determines that approval of the SSMP is exempt from CEQA pursuant to Section 21000 because it is an action taken by a regulatory agency to assure the protection of the environment and the regulatory process involves procedures for protection of the environment. In addition, this action is exempt from CEQA pursuant to Section 15301 to the extent that it applies to existing sanitary sewer collection systems that constitute "existing facilities" as that term is used in Section 15301, and Section 15302, to the extent that it results in the repair or replacement of existing systems involving negligible or no expansion of capacity. Section 3. This City Council hereby approves and adopts the 2023 SSMP and certifies that it complies with the Statewide General Waste Discharge Requirements (WDRs) for Sanitary Sewer Systems (Water Quality Order No. 2022-0103-DWQ). 1 I:\Resolutions\Res 8500-8599\8509 - 2023 Sewer System Management Plan.docx jm ADOPTED, SIGNED AND APPROVED this 5th day of September 2023.
