W H LKIIAS,the Health tnsuran,,;erortability and Accountability Act of 1996("HIPAA")and
the Fegulations issued by the Department of Health and Human Services under the ACIMimstrativt;
Simplification subtitle of HIPAA (the "Regulations"") establish a regulatory scheme to protect the
cordidentiality of personal health care intormation; and
W hIlKhAS,the Regulations permit an entity like the City of Redlauds("City")that includes
health care components and non-health care components to designate itself a "hybrid entity;" and
WHEKLAS, as a hybrid entity, the City may limit the applicatiun of HIPAA and the
Re8ulations to its designated health care components; and
WHEREAS, the purpose of this policy is to designate the health care components of the City;
NU W, I HtI<-ttuKt, be it resoivcd by the City Council of the City of Redlands("This City
Council") as tollows:
Section 1.Applicability This policy applies to the components of the City designated as health
care compurtunts of the City.
Section 2. Pole The City shall be deemed a "hybrid entity" within the meaning of We
Kegulations. Certain components of the City, as set forth in Exhibit "A" to this policy, shall be
deli mated "health care components" of the City. I he health care components shall be required to
comply with HIPAA and the Regulations.
Section 3. Impler-fteitta phis City Council hereby delegates the responsibility to ensure
compliance with HIFAA and the-Kegulations to the City Manager. The City Manager,or his or her
designee, may amend Exhibit "A" of this Resolution, as appropriate, by adding or deleting health
care components without further action by this City Council, Fovided7 however, that any such
amendment shall be dated and be delivered to the City Clerk of the City for subsequent attachment to
this Resolution and main fienaance in the Official Records of the City.Provision will be made to certity
the training;of City personnel in the health care components about compliance with HIPAA and th,
Regulatio,s. The City Manager is also authorized to take any additional actions necessaiy to assure
compliance of the City with HtrAA and the Regulations.

Secilon 4.Appointment of Privacy Utticer. =the City Manager shall cause a Privacy Utticer to
be desicnated to, the City, as reLtuired by the Regulations, and any additional staff necessary for
timely implementation and compliance with g1PAA and the Kegulations.

& Accountability Act of 1996, As Amended
